NY unemployment audit closed 09/07/2021 - Still no explanation or state refund after a week

So I just checked my ny unemployment tax status online and saw this message that caught me off guard: "Audit Status Your audit case was closed on 09/08/2021. You should receive an explanation of our findings within 30 days." My audit case was closed on 09/08/2021. Supposedly I should receive an explanation of the findings within 30 days. I already got my federal refund like 2 months back, but my state refund is still nowhere to be seen. I'm totally confused about what this means? Does anyone know if I'm going to get my money or if they're keeping it? Never been audited before and now I'm freaking out a bit about what comes next. Its been like a week since the case closed date. I don't understand why I'm just seeing this now when the case was apparently closed back in September 2021. I haven't received any explanation of findings that the message mentions should arrive within 30 days. Should I have received something in October 2021? Has anyone else experienced this kind of delay or confusion with NY unemployment tax audits?

Miguel Ramos

The same thing happened to me last year. When they say the audit is closed, it usually means they've finished reviewing your stuff and now they're preparing the letter to tell you what they found. In my case, they found I had underreported some income (honest mistake), so I had to pay a bit more. It took about 3 weeks to get the letter after seeing that message. Don't stress too much - could be nothing or could be something small they found.

Thanks for sharing your experience! Did you end up having to pay a penalty on top of what you owed? That's what I'm worried about most tbh

Yeah there was a small penalty, like 4% of what I owed. Not terrible but annoying for sure. They gave me a payment plan option too

mine took almost 40 days to get the letter so dont panic if it goes over their '30 day' timeframe. the whole system runs on its own schedule 🙄

After dealing with endless issues trying to call ny unemployment about my audit, I finally found a service called Claimyr that got me through to an actual person! They did the calling and waiting for me, then connected me when an agent was on the line. Talking to an agent got my situation resolved WAY faster than waiting for letters. Best decision I made throughout this whole mess! Here's a video about how it works: https://youtu.be/Rdqa1gKtxuE

This sounds fishy. Has anyone else actually tried this? How do we know it's not just another scam?

I was skeptical too at first but it's 100% worked for me. They just call and wait on hold so you don't have to. When an agent picks up, they connect you. Saved me hours of frustration.

another day, another company promising to fix the unfixable unemployment system lol. what makes this one special?

The difference is they don't claim to fix the system - they just help you navigate it by doing the annoying waiting part. I spent 2 hours on hold before trying them. With Claimyr I was talking to someone in 45 mins and didn't have to listen to that terrible hold music 🙌

I used it too after seeing it recommended here. The waiting is the WORST part of dealing with unemployment and this solved that problem.

I went through an audit back in September. Generally, a closed case means they've made their decision. If they found you owe money, they'll send a letter explaining what you owe and why. If they found nothing wrong or that they owe YOU money, they'll send the refund with an explanation. Mine took exactly 26 days to get the letter after the case closed. Hang tight!

Check your mail CAREFULLY! My audit letter came in an envelope that looked exactly like junk mail and I almost threw it away. When they say 30 days, they really mean 30-45 business days in government time 😂

omg this is so true. mine came in what looked like a credit card offer. nearly went straight to trash!

I'm actually going thru the EXACT same thing right now. My case closed on 11/19 so almost same timing as yours. Super nerve wracking. If you get your letter please post an update. I'll do the same if mine comes first.

Will do! Hope we both get good news. This waiting game is killing me.

Got my letter yesterday! They found I was actually underpaid on unemployment by $1,240 so I'm getting an additional payment. Check your mail soon!

I work for an accounting firm that deals with ny unemployment audits all the time. "Case closed" means they've made their determination. Here's what typically happens: 1. You'll get an official letter within 30 days (though it sometimes takes longer) 2. If they found you owe money, you'll have 30 days to pay or appeal 3. If they found they owe you money, refund will usually come 2-3 weeks after the letter 4. If they found nothing wrong, they'll just send a letter saying case is resolved One important thing - if you don't receive a letter within 45 days, CALL THEM. Sometimes letters get lost. The claimyr.com service others mentioned is actually helpful for getting through to someone quickly instead of waiting on hold forever. Hope this helps ease your mind a bit. Most audits are routine and nothing to panic about.

What happens if you can't pay what you owe? Asking for a friend 👀

They'll work with you on payment plans. NY is actually pretty reasonable about this. The important thing is to respond to the letter and not ignore it. That's when penalties start adding up fast.

Thank you so much for this detailed response! Super helpful to understand the process better. Fingers crossed I'll get my letter soon.

not trying to scare u but my friend got audited and ended up owing $4800!!! make sure u have all ur documents ready if they ask for more proof. the process is brutal 😭

-

Ugh that's exactly what I'm worried about. Did they have to pay it all at once or could they do payments?

they set up payments thank god. like $200/month for 2 years. still sucks tho

honestly the ny unemployment system is such a mess. ive been dealing with them for months. best advice I can give is document EVERYTHING. save every letter, record every phone call (if its legal in your state), take screenshots of everything online. bureaucrats love to 'lose' paperwork when its convenient for them.

dont worry too much. i got audited last yr and it turned out they owed ME money. got an extra $320 that I wasn't even expecting! sometimes audits work in your favor 💯

I'm in a similar boat. Been trying to call the unemployment office for 2 weeks straight with no luck. Finally tried claimyr.com that someone mentioned here and got through to a real person today. The agent told me that 'case closed' usually means good news - if they found a problem they'd keep it open until resolved. So maybe a good sign for you!

That's actually really reassuring to hear! Hopefully that's true in my case too. Thanks for sharing that info!

My cousin works at the unemployment office (not in NY but similar systems). She says audits are mostly automated these days. They run your numbers through a system, flag discrepancies, then a human reviews the flags. If the case is closed, it means either no issues found or they've determined what the issue is. Either way, the waiting for the letter is the worst part!

THE MAIL IS SLOOOOOW RIGHT NOW. My audit letter took 6 weeks to arrive even though the website said 30 days. And then when I called they claimed they'd sent it 4 weeks earlier. The whole system is a joke honestly.

fr the post office is struggling baaaad lately. had a package that took 3 weeks to go 20 miles 🤦‍♀️

Did you claim any weeks while you were working or receive benefits you weren't eligible for? Thats usually what triggers these audits. If not, you're probably fine.

0 coins

-

Ava Thompson

Nope, I was careful about that. I did work part-time for a few weeks and reported all income. Maybe they're just double-checking those weeks?

0 coins

-

25d

Chloe Harris

Thats probably it. They sometimes just verify income reports, especially with part-time work. If you reported everything correctly you have nothing to worry about.

Just a warning, I've gone through this and THE WORST THING you can do is ignore that letter when it comes. Even if you can't pay or disagree with their findings, respond within the timeframe they give you. Silent protest = maximum penalties.

After battling with ny unemployment for months, I've learned that the only way to get real help is to speak with an actual human. Claimyr helped me do that without wasting hours on hold (claimyr.com). Worth every penny to get my issue resolved FINALLY.

It's literally just a call service. They wait on hold so you don't have to - when a real agent comes on the line, you get connected. That's it. Saved me 3+ hours of waiting.

I tried it too. Finally got through after weeks of trying to call myself. Got my issue resolved in one call.

ur probably fine unless u lied about something big. they mostly go after people who were committing actual fraud. small mistakes usually just mean u pay the difference without penalties or anything dramatic.

Anyone else dealing with NY unemployment tax issues right now? I feel like they're doing a sweep of audits because EVERYONE I know on unemployment is getting reviewed suddenly. 🤔

Nia Wilson

YES! three people in my apartment building got audit notices last month. something fishy going on

I think they got extra funding to go after fraud so they're reviewing more cases than usual. That's what the agent told me when I called.

If u have a state representative or assemblyperson, sometimes their offices can help speed things up if you don't get your letter in a reasonable time. They have special contacts at unemployment that regular ppl don't have access to. Worked for me last year when I was in limbo for 2 months.
