Made $0.90 over NY unemployment weekly limit - will I lose my entire benefit?
So frustrating. I picked up a few extra hours at my part-time gig last week and when I calculated my earnings, I made $504.90 - literally 90 cents over the weekly benefit threshold of $504. I'm scared to certify because I don't know if they'll just reduce my benefit by $1 or if I'll lose the entire week's payment. Has anyone dealt with making just slightly over the limit? Will the system automatically disqualify me for the whole week because of 90 freaking cents? The rules seem so rigid and I really can't afford to lose a full week's worth of benefits right now.

Yep, unfortunately it's a hard cutoff at $504. I learned this the hard way when I made $505.12 back in November. Lost the entire benefit for that week. The system doesn't care if it's 1 cent or 100 dollars over - if you exceed the threshold, you get nothing for that week. It totally sucks.

•Are you serious?? That's so messed up. You'd think they'd prorate it or something. Did you try calling to appeal or explain it was just a few bucks over?

•I tried calling but got nowhere. They just kept saying 'thats how the system works' 🙄 Spent 2 hours on hold just to be told 'rules are rules.' Complete waste of time.

•Could've saved yourself the headache with claimyr.com - they would've waited on hold for you at least. Not that it would have changed the outcome, but at least you wouldn't have wasted 2 hours of your life.

After struggling for weeks to get through to NY unemployment, I finally tried a service called Claimyr that helped me reach an actual human. They got me a callback from an agent who fixed my issue in minutes. talking to an agent got my $ unlocked so fast, wish I'd known about this sooner! https://youtu.be/Rdqa1gKtxuE

•Does this actually work? Sounds too good to be true. How did they get you through when the phone lines are always jammed?

•Yep it works! They basically call repeatedly and stay on hold for you, then when they get a real person they connect you. Saved me HOURS of frustration.

•idk seems sketchy. why would they help people get through? what's their angle?

•They're a business that charges for the service, but it was worth every penny to actually get my issue resolved. Check out claimyr.com if you're interested.

•I've used them twice now. Both times got me connected with an agent in under an hour when I had spent DAYS trying on my own 💯

This exact thing happend to me omg. But I was like $1.25 over. Honestly, just report the correct amount but maybe wait until next week to certify (like Monday night) and by then the week will be over anyway so you won't have to worry bout them asking for the money back. Just my 2 cents! 🤔

So here's what you need to know about NY unemployment's partial benefit formula: If you earn more than $504 in a week, you lose ALL benefits for that week. There's no sliding scale or partial payment once you cross that threshold. This is different from some other states that gradually reduce benefits based on earnings. New York has what's called a "cliff" where you hit $504 and fall off. Your options are: 1) Report accurately and accept no benefits that week 2) Make sure next time you stay under the limit 3) If you think there's been a calculation error on your part, you could try calling, but good luck getting through without using something like claimyr.com Remember that accurately reporting your income is required by law. The system cross-checks with employer reports, so be honest to avoid future problems. Also worth noting: you can still certify for weeks where you make over the limit - you'll just receive $0 for that specific week but remain in the program for future weeks.

•This is really helpful, thanks. So basically I'm just out of luck for this week? There's no appeal process for such a tiny amount over?

•Unfortunately no appeal process for being over the limit, even by a small amount. The $504 threshold is set in stone. Just make sure you still certify so your claim stays active!

•I've used claimyr.com to get an agent when I had a similar issue - they couldn't change the rule but at least I got a clear answer without waiting for hours.

U could just report that u made $503.90 instead... just saying 👀

•Not a good idea. That's fraud and they do cross-check with employer reporting. Don't risk your entire claim over 90 cents.

•oh please, like they're gonna come after someone for 90 cents 🤣

•They absolutely will. The system is automated and flags ANY discrepancies. My friend got her benefits suspended for 3 months over a $12 difference. Not worth it!

•Terrible advice. Never lie on your certification.

Nyc resident here. I went through something similar last month. I called the unemployment office and the lady told me that it's a strict cutoff at exactly $504.00. So unfortunately you'll lose the entire benefit for that week. But at least you'll still be eligible for future weeks. Just make sure you certify accurately!

•How'd you actually get through to a person? I've been trying for days with no luck.

•Honestly it was pure luck. Called at exactly 8:00am on a Tuesday and only waited about 30 minutes. Every other time I've tried it's been impossible.

The system is designed to crush our souls, 90 cents at a time 😩

I don't think anyone's mentioned this but sometimes there's a calculation difference between how you count hours/wages and how your employer reports them. So it might be worth double-checking your math. Are you including lunch breaks? Different pay periods? Might be worth taking another look to see if you're actually under the limit.

•That's actually a good point. I'll double check my calculation. Maybe I can actually come in under the threshold with some adjustment.

Quick update: In case anyone in the future stumbles on this post, I'm in NY and had almost the exact same situation a few months back. It turns out NY unemployment rules are very strict about income limits, so make sure you calculate your weekly hours carefully! If your employer cuts your hours slightly differently than expected, it can push you over the threshold. I'd recommend trying to stay at least $20 under the limit just to be safe.

•This is good advice. I always try to stay at least $30 under because I've been burned before too.

Have you tried reaching out to your employer? Maybe they could adjust your hours for last week if you explain the situation? Worth a shot.

•I hadn't thought of that. Not sure if they'd be willing to adjust after the fact, but I could try.

•Most employers won't do this cause it messes up their payroll records. but if you have a cool boss maybe worth asking?

It's incredibly frustrating that the NY unemployment system has these hard cutoffs. In some other states, they gradually reduce your benefit as you earn more rather than this all-or-nothing approach. Maybe write to your state representatives about changing this policy? It punishes people for working more hours which seems counterproductive.

•Lol good luck getting any policy changed. Been this way for decades and they dont care.

•Actually there was a bill proposed last year to create a sliding scale for partial unemployment in NY. It didn't pass but at least it's on their radar.

Double-check if you're calculating your gross wages correctly. It's pre-tax, pre-deduction amounts that matter for unemployment. Sometimes people accidentally use their net pay which is lower.

Fun fact: if you divide 504 by 8 hours, that's $63/hr... so they basically expect you to make less than $63/hr or lose ALL benefits... makes no sense for those of us making way less than that normally 🤔

Liam Sullivan
•Your math is off. The $504 is for the whole week, not per day.
