How to withdraw an unemployment claim with NYS Department of Labor - need help ASAP

I filed for unemployment benefits two weeks ago but now I got called back to work full-time starting Monday. I need to withdraw my unemployment claim completely but can't figure out how to do it on the my.ny.gov website. I don't want any issues with NYS Department of Labor later if I need to file again. Has anyone successfully withdrawn their claim? What's the process?

You can't technically 'withdraw' a claim once it's filed, but you can stop certifying for weekly benefits immediately. Log into your my.ny.gov account and simply don't file any more weekly claims. The claim will become inactive after you miss filing for a few weeks. Make sure to report your return to work date if they ask.

Thanks! So I just stop filing the weekly claims and that's it? I was worried there was some formal withdrawal process I was missing.

Actually you should call NYS Department of Labor to report your return to work. They have a specific procedure for this. If you just stop filing without reporting, it might flag your account for potential issues if you need to file again later.

Good luck getting through on the phone though. I've been trying to reach someone at NYS Department of Labor for three days straight and keep getting the busy signal.

If you're having trouble reaching NYS Department of Labor by phone, I recently used a service called Claimyr that helped me get through to an actual agent. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me hours of calling.

wait so if I got a job offer but haven't started yet should I keep filing weekly claims until my actual start date or stop now??

Keep filing until your actual start date. You're still unemployed until you begin working. Just make sure to report your last day of unemployment accurately on your final weekly claim.

The NYS Department of Labor system is so confusing about this stuff! I had the same situation last year and just stopped filing. Never had any problems when I had to file again a few months later. I think you're overthinking it tbh

Congrats on getting called back to work! That's awesome news. I'm still waiting to hear back from my old job.

I went through this exact same situation last month! You definitely want to call the NYS Department of Labor to officially report your return to work date - don't just stop filing without notifying them. When I called, they updated my claim status immediately and gave me a confirmation number. It only took about 10 minutes once I got through to an agent. The phone lines are usually less busy early in the morning around 8 AM if that helps!

That's really helpful to know about the confirmation number - I didn't realize they would give you one when you report returning to work. Did you have to provide any specific information like your employer details or just the start date? And thanks for the tip about calling at 8 AM, I'll definitely try that tomorrow morning!
