How to unfile for unemployment - NYS Department of Labor claim withdrawal process?

I filed for unemployment benefits last week but now I got called back to work full time starting Monday. I don't want to mess anything up with NYS Department of Labor or have issues later. Is there a way to unfile or withdraw my unemployment claim before it gets processed? I haven't received any payments yet and my claim is still showing as pending. Don't want to accidentally commit fraud or anything. What's the proper way to handle this?

You can't technically 'unfile' a claim once it's submitted to NYS Department of Labor, but you can stop the process. Don't file any weekly claims and your claim will become inactive. If you've already filed weekly claims, you need to report your return to work immediately on your next certification. The system will automatically stop payments once you report full-time employment.

Thanks! So I just don't do the weekly certification thing? I haven't done any of those yet since I just filed the initial claim.

Yeah just don't certify for benefits and you'll be fine. The initial claim just establishes your eligibility but you only get paid when you file weekly claims. Since you're going back to work full time you wouldn't be eligible anyway.

Actually had the same thing happen to me last year! Got called back literally 3 days after filing. I called NYS Department of Labor to ask and they said exactly what the others mentioned - just don't file weekly claims. The claim stays on file for a year in case you need it later but no payments get made. Super easy fix.

That's reassuring, thank you! Did you have any issues when you actually needed to use unemployment later?

Nope, when I got laid off again 8 months later I just had to reopen the existing claim. Way easier than starting from scratch.

Wait I'm confused... if you don't file weekly claims does that mean your claim gets cancelled? What if the job doesn't work out and you need unemployment again in a few weeks?

The claim stays active for one year even if you don't certify weekly. If the job doesn't work out, you can always restart weekly certifications as long as you meet the work search requirements and are available for work.

Just wanted to add - if you're having trouble getting through to NYS Department of Labor to confirm this, I recently used claimyr.com to actually reach a real person. They have this system that calls you back when an agent is available. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Might be worth it for peace of mind since you want to make sure you're handling this correctly.

Thanks for the suggestion! I think I'm probably okay based on what everyone else said but good to know there's an option if I need to talk to someone official.
