How long do you have to wait to reapply for unemployment benefits in NY?
My unemployment claim ended about 6 months ago and I was working part-time but just lost that job too. I'm trying to figure out how long I need to wait before I can file a new claim with NYS Department of Labor. I've heard different things - some people say you can apply right away, others say there's a waiting period. Does anyone know what the actual rule is? I don't want to mess anything up by applying too early.

You can actually file a new claim right away if you've worked and earned wages since your last claim ended. NYS Department of Labor doesn't have a specific waiting period between claims. The key is that you need to have earned enough wages in your new base period to qualify for a new claim. If you worked part-time for 6 months, you should have some earnings that could establish a new benefit year.

I went through this same situation last year. You need to have earned at least $2,700 in your base period to qualify for a new claim. The base period is usually the first four of the last five completed calendar quarters before you file. So if you file now, they'd look at your earnings from roughly January 2024 through December 2024.

Just be prepared for the NYS Department of Labor system to be slow processing your new claim. When I reapplied it took forever to get through to someone to verify my work history. I kept calling but could never get past the busy signal.

The whole system is such a mess. I tried to reapply last month and they're saying my wages don't count or something even though I definitely worked. Now I'm stuck in adjudication AGAIN. NYS Department of Labor makes everything so complicated for no reason.
