When can i reapply for unemployment after being denied - NYS Department of Labor timing question
Got denied for unemployment benefits back in October and I'm wondering when I can try filing a new claim with NYS Department of Labor? My situation has changed since then - I was working part time when I first applied but now I'm completely unemployed after my job ended last month. The denial letter mentioned something about not meeting monetary requirements but I've earned more wages since then. Does anyone know if there's a waiting period before you can reapply or can I file a new claim right away? Really need to get this sorted out because my savings are running low.

You can file a new claim immediately if your circumstances have changed significantly. Since you've earned additional wages since your denial, you may now meet the monetary requirements. The key is that this would be a completely new claim, not an appeal of the old one. Make sure you have all your recent pay stubs and W-2s ready when you apply through the NYS Department of Labor website.

•Thanks! So I don't have to wait any specific amount of time? I was worried there might be some kind of penalty period.

i got denied twice before finally getting approved on my third try. each time my work situation was different so they treated it as a new claim. just make sure you really qualify this time or you'll be back to square one

•Three tries seems excessive. Did you appeal any of those denials? Sometimes it's better to appeal if you think the decision was wrong rather than filing new claims repeatedly.

I had similar issues reaching NYS Department of Labor to ask about reapplying. Kept getting busy signals and their online chat never worked. Finally used claimyr.com to get through to an actual agent who explained everything about new vs. appealed claims. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me weeks of trying to get answers.

•How much does that service cost? I'm already broke from being unemployed lol

•It was worth it for me just to get clear answers about my options. Better than wasting time filing claims that might get denied again.

The whole NYS Department of Labor system is so confusing!! Why can't they just have clear information about this stuff on their website? I've been going in circles trying to figure out if I should appeal my old claim or file a new one. This is ridiculous.

•I understand the frustration. Generally, if your work situation and earnings have changed significantly since the denial, a new claim is the right approach. If you think the original denial was an error based on the same circumstances, then appeal.

@Sofia Morales - since you mentioned your job ended last month and you've earned more wages since October, you should definitely be able to file a new claim right away. The monetary requirements are based on your earnings in the "base period" (usually the first four of the last five completed calendar quarters), so your additional work since the denial could make you eligible now. Just make sure to gather all your recent pay documentation before applying online. Good luck!

•This is really helpful info about the base period! I didn't realize they look at specific quarters like that. So if I worked more hours between October and when my job ended last month, those wages should count toward meeting the monetary requirements now. Thanks for breaking it down so clearly!

Just want to add that when you file your new claim, make sure to be very clear about the dates you worked and your reasons for separation from your most recent job. Since you mentioned your job ended last month, they'll want to know if you were laid off, quit, or terminated - this affects eligibility. Also, don't mention your previous denied claim unless they specifically ask about it. Treat this as a completely fresh application based on your current circumstances. The system will automatically check if you meet the monetary requirements based on your updated work history.

•This is excellent advice about being clear on separation reasons! I'm in a similar situation and was wondering - if you were laid off from your most recent job, does that automatically make you eligible even if your previous claim was denied for monetary reasons? Or do you still need to meet those wage requirements regardless of the separation reason?
