Can you get unemployment twice from NYS Department of Labor after previous claim ended?
My first unemployment claim ended about 8 months ago when I found a job. Unfortunately that position was eliminated last week due to company restructuring. I'm wondering if I can file for unemployment benefits again through NYS Department of Labor or if there's some kind of waiting period? I worked the full-time job for about 7 months before the layoff. Has anyone been in this situation before? I'm not sure if my previous claim affects my ability to file a new one.

Yes, you can absolutely file a new unemployment claim! Since you worked and earned wages after your previous claim ended, you're eligible to file again. NYS Department of Labor doesn't have a waiting period between claims as long as you meet the work requirements. You'll need to file a new initial claim, not reopen your old one.

i did this same thing last year, filed twice in one year because of two different layoffs. the second claim processed just fine, took about the same time as the first one

Make sure you have your separation paperwork from the recent job when you file. NYS Department of Labor will calculate your benefit amount based on your most recent base period wages, which should include the job you just lost. The 7 months of work you mentioned should definitely qualify you for benefits.

I've been through this exact situation multiple times unfortunately. The key thing is that you earned sufficient wages in your new base period. Since you worked 7 months full-time, you should be fine. Just file online through my.ny.gov as soon as possible since benefits start from the week you file, not when you lost your job. Just to add - when I filed my second claim last year, NYS Department of Labor required me to do the whole job search requirement thing again even though I had done it before. So be prepared for that if your claim gets approved.
