Got denial letter from ny unemployment but system still lets me certify weekly - what's going on?
Found a denial letter in my mailbox from unemployment about 2 weeks ago. The letter was dated July 5th and basically said I wasn't eligible for benefits because I didn't earn enough in my base period. The weird thing is, I can still log into the ny unemployment website and certify every week like normal. I've been doing this for the last 3 months and even got payments for the first 6 weeks before the letter came. Haven't seen any money since getting the letter but the system still lets me certify. Should I stop certifying? Am I doing something wrong here? I'm really confused why they would deny me but still let me claim. Anyone else experienced this? Not sure if this is a glitch or if I should be appealing the denial or what.

This is a classic example of the left hand not knowing what the right hand is doing at NYSDOL 🙄 Same thing happened to me last October. Keep certifying weekly! You might wanna appeal that denial letter asap tho - there's a time limit (I think like 30 days). The online system and the paper notices aren't synced up properly half the time.

•Thanks for the advice! Do you know how I go about filing an appeal? Is there a form online or do I need to call them?

•There should be instructions on the denial letter itself. But good luck getting through on the phone 😩 I spent 3 weeks trying before I found claimyr.com and got a callback same day. Saved my sanity fr

•wait what's claimyr? another app that promises to help with unemployment? does it actually work??

•It's not an app - just a service that calls DOL for you and then connects you when they get a human. And yeah it worked for me when nothing else did. Check out their demo video: https://youtu.be/Rdqa1gKtxuE

After spending weeks trying to get through to NY unemployment by phone, I finally found this service called Claimyr that literally saved me. They call for you and connect you with a live agent when they pick up. talking to an agent got my $ unlocked so fast after getting a weird denial letter similar to yours. check them out at claimyr.com - it was the only way I could talk to a live agent after trying for days on my own. https://youtu.be/Rdqa1gKtxuE

•sounds too good to be true tbh. did you actually try it yourself?

Maggie Martinez
•Yep, used it twice actually. First time got through in about 45 mins, second time took longer (like 2 hours) but still better than the DAYS I spent trying to call myself. It's literally the only reason I got my case fixed.

•I'm always suspicious of these services... but at this point I'm desperate enough to try anything 🤷♀️

•I was skeptical too, but after attempting to call for 3 straight days and never getting through, I was ready to try anything. This actually worked. They just dial for you basically.

KEEP CERTIFYING NO MATTER WHAT!!!! That's the #1 rule with unemployment. Even if there's a problem or pending issue, if you stop certifying you'll lose those weeks forever. The system probably has a glitch or your case is under review. Has happened to a bunch of ppl I know. Just make sure you're answering the weekly questions honestly.

The exact same thing happened to me back in April. I got a denial letter but could still certify. Turned out there were two claims in the system - one was denied but the other was active. Had to call them to sort it out though which was a nightmare. Spent like 8 hours on hold over 3 days before I finally got through. Definitely keep certifying weekly while you try to resolve this. If it turns out you ARE eligible, you'll only get paid for weeks you certified for. And check your online account for any messages or outstanding tasks - sometimes they need more info but the letter doesn't make that clear.

•Wow, really? Two claims? I'm gonna check my online account more carefully to see if something like that happened. Thanks!

•same thing happened to me last year! the system had somehow created a duplicate claim when I had to reapply after my benefit year ended. super confusing

CALL THEM IMMEDIATELY!!! This happened to me and I kept certifying for like 2 months thinking eventually it would sort itself out... ended up owing all that money back because I wasn't actually eligible but the system let me certify anyway. Don't make my mistake!

•Oh no that's exactly what I'm worried about... did you have to pay it all back at once?

Monique Byrd
•No they put me on a payment plan, but still... it was money I thought I was entitled to and had already spent some of. Just try to get ahold of someone ASAP to figure out what's really going on with your claim.

•If you're having trouble getting through on the phone, I used claimyr.com and finally got to talk to an agent after weeks of trying. Just putting that out there.

So apparently, there's a thing called a "partial approval" where they approve you for some weeks but not others based on your earning history. But the system is so outdated it sometimes sends full denial letters even in partial cases. Definitely appeal! And yes keep certifying.

•That's interesting... maybe that explains why I got payments for the first 6 weeks but then they stopped after I got the letter?

•Exactly! That's probably exactly what happened. The system is so broken lol. But you definitely need to talk to someone to get it sorted out.

Check your payment history in your online account. If it shows those first 6 weeks as "paid" but recent ones as "pending" that tells you something different than if they all say "denied." Also look for any correspondence in your online inbox - sometimes they send important notices there that never come in the mail.

I'd be real careful here. I've heard horror stories of people who kept claiming after being denied and then got hit with fraud penalties. Not trying to scare you, but you should definitely appeal that denial AND try to speak with someone to clarify your status ASAP.

•Fraud penalties?? That's terrifying. I've been answering everything honestly but now I'm worried...

•As long as you're being truthful in your certifications you should be ok. But definitely get it sorted out sooner rather than later. The unemployment system is a mess but they do eventually catch discrepancies.

Here's what you need to do (I worked through this exact situation last year): 1. DEFINITELY keep certifying weekly - that's your lifeline if it turns out the denial was in error 2. Check if the denial letter has appeal instructions - there should be a form you can fill out and mail back 3. Try to reach a live agent to explain the situation - this is the most important step 4. Review all correspondence in both your online account AND physical mail - sometimes critical info is only in one place 5. Make sure your work search activities are documented properly 6. If you're having trouble reaching someone by phone (and you will), I highly recommend using claimyr.com - it's a service that calls for you and connects you when they reach a live agent The NYSDOL systems don't communicate well with each other. The certification system and the eligibility determination system are basically separate. When I was in your situation, it turned out there was a simple earnings calculation error that I was able to resolve once I finally spoke with someone. Good luck! The system is frustrating but don't give up on what you're entitled to.

•Yeah it does. I was super skeptical but after trying for literal WEEKS to get through myself, I gave it a shot. Had an agent on the phone within 2 hours. Best decision I made during my whole unemployment nightmare.

anyone else think its wild that in 2023 the ny unemployment system is still this broken? like how hard is it to make a system that doesn't send denial letters to people who are actually approved?? 🤡

Do not stop certifying!!!! Keep doing it every week! My husband got a denial letter in May but kept certifying and after he finally got through to someone on the phone, they fixed something in the system and he got backpay for all those weeks. If he had stopped certifying he would have lost thousands.

Did you check if you have a hearing scheduled? Sometimes they send a denial letter but also schedule an appeal hearing automatically. Check both your online account and any other mail you might have received.

•I haven't seen anything about a hearing, but I'll double check all my mail and my online account. Thanks for the suggestion!

You need to get on the phone with them RIGHT NOW. This happened to me - and guess what? Six months later they hit me with an overpayment notice and I had to repay everything plus interest. Don't mess around with this - find a way to talk to a real person immediately.

Alejandro Castro
•That's horrible! Did you try to appeal the overpayment?
0 coins
Romeo Barrett
•I did appeal but they denied it because they said the original denial letter was clear and I should have stopped certifying. It was a nightmare. Only got resolved when I finally reached someone by phone who actually understood the situation.

•This is why I recommend claimyr.com - trying to call NYSDOL directly is almost impossible these days but this service got me through in a couple hours.

APPEAL THE DENIAL!! You only have 30 days from the date on the letter. There should be instructions on how to appeal right on the denial letter. Missing that deadline can cause huge problems down the road.

Lourdes Fox
•Thanks for the reminder - the letter is from July 5th so I better get on this immediately!

•Yes hurry! Even if you're not sure about appealing, file it anyway. You can always withdraw it later, but you can't file after the deadline passes.

This is so typical of NY unemployment 🙄 Their left hand has no idea what their right hand is doing. Last year they told me I was denied, then approved, then denied again, all while letting me certify weekly. Take screenshots of EVERYTHING in your account - payment history, correspondence, etc. You'll need it when you finally talk to someone.
