Eight weeks of ny unemployment backpay stuck because of 'under review' teaching documents
This is getting ridiculous! I've been trying to get my backpay for almost 8 weeks now. I work as a substitute teacher on a per diem basis, and my unemployment account technically expired last Monday. I submitted all my teaching documentation weeks ago, but they're still sitting 'under review.' Called last Tuesday and the rep told me to call back Friday to get my account expedited. So I called today and now they're giving me a completely different story! They say they can't release ANY money while documents are under review and I should call back when a full 12 weeks passes (that would be October 7th). Has anyone dealt with this before? Should I just keep calling until I find someone who will actually help me, or am I wasting my time? I'm seriously frustrated with this whole process.

Keep calling! I was in a similar situation last year where they held my benefits for 6 weeks because of a 'pending document review'. I called literally every day for a week straight. First 4 reps told me to just wait, but the 5th one actually fixed it right on the spot. The key is getting the right person who knows what theyre doing.

•Thanks for giving me some hope! How many times did you typically have to call to get through to a real person?

•Honestly it was a nightmare. I was on hold for 2-3 hours each time. That's why after the 4th try I was ready to give up.

•This is why I used claimyr.com - skipped all that waiting on hold garbage and got connected to an agent in like 20 minutes. Totally worth it when ur desperate.

•Never heard of that. Does it actually work? I'm desperate enough to try anything at this point.

•Yeah dude, saved me hours of frustration. They do the hold time for you and call when an agent picks up. My issue got resolved in one call after weeks of getting nowhere.

After weeks of getting nowhere with ny unemployment, I used this call service called claimyr.com that got me through to an actual human at NYSDOL. They did all the waiting on hold, then called me when they got a rep on the line. Talking to an agent got my money released in one phone call after a month of delays! Check out this video about how it works: https://youtu.be/Rdqa1gKtxuE

•wait for real? sounds to good to be true tbh... does it actually work?

•Yep, worked for me! They wait on hold so you don't have to, then call you when they get a real person. Was the only way I broke through the unemployment wall of silence.

•I get the skepticism - I was desperate after trying for weeks. But it worked for me when nothing else did. I had $4300 in stuck payments that got released after one call.

•hmm I've been burned by so many of these 'services' before... what makes this different? 🤔

•They don't actually handle your claim or need any of your info - they just connect you with a live agent so YOU can talk to them. That's all. I was just sick of being on hold for hours.

I'm a substitute teacher too and had this exact problem last spring! The trick is you need to specifically ask for a tier 2 claims specialist. The regular agents literally CAN'T help with document reviews - it's not that they won't, they literally don't have access to that part of the system.

•Thanks! When you ask for a tier 2 specialist do they usually transfer you or do they give you pushback?

Camila Jordan
•They'll give u some pushback and might say you need to wait for a callback. Be polite but FIRM that you need this resolved. Eventually they'll transfer you.

This is a SUPER COMMON issue with substitute teachers and per diem workers on unemployment. The system basically treats you differently. Don't listen to the 10-12 week garbage, that's just them trying to get you off the phone. I had the same issue and what worked for me was filing a formal complaint through the Governor's office. Sounds extreme but my case was resolved in 72 hours after 9 weeks of nothing.

The issue is that substitute teaching falls into a weird gray area with unemployment. Since you're technically "on call" but not actively working every day, they have special rules. I've been dealing with ny unemployment for 3 years as a sub and it's always a mess. 😤😤😤

•That makes sense. Did you ever get stuck in this 'document review' loop before? How long did it take to resolve?

Madeline Blaze
•Yep, twice! First time took 9 weeks, second time only 3 weeks. The difference? Second time I used claimyr.com to actually get a human on the phone who could help. First time I just kept calling normally and getting nowhere.

Here's what you need to do to resolve your NY unemployment backpay issue as a substitute teacher with documents under review: 1) DO NOT wait the 10-12 weeks they're telling you. This is standard deflection tactic. 2) Call again but specifically ask for a "claims examiner" or "claims specialist" - regular agents don't have access to document review systems. 3) Explain that you're experiencing financial hardship due to the delay (be specific about bills you're struggling with). 4) Reference NY Labor Law §590.7 which states claims should be processed within a reasonable timeframe. 5) If multiple calls don't work, file a complaint with your state representative AND the Department of Labor ombudsman simultaneously. 6) If you're tired of waiting on hold for hours, use claimyr.com - they'll wait on hold and connect you directly with an agent when one is available. This service literally saved me weeks of frustration. 7) As a last resort, request a hearing on your claim status. They don't advertise this option but you have the right to request it. I went through almost identical issues as a per diem healthcare worker. The system is designed to be frustrating, but there ARE ways through it if you're persistent and strategic. Good luck!

•Thank you SO MUCH for this detailed advice. I'm going to try calling again tomorrow with these specific requests.

•This is solid gold advice. I'm saving this for future reference. The NY labor law citation is especially helpful! 👍

•I thought the same thing til I tried it. Sometimes you gotta be desperate enough to try anything. I was about to lose my apartment over delayed benefits.

•Fair enough I guess. Been jerked around for so long by NYSDOL that I'm cynical about everything now.

Document review is the black hole of ny unemployment. I had W2s under review for SIXTEEN WEEKS last year. Absolute garbage. The only thing that worked was having my state assembly person intervene. Look up your local rep and call their office - they have special contacts at DOL.

Two words: CONTACT MEDIA. I was in your exact situation, reached out to a local news consumer advocate reporter, they did a story, and magically my claim was fixed in 48 hours. The unemployment office hates bad publicity more than anything.

•This is actually brilliant. Which news station did you contact? Did they actually run the story or just make inquiries?

•Local ABC affiliate. They have a "7 On Your Side" segment for consumer issues. They didn't even need to air it - just the inquiry from a reporter got things moving.

i had the SAME EXACT ISSUE a few months back. Called for weeks and got nowhere. Ended up using claimyr.com to get through to an agent (they handle the waiting on hold part) and had it resolved in one call. My 9 weeks of backpay hit my account 2 days later.

they told me the same bs about waiting 10 weeks. don't believe them. they're trying to save $$$ by delaying payments and hoping people give up. KEEP CALLING.

•^^^THIS!!! They count on people giving up. The system is literally designed to be frustrating.

FYI - There's actually a specific escalation process for substitute teachers with document review issues. Ask for the "educational worker claims department" when you call. Most regular agents don't even know it exists but it's a real thing.

Caleb Stark
•This is super helpful! I'll definitely ask for this specifically. Have you gone through this process yourself?

Steven Adams
•Yep, twice. First time took forever because I didn't know to ask. Second time was resolved in 8 days once I got to the right department.

•Totally get it. The unemployment system makes us all paranoid. But yeah, it's just a service that handles the hold time so you don't have to sit by your phone for hours.

The document review excuse is their new favorite way to delay payments. They know most people will eventually give up or find work and then they save money. It's disgusting how the system is designed to fail us. Keep pushing!

•So I was about to throw my phone after 3 hours on hold when a friend told me about it. Used it twice now - they stay on hold then call you when a human picks up. Saved me hours of my life.
