Wait I thought unemployment was only 20 weeks? Or maybe that was the old rules? I collected back in 2019 and I swear it was different. This whole system changes so much I can never keep track of what's current.
Something to keep in mind - those 26 weeks start from when you first become eligible, not from when you file your claim. So if there are any delays in processing or if you have to go through adjudication, you don't get extra time added to the end. The clock is always ticking once your benefit year begins.

The whole system is so confusing! I got laid off 3 months ago and I'm still not 100% sure how they calculated my weekly amount. honestly the whole system is messed up, you work your butt off and when you actually need help there's always some technicality why you don't qualify for anything. employers know exactly how to screw you over while staying within the law
Document EVERYTHING - every conversation with your employer, all medical records, any emails about your request for time off. If this goes to an unemployment hearing you'll need proof that you had no choice but to take the time off for medical reasons. The burden of proof is on you to show it wasn't a voluntary quit.

Wait so if they contest it does that mean I don't get any money while they investigate?? I can't afford to go weeks without income while NYS Department of Labor decides who's telling the truth. This is making me even more anxious about my job situation.

The whole system is rigged anyway. Employers know exactly what to say to get claims denied and NYS Department of Labor just rubber stamps whatever the company tells them. I've seen people with legitimate claims get screwed over because their boss knew how to work the system.

•That's not really accurate. NYS Department of Labor investigates each case individually and workers win contested claims all the time when they have proper documentation.
