The unemployment system is so confusing with all these different rules! I thought you had to wait a full year between claims but apparently not. Why don't they make this information easier to find on their website??
Just to clarify the process - when you file your new claim, make sure you report that your hours were reduced rather than saying you quit or were fired. Reduction in hours is good cause for filing and shouldn't trigger any adjudication issues. You'll need to provide your recent pay stubs to verify your earnings for the new base period calculation.
wait why does adjudication take so long anyway?? seems like they could just check if you got fired or quit and approve it
Adjudication involves verifying employment history, reason for separation, wages earned, and sometimes conducting interviews with both you and your former employer. It's not just a simple approve/deny decision - they need to ensure all information is accurate before determining benefit eligibility and amount.
same boat here, trying to figure out all the rules. is there a difference between being laid off vs fired for attendance issues? asking for a friend... 😬
Been through this twice unfortunately. Key things: always file on your assigned day of the week, never lie about anything even small stuff, keep copies of EVERYTHING, and if you work part-time while claiming report every penny. The NYS Department of Labor will eventually find out about unreported income and hit you with an overpayment that's way worse than just being honest upfront.
honestly the whole system is designed to make you jump through hoops. yeah unemployment is 'important' because it keeps people from becoming homeless but NYS Department of Labor makes it so complicated with all the job search logs and weekly questions. half the time their website crashes when you try to file anyway
I had major issues reaching NYS Department of Labor when my claim got stuck in adjudication for weeks. Couldn't get through on the phone no matter how many times I called. Finally used this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video demo showing how it works: https://youtu.be/qyftW-mnTNI. Worth checking out if you're having contact issues with NYS Department of Labor.

I've been trying to reach NYS Department of Labor for weeks about my own quit vs fired situation and their phone lines are always busy. Getting really frustrated with this whole process. Has anyone found a way to actually talk to someone there?

Wait so you can get unemployment even if you quit?? I thought that was only for people who got fired or laid off. This changes everything for my situation...

•Only if you quit for 'good cause' - things like unsafe working conditions, harassment, significant changes to your job duties or hours, etc. Regular voluntary resignation usually disqualifies you.
