I was stressed about this too! Called about 50 times yesterday with no luck. Finally used claimyr.com to get through this morning and got confirmation that Sept 5th is indeed the day to certify for the last week. The agent also told me that they're extending their call center hours that day because they expect high volume. Worth the money to get a definitive answer for me.
Of COURSE they're making you PAY to get basic information that should be clearly stated on their website! Just another way they try to cheat us out of benefits we've EARNED.
Important note for everyone: Make sure you've resolved any pending issues with your claim before the program ends. If you have any outstanding documents they've requested or interviews scheduled, complete those ASAP. After the program ends, it becomes much harder to resolve issues that might be holding up your final payments.
Once my senator's office got involved, it took about 3 weeks to get resolution. They have dedicated contacts at NYSDOL who can actually pull the case and review it. The senator's office called me weekly with updates. It was like night and day compared to dealing with NYSDOL directly!
Thank you everyone for all the helpful advice! We're going to:\n1. Contact his state assembly member and senator (already found their contact info)\n2. Ask specifically for the TC-1 and TC-40 forms\n3. Request a formal hearing\n4. Check for any missed correspondence\n5. Ask specifically about OSI involvement and for a Tier 2 specialist\n\nI'll update if we make any progress. It's been such a frustrating process, but your suggestions have given us new directions to try!
UPDATE: I was finally able to get through to a real person at NYSDOL! I used the Claimyr service that someone mentioned above, and it worked perfectly. The agent found the problem right away - turns out there was a flag on my account because I had an old claim from 2023 that had some kind of unresolved issue. The system was holding ALL my new payments because of this old problem that no one ever told me about! The agent removed the flag and said I should receive ALL my back payments within 3-5 business days. I'm trying not to get too excited until I actually see the money, but this is the first real progress I've made in a year! Thank you to everyone who offered advice. I'll update again once the payments come through.
This is exactly what I suspected - a system flag from a previous claim. I'm glad you were able to connect with someone who could identify and fix the problem. This happens more often than you'd think, and it's frustrating that the online system doesn't make these flags visible to claimants. The 3-5 business days timeline is accurate in my experience, especially for back payments. Make sure to check both your payment history in the portal and your bank account, as sometimes the portal updates before the deposit arrives.
FINAL UPDATE: All my back payments came through today!!! Over $19,000 in total (minus taxes). I almost cried when I saw the deposit. Thank you again to everyone who helped - especially the suggestion to try Claimyr to get through on the phone. If anyone else is stuck in payment limbo, don't give up!
That's wonderful news! I'm so glad you got your situation resolved and received all your back payments. It's unfortunate you had to wait so long, but this is a great reminder to always be persistent with unemployment issues - there's almost always a solution once you reach the right person.
my sister just got an overpayment notice 2 days ago too! might be a system glitch if lots of people are getting them suddenly??
While system glitches can happen, it's unlikely that multiple overpayment determinations are errors if they're for different reasons. Each case is typically reviewed individually. Your sister should check her specific reason for overpayment - it's likely different from the vacation pay issue discussed here.
UPDATE: I managed to get through to someone at NYSDOL this morning! Used that Claimyr service someone recommended and it worked great. The agent confirmed it was because of my vacation payout ($1,890) that I got after being laid off. I didn't realize I needed to report that as income for that week. They're going to adjust my claim and said I should only owe back about 2 weeks worth of benefits instead of everything. Still sucks but way better than I feared. Thanks everyone for your help!!!
That's great news! Glad you got it sorted out. At least now you know exactly what happened and can move forward. Did they say how long it will take for your regular payments to resume?

•I tried calling the number with the special prompts but still couldn't get through after waiting 2 hours! Then I used that Claimyr service someone mentioned and actually got through to a rep in about 15 minutes. They found that my identity verification was stuck in the system. The agent was able to clear it right there on the phone. My payments should start processing in 3-5 business days! Such a relief!
