That's mostly correct. Religious organizations and certain non-profits can be exempt, but they can also choose to participate. Agricultural employers have different rules too. But for a typical small business like a marketing firm, they absolutely have to pay unemployment insurance taxes to NYS Department of Labor.

Like they're doing you a favor or something. But yeah you can definitely apply, just be prepared for them to take forever to decide.
Just to add - make sure you're honest about the reason for termination when you file. NYS Department of Labor will contact your employer anyway, so any discrepancies will hurt your case. The fact that you feel the write-ups were unfair doesn't necessarily matter legally, but if you can show the termination wasn't for willful misconduct, you should be approved.
THE WHOLE SYSTEM IS A JOKE!!! I've been waiting 7 weeks and every time I call they just say 'still processing' or hang up on me. Meanwhile bills are piling up and I'm about to lose my apartment. They make it impossible to get through to anyone who can actually help.

The key thing is to keep filing your weekly claims even while it's under review, because if you miss those you'll lose benefits for those weeks. Also document everything in case you need to appeal later.
Don't give up! I was disqualified initially because there was some confusion about my last day of work. My employer reported the wrong date to NYS Department of Labor and it made it look like I quit without notice. Once I provided my actual termination paperwork and explained the timeline, they reversed the disqualification. The whole thing took about 6 weeks but I got all my back pay. Make sure you keep filing your weekly claims even while the appeal is pending - that way if you win, you'll get benefits for those weeks too.

The performance thing might actually work in your favor if they're also saying restructuring. Sounds like they're trying to cover their bases but it shows they had multiple reasons for the termination. Mixed messages from employers often help the claimant's case during adjudication.
