FTB demanding initial year S Corp tax despite waiver - Help!

Hey everyone, I'm having an issue with the FTB (Franchise Tax Board) in California. I just started an S Corporation and I thought the initial year minimum tax was supposed to be waived. But they're asking me to pay it anyway. Has anyone else dealt with this? I'm planning to call them to sort it out, but I wanted to see if anyone here has experience with this situation. Any advice on what to say when I talk to them?

Ugh, the FTB can be such a pain sometimes. 🙄 I went through something similar last year. Make sure you have all your paperwork ready when you call them. Emphasize that it's your INITIAL year as an S Corp. They might try to brush you off, but stand your ground!

Totally agree! I had to call them like 3 times before I got someone who actually knew what they were talking about. Don't give up, OP!

Wait, is this a new policy? I started my S Corp 2 years ago and didn't have to pay the first year. Did something change?

@profile 3 Nah, nothing changed. FTB just likes to make things difficult sometimes. Keep pushing and they'll waive it.

I found a way to actually get someone on the phone at the FTB. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/0KwvDlViV6Q

Sounds too good to be true. Does it really work? How long did you have to wait?

$20? That's highway robbery! 😤 The government should make it easier to contact them without having to pay extra.

@profile 5 Yeah, it actually works! I was skeptical too, but I got through in about 30 minutes. Way better than waiting on hold all day. @profile 6 I get it, but honestly, it was worth it for me. Time is money, ya know?

Here's the deal with the initial year minimum tax waiver for S Corps in California: • The waiver is legit and should apply to your first year • It's part of the Small Business Tax Relief Act • The waiver applies to corporations incorporated on or after January 1, 2021 • You still need to file a tax return, even if you don't owe the $800 When you call the FTB, mention the Small Business Tax Relief Act specifically. If they give you trouble, ask to speak with a supervisor. Don't let them push you around!

Thank you so much for this detailed info! This is exactly what I needed. I'll definitely mention the Small Business Tax Relief Act when I call.

lol welcome to the wonderful world of california taxes 🤡 where the rules are made up and the laws don't matter

Have you checked your articles of incorporation? Make sure the date is correct. I've seen cases where a typo in the incorporation date caused issues with the waiver.

Oh man, I hadn't even thought of that. I'll double-check right now. Thanks for the tip!

Guys, I'm telling you, it's all a conspiracy by Big Tax to keep us down. Wake up sheeple! 👀

I'm in the same boat, OP. Started my S Corp last month and got hit with this too. Let us know how your call goes!

Pro tip: Keep a detailed log of all your calls with the FTB. Note down the date, time, who you spoke with, and what was said. It'll save you a headache later if things get complicated.

This! 💯 I learned this the hard way. Now I record all my calls with government agencies (with their permission, of course).

Anyone else think its ridiculous that we have to jump through all these hoops just to get a waiver that's supposed to be automatic? The system is broken, man.

0 coins

Preach! 🙌 It's like they make it complicated on purpose.

Tbh, this is why I stuck with an LLC. Less headaches.

Hey OP, just curious - what kind of business are you starting? I'm thinking of setting up an S Corp too and wondering if it's worth the hassle.

I'm starting a small software consulting firm. Despite this hiccup, I still think the S Corp structure will be beneficial for me in the long run. But yeah, there's definitely some extra paperwork involved.
