Received 1099-G form from EDD but never filed for disability in 2023 - what's going on?

I'm really confused and a bit worried. I just received a 1099-G tax form from EDD stating I received $8,430 in disability benefits during 2023, but I NEVER filed for any disability or unemployment! I haven't been on any EDD programs since 2021 when I had regular unemployment for 3 months. Has anyone experienced this before? Could this be identity theft? I'm freaking out because I don't want to get in trouble with the IRS for benefits I never received. I checked my mailbox yesterday and there it was - this random tax form showing income I never got! What should I do? Call EDD? Report it to the IRS? I've heard EDD is impossible to reach by phone. Really appreciate any advice because tax season is already stressful enough without this weirdness.

Unfortunately, this is probably identity theft. Someone likely filed a disability claim using your personal information. You need to: 1. Contact EDD's fraud department immediately at 1-800-229-6297 or report it online at https://edd.ca.gov/en/about_edd/fraud/ 2. File an identity theft report with the FTC at IdentityTheft.gov 3. Contact the IRS to let them know the 1099-G is fraudulent - you'll need to dispute this so you don't pay taxes on money you never received 4. Check your credit reports for any suspicious activity Don't delay on this as it could affect your tax filing. EDD has been having lots of issues with fraud since the pandemic.

Oh no, that's what I was afraid of! Thank you for the detailed steps. I'll call the fraud department first thing tomorrow. Do you know if I need to get some kind of official documentation from EDD before I file my taxes? I'm worried because my tax appointment is next week.

3 months?? I don't have that kind of time before taxes are due! What did your cousin have to do to fix it? Was she able to file her taxes on time?

THIS HAPPENED TO ME TOO!! I got a 1099-G for SDI I NEVER FILED FOR! Called EDD about 50 times and couldn't get through to anyone. The regular unemployment number won't help with disability tax forms and the disability office never picks up!!! I ended up just checking box on my taxes saying the 1099-G was incorrect and attached a statement explaining I never received the money. Still haven't heard if IRS accepted it or not. EDD IS THE WORST!!!!

If you're having trouble getting through to EDD on the phone (which is super common), you might want to try Claimyr. I was in a similar situation with incorrect tax forms and couldn't get anyone on the phone for weeks. Claimyr connected me with an EDD rep in about 15 minutes. Saved me so much frustration. Their website is claimyr.com and they have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km

This is definitely a case of identity theft. I work with tax issues and see this fairly regularly since the pandemic. Here's what you need to do: 1. Contact EDD's fraud department (1-800-229-6297) and request a corrected 1099-G. Document this contact with date/time and representative name. 2. File IRS Form 14039 (Identity Theft Affidavit) 3. When filing your taxes, DO NOT report the incorrect 1099-G income. Instead, attach a statement explaining that you've reported the fraudulent form to EDD and the IRS. 4. File a police report - this creates an official record of the fraud 5. Freeze your credit with all three credit bureaus The critical part is getting documentation from EDD that confirms the 1099-G was issued in error due to identity theft. This will protect you if the IRS questions the discrepancy.

Thank you so much for this detailed information! I'll start on this right away. One question - should I still file my taxes on time if I haven't received the corrected 1099-G from EDD by the deadline? Or should I file for an extension?

File on time with a statement explaining the situation. You can always amend later if needed once you receive the corrected 1099-G. Extensions only extend the time to file, not the time to pay, so it's usually better to file on time with the information you have. Make sure to keep copies of all correspondence with EDD regarding this matter.

Just wanted to update everyone - I finally got through to EDD's fraud department after using Claimyr (thanks for that tip!). The rep confirmed someone filed a fraudulent SDI claim using my info last March. They've started an investigation and are sending me a corrected 1099-G. The rep also gave me a case number and confirmation email I can use with my tax filing. I've also filed the identity theft report with the FTC and frozen my credit reports. What a nightmare, but at least now I have documentation for the IRS. Thank you all for your help!

That's great news! Make sure you keep ALL documentation from EDD in a safe place. Sometimes these investigations can take months, and you might need that paperwork if the IRS comes back with questions. I'm glad you were able to get through and start resolving this!

People don't realize how common this problem is! The EDD systems were completely overwhelmed during the pandemic and they're still dealing with the aftermath of all the fraud. Always double-check any tax documents you receive, especially from government agencies. One thing I'd add to the excellent advice others have given: check if your employer received any notices about disability claims filed in your name. Sometimes EDD contacts employers to verify employment details for SDI claims, so your HR department might have information that could help your case.

That's a really good point - I hadn't thought of that. I'll check with HR tomorrow. Thank you!

No, they didn't tell me exactly how it happened, but the rep mentioned there were several data breaches over the past few years that exposed people's personal information. She said the fraudsters probably got my SSN and other details from one of those breaches. Really scary stuff!
