PA UC fraud claim in my name - Do I report fraudulent unemployment on taxes?

Help! Someone filed a fraudulent unemployment claim using my identity last year, and I just received a 1099-G form showing $6,200 in PA benefits paid out with NO taxes withheld. I've already reported the fraud to the PA UC office and they confirmed it wasn't me receiving those payments. But tax season is here and I'm freaking out - do I still have to claim this 'income' on my tax return even though I never received a penny? Has anyone dealt with this identity theft situation before? What documentation do I need for the IRS to prove I wasn't the one collecting these benefits?

Thanks for responding! I already contacted the unemployment office about the fraud, but they never mentioned anything about a corrected form. Do I need to call them again specifically about the 1099-G?

When you reported the fraud to PA UC, did they give you a fraud case number or confirmation? I went through this exact situation in 2023. Here's what you need to do:\n\n1. Call PA UC's dedicated fraud hotline (not the regular UC number) at 1-800-692-7292\n2. Tell them you need a corrected 1099-G showing $0 income\n3. They should mail you a revised form within 2-3 weeks\n4. Do NOT file your taxes until you have the corrected form\n5. Keep all documentation showing you reported the fraud\n\nThe IRS is aware of widespread UI fraud and has procedures for this. Just make sure you have that corrected form before filing.

You're right that it can take longer sometimes. If tax deadline is approaching and you still don't have the corrected form, you can file IRS Form 14039 (Identity Theft Affidavit) along with your tax return explaining the situation.

WENT THROUGH THIS EXACT HELL LAST YEAR!!!! The PA unemployment people are USELESS when it comes to fixing this. I spent MONTHS trying to get it resolved and kept getting transferred between departments. Eventually I got a corrected 1099-G but missed the tax filing deadline because of their incompetence!!

Oh no, that sounds awful! Did you end up having to pay any penalties for filing late? I'm worried I won't get this cleared up in time.

I help clients with this issue regularly. Here's what to do:\n\n1. Request a corrected 1099-G from PA UC by calling their fraud department at 1-800-692-7292\n2. Document all communications (dates, representative names, reference numbers)\n3. If you haven't received the corrected form by mid-March, you have two options:\n - File for an extension using Form 4868\n - File your taxes on time but include Form 14039 (Identity Theft Affidavit)\n\nThe IRS has procedures for handling unemployment fraud cases. You should NOT report income you never received. Make sure to keep copies of your fraud report and all correspondence with PA UC.\n\nAlso, check your credit reports and consider placing a fraud alert with the major credit bureaus if you haven't already.

Thank you for this detailed advice! I did place a fraud alert with the credit bureaus when I first discovered the claim, but I hadn't thought about requesting copies of my credit reports. I'll definitely do that. For the corrected 1099-G, is there a specific form I need to fill out or just call that number?

i had this problem but with my WIFE'S info last year. we spent weeks trying to reach someone at PA unemployment. busy signals and voicemails nobody returned! so frustrating!!! we finally got through using Claimyr.com - got connected to an agent in 20 minutes instead of days of trying. they have a video showing how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 - totally worth it to avoid the headache of constant redialing

I've never heard of that service before. Did they actually help resolve your issue once you got through to them? I've already been on hold for hours this week trying to reach someone.

yeah once we got through to an actual person they took care of it. the problem is just REACHING anyone! the service just gets you past the busy signals and into the callback queue faster. after that its the same UC people handling your case. but at least you can talk to someone!

Hey there, just wanted to add that I'm going through this right now too and found that if you go to the PA UC website there's actually a specific form for requesting a corrected 1099-G. It's under

That's super helpful, thank you! I'll look for that form right now. Did they give you any estimate of how long it might take to process?

They said 10-15 business days, but based on other comments here I'm not holding my breath! I'm planning to file an extension just to be safe.

Quick update on this thread - for anyone dealing with identity theft unemployment claims in PA, there's now a dedicated email address for 1099-G corrections: UCFraud1099G@pa.gov\n\nInclude your full name, last 4 of SSN, current mailing address, and a statement explaining that you had a fraudulent claim filed in your name and need a corrected 1099-G. This might be faster than waiting on the phone.

my neighbors cousin had this happen and the irs audited him anyway even after he got the corrected form just sayin be prepared for that possibility they dont always communicate between agencies

While it's true that audits can happen, if you have proper documentation showing you reported the fraud and received a corrected 1099-G, you'll be fine. Always keep copies of your correspondence with PA UC and the corrected form for at least 3 years after filing.
