How much can child support take from my California EDD unemployment benefits?
So I just found out I have an active child support order and I recently filed for unemployment through California EDD. Now I'm freaking out trying to figure out how much they can actually take from my weekly benefit amount. I work in construction and got laid off about 6 weeks ago, my weekly benefit amount came out to around $520 which honestly isn't much to live on as it is. I called the child support agency and they just told me to contact EDD, then I called EDD and couldn't get through to anyone. I've been going back and forth between agencies for two weeks now with zero answers. Does anyone actually know the rules around child support garnishment from unemployment benefits in California? Like is there a cap on how much they can take? Will EDD automatically deduct it or do I need to do something? I haven't gotten any paperwork from EDD about this yet and my first payment already went through without any deductions, so now I'm confused whether the withholding even kicks in automatically or if there is some kind of delay. Any help would be massively appreciated because I can't afford to have half my check disappear without warning.

Child support can absolutely be withheld from California EDD unemployment benefits - this is actually a really common situation and there are specific rules that govern it. Under federal and California law, child support income withholding orders apply to unemployment insurance benefits just like they would apply to wages. The standard withholding limits follow the Consumer Credit Protection Act (CCPA) guidelines. For someone supporting another spouse or child in addition to the child named in the order, the max withholding is 50% of your disposable earnings. If you are not supporting another family, it goes up to 60%. There is an additional 5% tacked on if you are more than 12 weeks behind on payments. So the absolute maximum they could take is 65% of your weekly benefit amount in a worst case scenario, but most orders don't hit those extremes. California EDD will automatically honor a valid income withholding order once they receive it from the child support agency - you don't have to initiate anything on your end. The delay you're experiencing with no deductions yet probably means EDD hasn't received the withholding order yet from DCSS (Department of Child Support Services). It could also mean the order is still being processed. Either way you should keep those first payments because they were issued before the order was in effect.

AuthorThis is really helpful, thank you. So the 50-60% cap is on the entire weekly benefit amount? So worst case on my $520 they could take up to $312? That's going to be really tight but at least now I know the ceiling.

wait so they can take MORE than half?? that seems insane. i thought there were stronger protections for unemployment

Yes unfortunately the 60% figure applies when the claimant isn't supporting another household. The federal CCPA limits apply to unemployment benefits the same way they do wages. California doesn't offer stronger protections for UI benefits specifically. The good news is most orders are set at much lower percentages based on what was originally calculated.

I went through this exact situation last year. My child support withholding kicked in about 3 weeks after my first EDD payment. What happens is DCSS sends the income withholding order directly to EDD and EDD processes it on their end - you don't fill out any forms. The amount withheld depends on what your actual order says, not just the maximum allowed by law. If your order says $200/week, that's what they'll take as long as it doesn't exceed the percentage caps. EDD sends the withheld amount directly to the state disbursement unit and it gets applied to your child support account. Your UI Online dashboard won't always show a separate line item for the withholding right away, which confused me at first. I'd recommend logging into your myEDD account and looking at your payment history in detail once the withholding starts.

AuthorDid your weekly benefit amount on UI Online show the full amount before the deduction or the net amount after child support was taken out?

Hailey O'Leary
It showed the gross amount first and then there was a separate notation. But honestly the interface wasn't super clear about it. I had to call EDD to confirm what was actually being sent to DCSS vs what I was receiving. Which brings up the whole phone nightmare...

same thing with me, the UI online dashboard is so confusing when theres multiple deductions happening at once

Okay so I was in this boat about 8 months ago and the phone situation between EDD and child support is a complete runaround. EDD kept telling me to call DCSS, DCSS kept telling me to call EDD, and I spent probably 12+ hours total on hold going nowhere. What finally worked for me was using Claimyr to get through to an actual EDD phone agent. The service connects you to EDD without you having to sit on hold forever - you basically let them handle the queue and they call you back when an agent is available. I was skeptical but I was desperate at that point. Got through to someone within a couple hours and the agent was actually able to see the withholding order status in my file and explain exactly what was happening. Site is claimyr.com and there's a video showing how it works at https://youtu.be/JmuwXR7HA10 - genuinely saved me from losing my mind trying to sort out the child support/EDD situation.

AuthorI've never heard of this. So they just get you through to a real EDD agent? Because that's been my whole problem - I can't get anyone on the phone to confirm anything.

Exactly. Real EDD agent, they can actually pull up your claim and see the withholding order status, confirm amounts, all of it. Way better than the automated system that just loops you around.

Works for any reason you need to reach EDD by phone. Whether it's checking claim status, adjudication questions, child support withholding questions, anything. The agent you reach is just a regular EDD rep.

genuine question - does having a child support withholding affect your eligibility for unemployment at all? like does EDD treat your claim differently
0 coins
Katherine Shultz
No, having a child support order has absolutely zero impact on your unemployment eligibility or your weekly benefit amount calculation. EDD determines your WBA based solely on your base period wages. Child support withholding is a separate administrative process that happens after eligibility is already determined. Your claim moves through adjudication, approval, all of that completely independently.

Something worth knowing - if you have federal or state income tax withholding set up on your EDD benefits too, those come out BEFORE the child support calculation in terms of how much is available. So if you opted into voluntary tax withholding (EDD lets you withhold 10% for federal taxes) that reduces what's in the pool that child support percentages apply to. Not sure if this is exactly how California calculates it but it's something to ask about when you get someone on the phone at EDD. I learned about this the hard way when my numbers weren't adding up.

Alberto Souchard
AuthorOh wow I did opt into the 10% federal tax withholding. So both of those would be coming out? I need to actually talk to someone at EDD to understand my specific numbers.
0 coins
Katherine Shultz
This is partially correct. The disposable earnings calculation for CCPA purposes typically does take into account legally required deductions first. Federal income tax withholding from unemployment benefits is voluntary though so it gets treated differently than mandatory deductions in some interpretations. Definitely worth clarifying directly with EDD for your specific situation.

Yeah I wasn't 100% sure on that which is why I said to ask. Definitely get confirmation from an actual agent.

EDD is THE WORST at communicating this stuff. I had a child support intercept happen and found out when my payment was just... less than expected. No warning, no notification email, nothing. Just short-changed and I had to figure out why on my own. The lack of proactive communication from this agency is honestly disgraceful when people are already in a stressful financial situation

AuthorThis is my fear - that it just starts happening and I won't know what the actual deduction amount is or where it's going
0 coins
Marcus Marsh
Exactly. Document everything. Screenshot your payment history before and after. Keep records of your DCSS account balance so you can cross-reference that the withheld amounts are actually being credited correctly.

EDD really does communicate terribly. I found out about a random deduction on my account by accident too

One thing nobody has mentioned - if you think the child support order amount is wrong or outdated, you can request a modification through DCSS separately from all of this. If your income has dropped significantly (which it has since you're on unemployment), you may qualify for a downward modification of the monthly support obligation. That's a whole separate process through the family court/DCSS but it could reduce the withholding amount going forward. Worth looking into if the current order was set when you were earning full construction wages.

Alberto Souchard
AuthorI didn't even think about this. The order was set like 3 years ago when I was making more. Is that something I can just request or do I need a lawyer?
0 coins
Annabel Kimball
You can request it directly through DCSS without an attorney - they have forms for income-based modification requests. You'll need to show your current income (unemployment award letter works) and they recalculate. Process takes a few months though so the current order stays in effect while it's pending.

This is really good advice. I modified mine when I lost my job and it made a huge difference. Current income documentation from EDD is exactly what they need.

wait im confused - is unemployment income counted the same as regular wages for child support purposes in california? i thought there might be different rules
0 coins
Katherine Shultz
Under California law, unemployment insurance benefits are treated as income for child support calculation purposes. And income withholding orders that apply to wages also apply to unemployment benefits. Federal law (Title IV-D of the Social Security Act) specifically extends income withholding to unemployment compensation. So yes, essentially the same rules apply. The child support agency doesn't have to get a separate order specifically for unemployment - your existing wage withholding order covers it.

something that helped me understand my situation was calling DCSS directly and asking them to confirm they had sent the income withholding order to EDD. Turns out in my case there had been a delay in the order being transmitted and DCSS had an old employer address on file. Once I confirmed the correct mailing info for EDD they resubmitted and it was processing within 2 weeks. Worth double-checking that DCSS actually has the right contact info for EDD if you're in a hurry to get it sorted.

Alberto Souchard
AuthorThat's a really practical tip. So I should call DCSS first and confirm they actually sent the order to EDD before I waste more time trying to reach EDD?
0 coins
Charity Cohan
Yes exactly. DCSS can tell you the date the order was transmitted and to what address. If they haven't sent it yet or sent it to wrong place, you want to know that first. Saves the runaround.
0 coins
Talia Klein
Good point. And then once you've confirmed DCSS sent it, that's when you'd want to follow up with EDD to confirm receipt on their end. Two separate phone calls to two different agencies unfortunately.

ugh this whole thread is giving me anxiety. my ex just filed a new child support case and i just filed for unemployment and i have NO idea whats going to happen with my EDD payments. I dont even know how much the order is going to be for yet
0 coins
Annabel Kimball
Take it one step at a time. The child support order has to be established first by the court before any withholding can happen. A newly filed case takes time to work through the system - there will be hearings, calculation of support, then issuance of the order. You have some runway before it hits your EDD payments.
0 coins
Maxwell St. Laurent
okay that is genuinely reassuring thank you. I thought they could just start taking money immediately
0 coins
Katherine Shultz
Your ex filing a case doesn't mean immediate garnishment. There's a legal process. A temporary order might be issued somewhat quickly but it still has to go through EDD's withholding process. You'll receive notice before deductions begin.

Coming back to add - for anyone else in this thread dealing with the phone access problem with EDD, I mentioned Claimyr earlier but wanted to add that it was specifically useful for child support withholding questions because the EDD agent could actually see the income withholding notice in the system and tell me exactly when it was received and when deductions would begin. That kind of specific account info is impossible to get from the automated phone system or through UI Online. For something as financially important as child support withholding where you need exact numbers, talking to an actual agent makes a huge difference.

random question but does child support withholding from unemployment affect your ability to certify for weekly benefits? like do you still just certify normally every two weeks
0 coins
Hailey O'Leary
Yes, you certify completely normally. The child support withholding is invisible to the certification process. You answer the same questions, report any income, etc. The withholding happens on the payment processing side after your certification is approved. Nothing changes on your end for weekly certifications.
0 coins
Cedric Chung
okay good because i was worried i had to check some box or report the withholding or something
0 coins

Correct, nothing to report or check regarding child support withholding on your weekly certifications. Your obligation is just to answer the regular certification questions accurately. EDD and DCSS handle the withholding between themselves.

I work in HR and dealt with income withholding orders a lot before I got laid off. One thing people don't realize is that EDD as an employer equivalent has specific timelines they're supposed to follow once they receive an IWO. They're required to begin withholding no later than the first payment due after 14 days of receiving the order. So if you want to know when it will start, find out the date EDD received the order and count forward from there.
0 coins
Alberto Souchard
AuthorWait this is really useful. So there's actually a legal deadline for when EDD has to start withholding? That's good to know for setting my expectations.
0 coins
Josef Tearle
Yes, income withholding orders come with required response timelines for income sources including unemployment agencies. If EDD received the order more than 14 days ago and hasn't started withholding, that might be worth flagging when you talk to an agent.
0 coins
Annabel Kimball
This is solid info. The 14-day rule for income sources to begin withholding is real - it's part of the federal requirements for income withholding.

does anyone know if there's a way to see on UI online whether EDD has an active income withholding order on your account? i've been looking through every tab and can't find anything
0 coins
Hailey O'Leary
Unfortunately UI Online is pretty limited in what it shows about withholding orders. You can see your payment history and any deductions that have already been processed, but I don't think there's a way to see pending withholding orders before they've kicked in. That's another reason why actually calling and speaking to an agent is the only way to get the full picture.
0 coins
Chris Elmeda
that figures. EDD online systems are genuinely so lacking compared to what they should be

Agreed. For anything beyond basic claim status and payment history, you really need to talk to a representative who can see your full account notes.

THE REAL PROBLEM nobody is talking about is that child support calculations were set when people had real jobs and real income. Then you lose your job, EDD pays you maybe 60% of what you were making if you're lucky, and the child support order stays at the same dollar amount calculated based on your old wages. So now you're paying the same support out of a much smaller check. The system is designed to crush people who lose their jobs. I know you can request modification but that takes months and in the meantime you're getting hammered.
0 coins
Alberto Souchard
AuthorThis is exactly my situation. My order was set based on my full construction salary and now I'm on EDD making way less. I did file for modification but yeah in the meantime...
0 coins
Annabel Kimball
This is a real pain point in the system and you're not wrong about the timeline issue. Some counties have expedited modification processes specifically for job loss situations - worth asking DCSS if your county has any kind of emergency or expedited review for unemployment-related income changes.

Marcus Marsh
I didn't know about expedited review options. That's actually helpful even if I'm still annoyed at the whole system

went through this whole thing six months ago. the thing that saved me was writing everything down - every phone call, who i talked to, what they said, date and time. when something finally went wrong with my withholding amount DCSS tried to say EDD had sent too little and EDD said they sent exactly what the order said. kind of off topic but this thread reminded me - i had a whole situation where EDD was withholding child support and ALSO had an overpayment deduction happening at the same time. TWO separate deductions coming out of my weekly benefit and I couldn't figure out which was which in my payment summary. took me forever to untangle. just warning anyone who has multiple issues going on with their EDD account at the same time it gets really complicated really fast

Yeah the overpayment was from a previous claim period and hit at the same time as the child support withholding starting. EDD's payment breakdown on UI Online just showed a reduced payment with no clear explanation. I had to call to get a line-item breakdown.

Multiple simultaneous deductions is exactly when you really need to talk to an agent because the online system just shows you a net number and you have no idea what came out for what reason.

For anyone still trying to reach EDD to sort out child support withholding questions - wanted to loop back one more time on Claimyr since a few people asked. The way it worked for me was I gave my callback number, and when an EDD agent became available they called me directly. Took maybe an hour and a half. The agent could see my income withholding order, confirmed the amount being deducted, and told me exactly when the first withholding payment would be sent to the state disbursement unit. That level of detail just isn't available through UI Online or the automated phone system. claimyr.com if you want to check it out.

quick note for OP - when you do get through to EDD, specifically ask them to confirm 1) whether they have an active IWO on your account, 2) what the withholding amount per payment period is, 3) what date the first deduction will occur, and 4) where the withheld funds are being sent. Those four questions will give you everything you need to reconcile with your DCSS account. EDD agents can see all of this in your file.
