Does child support come out of unemployment benefits with California EDD?
So I just got approved for unemployment and I'm trying to figure out my actual take-home situation. I have an existing child support order and I'm genuinely confused about whether California EDD automatically withholds child support from my weekly benefit payments or if that's something that gets handled separately. My ex's attorney mentioned something about income withholding orders applying to unemployment but I honestly don't know if that's true for UI benefits in California. Does anyone have firsthand experience with this? Do I need to notify California EDD about my support order or do they already know? I don't want to end up in arrears because I assumed wrong about how this works.

Yes, child support absolutely can be withheld from your California unemployment benefits. This is handled through what's called an Income Withholding Order (IWO). If there's an active IWO on file with the California Department of Child Support Services (DCSS), they can notify California EDD directly and your UI benefit payments will be reduced by the court-ordered amount before you receive them. You don't necessarily have to do anything special — the coordination between DCSS and California EDD happens through established state systems. That said, it's always worth confirming your support order information is current and accurate.

AuthorSo California EDD gets notified automatically? I wasn't sure if I needed to call them and tell them about it myself. I really don't want to mess this up.

This is correct. The withholding system between the two agencies is automated. I went through this last year and my child support was deducted right off the top of my weekly UI payment without me doing anything.

To add some detail here — under California law, unemployment insurance benefits ARE considered income for child support purposes. So yes, they're subject to withholding just like wages would be. The amount withheld depends on your specific court order. In most cases California EDD will withhold up to 50% of your weekly benefit amount to satisfy a current support obligation, and potentially more if you're behind on payments (in arrears). The withholding percentage caps are set by federal consumer credit protection laws, not just California rules.

AuthorWait up to 50%?? That's a huge chunk. So if my weekly benefit is like $450 they could take $225 of that? That seems really rough when you're already unemployed.

yeah that's brutal honestly. the system does not make it easy

The 50% cap applies when you're supporting another spouse or child in addition to the one the order is for. If it's just one obligation and no other dependents it can go up to 60%, and if you're more than 12 weeks behind it can go to 65%. These are federal maximums under CCPA.

I went through exactly this situation about eight months ago when I got laid off from my warehouse job. The child support started coming out of my first or second UI payment, I don't remember exactly which one. What I didn't expect was how hard it would be to get anyone on the phone at California EDD to confirm the withholding amount was correct. I spent like two weeks trying to get through. Someone on another forum mentioned Claimyr (claimyr.com) and I finally tried it — it basically gets you connected to an actual California EDD agent instead of sitting in the call queue forever. They also have a video showing how it works at https://youtu.be/JmuwXR7HA10. Once I got through, the agent confirmed exactly what was being withheld and why. Super helpful when you're dealing with something as important as making sure your child support calculations are right.

AuthorI've been terrified of trying to call California EDD because everyone says you can never get through. I might look into that Claimyr thing if I need to verify my withholding amounts.

I've heard of Claimyr. Did it actually work for you? Like you got a real person?

Yeah a real person, not a robot menu. It was honestly the first time I'd successfully talked to an EDD agent after multiple attempts on my own. The agent was actually helpful about explaining how the withholding worked on my specific benefit amount.

ok so dumb question but does this happen automatically even if ur ex never filed anything recently?? like if the court order is old does EDD still know about it
0 coins
Emma Garcia
Good question actually. If the income withholding order was entered by the court and is being enforced through DCSS (California's child support enforcement agency), then yes it should still be active and California EDD should receive notification when you file for UI. Old orders don't expire just because time passed — they remain enforceable until modified or terminated by the court.

oh wow ok i def need to look into my ex's situation then bc he just filed for unemployment and i don't think he's been paying

You can actually contact DCSS directly to confirm whether an IWO has been issued and sent to California EDD. That's your best resource for tracking whether enforcement is actively in place.

I'm gonna be real this thread is stressing me out because I just filed for UI last week and didn't even think about my support order. I'm like 4 months behind on payments already because I lost my job. Will California EDD take MORE because I'm in arrears?? I feel like I'm about to lose half my check before I even see it
0 coins
Layla Mendes
Unfortunately being in arrears does increase the withholding percentage. As I mentioned above, if you're 12+ weeks behind the maximum goes to 65% of your disposable earnings (which in UI's case is basically your full weekly benefit). If you're less than 12 weeks behind it's 60% if you have no other dependents. This is hard to hear but it's the reality of how the system works.

this is genuinely awful. i lost my job BECAUSE i couldn't afford to keep showing up to a job that paid garbage and now they're gonna take 60% of my unemployment. how is anyone supposed to survive this

Ava Kim
I know it feels impossible. One thing you can potentially do is contact your local DCSS office and ask about a modification review given your current unemployment status. They sometimes work with you on arrears when your circumstances have changed significantly. Not guaranteed but worth asking.

Something important to clarify: there's a difference between voluntary withholding and mandatory withholding. If you WANT California EDD to withhold federal income taxes from your benefits, you have to actively request that using the DE 4S form. But child support withholding via an IWO is NOT voluntary — that happens regardless of what you want because it's a court-ordered obligation. Just making sure nobody confuses the two when they're looking at their benefit statements.

Aiden Rodríguez
AuthorOh this is a really helpful distinction. So taxes I have to opt into but child support just happens automatically if there's an order. Got it.
0 coins
Ethan Anderson
wait you can have EDD withhold taxes too?? i didn't know that was a thing
0 coins
Ava Kim
Yes, for federal taxes you fill out the DE 4S (Voluntary Withholding Request for Unemployment Insurance). It's optional but a lot of people do it so they don't get surprised at tax time. California doesn't tax UI benefits at the state level but federal taxes still apply.

This happened to my brother last year. His child support order was through the county and it took almost three weeks after he started receiving UI payments before the withholding kicked in. During that gap he was actually worried he was going to get hit with a big bill later. Turned out California EDD back-withheld the amount from his subsequent checks which was brutal but at least he wasn't penalized for the delay. Just something to be aware of — there can be a lag.

Aiden Rodríguez
AuthorOh no a back-withholding situation sounds rough. Did they take it all out of one check or spread it over several?
0 coins
Noah Ali
They spread it over a few checks if I remember right. But it still made those weeks really tight for him. He had to call California EDD to ask about it and of course got the whole runaround trying to reach someone.

This is exactly the kind of situation where having a way to actually reach an EDD agent matters. If there's a discrepancy in your withholding or a back-withholding situation you need answers about, you can't afford to wait weeks hoping someone calls you back.

does child support come out of unemployment if you're the one RECEIVING support, not paying it? like would my ex's unemployment payments go to me directly or still through DCSS
0 coins
Emma Garcia
Great question. If your ex has an IWO and is receiving UI, California EDD sends the withheld amount to DCSS, and then DCSS distributes it to you (or your child's case). It doesn't go directly from EDD to you as the recipient — it goes through the state's child support payment system first. This means there can be processing delays of a few business days.
0 coins
Chloe Boulanger
ok that makes sense. so i would just see it come through my DCSS/child support payment portal as usual, just with unemployment listed as the source?
0 coins
Emma Garcia
Essentially yes. The payment source changes but your DCSS account should reflect the incoming payment. If you're not seeing payments you expected, contact DCSS rather than California EDD since DCSS manages the distribution side.

EDD is an absolute nightmare to deal with when you have any kind of complicated situation like this. My child support was being withheld incorrectly for MONTHS — they were using an old order amount instead of my modified order. You would think two state agencies could share updated records but apparently not. I had to fight to get it fixed and spent an eternity on hold trying to reach anyone who could actually do something about it.

Lucas Notre-Dame
This is my worst nightmare honestly. How did you finally get it resolved?

Eventually used Claimyr to get through to California EDD — same service someone mentioned above at claimyr.com. Got connected to an agent who could actually pull up my account and see the discrepancy. They initiated a correction but I also had to contact DCSS separately to make sure they updated the IWO amount on their end. Took both calls but at least I got it done in a day instead of another month of getting nowhere.

Ava Kim
This is actually a really important point — if the IWO on file with California EDD is based on an old or modified order, you have to proactively fix that. Neither agency will catch the error automatically.

For anyone researching this topic: the legal basis for child support withholding from unemployment is California Family Code Section 17518, which authorizes DCSS to send income withholding orders to California EDD. At the federal level, UI benefits are specifically listed as 'income' subject to withholding under Title IV-D of the Social Security Act. So this is very well-established law, not a gray area. If someone tells you unemployment can't be touched for child support, that's simply incorrect.

my cousin literally told me this yesterday that they couldn't touch his unemployment for support lol. gonna send him this thread

Yeah this is a common misconception. Some people confuse UI with disability payments or other benefits that have different rules. But regular unemployment is absolutely subject to child support income withholding.

UPDATE from OP: I called California EDD this morning (finally got through after trying a few times) and confirmed that yes, there is an IWO on file for my account. The agent told me the withholding will start from my first payment. She said the amount is based on my court order which is current so at least I don't have to worry about the arrears percentage. My weekly benefit is $390 so I'll have about $195 withheld. Tight but manageable. Thanks everyone for the info in this thread — it really helped me understand what to expect before I called.

question kinda related — if i voluntarily pay MORE than my court order requires while on unemployment, will EDD withhold the extra too or just the minimum order amount?
0 coins
Layla Mendes
California EDD can only withhold what the IWO specifies — they don't have authority to withhold voluntary extra payments. If you want to pay above your court-ordered amount, you'd need to send those additional payments directly to DCSS or however your order specifies. EDD just processes the mandatory IWO amount.
0 coins
Olivia Harris
ok that actually helps, i was wondering if i could use EDD withholding as like a forced savings mechanism to pay down my arrears faster but sounds like i'd have to handle the extra payments separately
0 coins
Ava Kim
You can contact DCSS about setting up an arrears payment plan that you pay separately from the automatic withholding. Some counties are pretty flexible about this when you're clearly trying to get current.

My situation is a little different and wondering if anyone knows — I'm on standby status with California EDD (seasonal worker, employer called me back temporarily) and I'm about to start a part-time return. Will child support withholding change when I report partial earnings on my weekly certification?
0 coins
Emma Garcia
When you report partial earnings on your weekly certification, California EDD calculates your reduced benefit payment for that week. The IWO withholding percentage applies to whatever the actual benefit payment ends up being that week, not your full benefit amount. So yes, it will adjust week by week based on your actual payment.
0 coins
Alexander Zeus
That's helpful. So the percentage stays the same but since my benefit payment is smaller the dollar amount withheld goes down proportionally?
0 coins
Layla Mendes
Correct. The IWO specifies either a fixed dollar amount or a percentage. If it's a fixed dollar amount it could create problems in low-earnings weeks where your benefit barely covers it, so you'd want to flag that to DCSS if it comes up.

I work in family law and just want to add for accuracy: California is actually one of the more aggressive states in terms of ensuring child support is collected from UI benefits. The coordination between DCSS and EDD is largely automated and they do data matches periodically. So even if someone thinks they can fly under the radar while on unemployment, the system is designed to catch it. Not judging anyone here, just want people to have realistic expectations.

Lucas Notre-Dame
lol well there go my hopes of the system somehow missing me i guess

Ethan Anderson
is there ANY way to get the withholding temporarily reduced if you literally cannot afford to eat after they take it out?

Alicia Stern
The proper avenue is to file a motion to modify the child support order with the family court, citing change of circumstances (job loss). This is a legitimate legal process. Some family law facilitators at courthouses help with this for free. It won't be instant but it's the right path if your circumstances have genuinely changed.

nobody ever thinks about this stuff when they first lose a job i swear. i found out my unemployment was being garnished for child support on the same day my rent was due and it was a complete shock even though logically i should have expected it. wish i had found a thread like this before my first payment dropped

One thing I don't see mentioned: if you have back child support (arrears) and you get a lump sum payment from EDD for any reason — like if a claim was held up in adjudication and then all at once approved — that lump sum is ALSO subject to child support withholding. Possibly at a higher rate. This caught my coworker totally off guard when he finally got his UI claim resolved after weeks in adjudication.
0 coins
Lucas Notre-Dame
oh man. so if your claim sits in adjudication for months and then gets approved, they can take an even bigger chunk of that lump sum?
0 coins
Noah Ali
That's my understanding based on what happened to him. The lump sum is still just 'income' for withholding purposes. He said nearly half of his back payment went to child support arrears.
0 coins
Layla Mendes
This is accurate. Large lump sum UI payments can trigger significant withholding especially if arrears are involved. If someone is in adjudication and also has a child support IWO, they should be aware of this before their claim resolves.

how do you even find out how much is being withheld before it happens?? like can you see it in your UI Online account or do you have to call
0 coins
Emma Garcia
Your UI Online account through myedd.edd.ca.gov should reflect your payment details, but the withholding breakdown isn't always clearly labeled in the portal — it may just show your net payment amount. Calling California EDD directly is the most reliable way to get a breakdown of exactly what's being withheld and why. You can also check your DCSS account to see incoming payments attributed to your ex's UI.

It can be rough. If you're hitting a wall with the regular phone queue, the Claimyr service I mentioned earlier (claimyr.com, video at https://youtu.be/JmuwXR7HA10) is actually worth trying specifically for situations like this where you need real account-specific information that you can't get from the automated system.

quick clarification question — is it possible to have BOTH federal tax withholding AND child support withholding coming out of the same UI payment? and if so which one gets priority?
0 coins
Layla Mendes
Yes both can be withheld from the same payment. Child support via IWO takes priority over voluntary federal tax withholding. So if there isn't enough left after child support to cover the tax withholding you requested, the tax withholding may be reduced or skipped for that payment period. The mandatory court-ordered deduction always comes first.
0 coins
Chloe Boulanger
good to know. so i should factor that in when deciding how much federal tax to have withheld
0 coins
Ava Kim
Right — if child support is already taking a big chunk, having high tax withholding on top of that could leave you very little to live on. Some people in this situation choose minimal or no voluntary withholding while unemployed and just set aside a small amount manually for taxes instead.

UPDATE on my situation I mentioned above — finally got everything sorted. After getting through to California EDD via Claimyr and also calling DCSS, they both updated their records to reflect my modified support order from last year. It took about 2 weeks for the corrected amount to show up in my payments. Not fast but at least it's fixed. My advice: if you have a modified order, don't assume EDD or DCSS have the updated info. Follow up proactively even if you think it should all be automatic.
