Can child support take your unemployment check from California EDD?
So I just started getting unemployment benefits through California EDD about three weeks ago and I'm already stressed enough trying to figure out how to cover rent and groceries. Then my buddy mentions that child support enforcement can actually garnish your unemployment benefits directly. I honestly had no idea this was even possible and now I'm freaking out a little. I have an existing child support order and I'm behind on payments because I lost my job - that's literally WHY I filed for unemployment in the first place. Does anyone know if California EDD actually sends money directly to child support agencies before you even see it? Like does it come out automatically or do they have to take some kind of legal action first? And is there a cap on how much they can take? I really need to understand what I'm dealing with here before my next payment drops.

Yes unfortunately this is real and it happens automatically in most cases. When you have an active child support order in California, the Department of Child Support Services (DCSS) can issue what's called an Income Withholding Order to California EDD. Once EDD receives that order they are required by law to deduct the child support amount from your UI benefits before you ever see a dime. It doesn't require any new court action - if the withholding order already existed from your employment it typically transfers over to your unemployment benefits too.

AuthorSo it just automatically switches over from my paycheck to my unemployment? I never got any notice about this from EDD or DCSS.

You should have received something from DCSS but honestly their notification process isn't always quick. I'd log into your UI Online account and check your payment history - if there's a garnishment happening it should show as a deduction line item before your net deposit amount.

This happened to my brother in law last year. He had no idea until his first EDD payment was like $200 less than expected. Definitely check your UI Online account payment details.

The amount they can take is regulated though - it's not like they can just drain your whole check. Federal law under the Consumer Credit Protection Act limits garnishments on unemployment benefits. For child support specifically, they can typically take up to 50% of your disposable earnings if you're supporting another spouse or child, or up to 60% if you're not. If you're more than 12 weeks behind on payments those percentages go up by 5% each. So worst case scenario is 65% which is brutal but they can't take everything.

AuthorWait 65% of my unemployment would leave me basically nothing. My weekly benefit amount isn't even that high to begin with. Is there any way to request a modification because I literally have zero income right now?

Yes! This is actually important - losing your job IS grounds to go back to court and request a modification of your child support order. The court looks at current income when setting support amounts. You'd want to file for a modification as soon as possible because modifications typically only go back to the date you filed, not the date you lost your job.

seconding the modification advice. my cousin went through this and the judge actually reduced his payments significantly once he showed proof of job loss and EDD claim. dont wait on that

I went through almost this exact situation about eight months ago. Lost my job in the logistics industry, filed for California EDD unemployment, and within two weeks my child support withholding kicked in on my UI benefits. What I didn't realize was that I needed to actually CALL California EDD to understand exactly how my payment breakdown was being calculated. The UI Online portal showed the deduction but didn't explain everything clearly. After spending three days trying to get through on the phone and getting disconnected every single time, someone in a Facebook group told me about Claimyr. You basically use it at claimyr.com and it navigates the EDD phone system and gets you connected to an actual agent without you sitting on hold for hours. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - I was skeptical but I got through to an EDD rep within the same day and they walked me through exactly what was being withheld and why. Genuinely saved my sanity during an already awful week.

AuthorI've been trying to call EDD for two days straight and can't get through at all. I'll check out that Claimyr link, thanks.

Does Claimyr actually work? I've seen it mentioned before but always assumed it was a scam or something.

I was skeptical too but it genuinely worked for me. Got connected to a real EDD agent who answered all my questions about the withholding. Way better than the nightmare of trying to call directly.

Something important people aren't mentioning - there's a difference between a voluntary wage assignment and a mandatory income withholding order. If you voluntarily set up child support payments through your bank account you might not have an automatic withholding on your EDD benefits. The automatic transfer to unemployment only happens when there's a formal Income Withholding Order on file. Check your original court order paperwork to see what type of payment arrangement you actually have.

AuthorOkay this is helpful - I honestly don't remember the details of my court order. I need to dig that paperwork out.

good point. a lot of people don't realize there's different types of arrangements. the formal IWO is way more common though especially if you've been behind on payments at any point

THE SYSTEM IS SO BROKEN. You lose your job through no fault of your own, qualify for unemployment, and then child support enforcement swoops in and takes a huge chunk before you can even pay rent?? I understand child support is important but there should be an automatic pause or at least a review process when someone becomes unemployed. I've been through this and it is absolutely devastating to already be stressed about income and then get hit with this on top of it. California EDD doesn't even warn you when you file that this might happen.

I feel this so hard. The stress of unemployment is already at a 10 and then this hits and it goes to like a 15.

I get the frustration but the child support system is designed to protect the kids who depend on those payments. The solution really is to go back to court immediately and get a modification based on your changed circumstances. That's the proper channel for this situation even though it takes time.

yeah I know I know. I just wish there was more automatic communication between these agencies so people weren't blindsided

Worked in family law paralegal for a while so maybe I can clarify a few things. The Income Withholding Order process with California EDD specifically: when DCSS receives notice that you've filed for unemployment (and they do receive this notice automatically through data sharing), they have the right to send an IWO to EDD. EDD then has to honor it. The timeline can vary - sometimes it catches your first payment, sometimes it takes a few weeks to kick in. This is why some people get a couple full payments and then suddenly see a deduction. Don't assume you're in the clear just because your first payment was full.

Clarissa Flair
AuthorThis is really useful context, thank you. So even if my first payment came through normal that doesn't mean the garnishment isn't coming?
0 coins
Tyrone Hill
Exactly. DCSS and EDD data sharing has improved a lot in recent years so the gap is usually shorter now than it used to be, but it's not always instant. Keep checking your UI Online payment details with each certification.

wait they automatically share data?? I did not know that. I thought you had to be reported or something

something nobody mentioned yet - if you're behind on child support and your benefits are being garnished, that doesn't automatically stop the arrears from growing. You're still accruing interest on back payments in California (10% annually I believe). Even if EDD is forwarding some of your UI to DCSS the interest clock doesn't pause. This is another reason to get that modification filed ASAP and also maybe try to negotiate a payment plan for the arrears directly with DCSS.

Clarissa Flair
Author10% interest on arrears?? That's going to make this so much worse. I really need to get on top of this.
0 coins
Harmony Love
Yes the interest situation is brutal and often people don't realize it until the arrears have ballooned. DCSS does have some hardship provisions but you have to proactively ask for them. They don't just offer it.

update: Claimyr actually worked for me, I got connected to a California EDD rep about 45 minutes after signing up. Asked about my payment breakdown and the agent confirmed the child support withholding amount and explained my payment schedule. Would have taken me days to get that info otherwise. Really useful if you need to talk to someone at EDD about your specific situation.

Clarissa Flair
AuthorThat's actually really encouraging. I'm going to try it today. Did you have to explain a lot of background to the EDD agent or were they already able to see your account details?

They pulled up my account pretty quickly and could see everything. Just had my SSN and claim number ready. The conversation was maybe 15 minutes and they answered all my questions.

Can we also talk about what happens to your EDD debit card vs direct deposit when a garnishment is in place? I had my benefits on a Bank of America EDD debit card and was confused about whether the withholding happened before the card was loaded or after. Turns out the withholding happens on EDD's end before any funds are disbursed - so whether you have direct deposit or the debit card, the amount you receive is already after the child support deduction. You never see the withheld amount at all.

Clarissa Flair
AuthorOkay that makes sense actually. So the number I see in UI Online as my 'payment issued' - is that before or after the deduction?
0 coins
Abigail bergen
The payment issued amount should reflect what you actually receive. Look for a separate line showing 'withholding' or 'deduction' - that's the child support amount. Your account summary should break it down if you look in the payment details section.

McKenzie Shade
yeah mines showed up as a separate line when I had garnishments. you have to click into each individual payment to see the breakdown

has anyone dealt with child support from a different state taking from california edd? my ex moved to another state and the support order is through there but i'm filing for california unemployment. not sure if the interstate thing changes anything
0 coins
Tyrone Hill
Interstate child support orders are still enforceable through the Uniform Interstate Family Support Act (UIFSA). The other state's DCSS can contact California DCSS who then contacts EDD. It's more steps but it still works and still results in withholding. Might take slightly longer to set up but don't assume being in a different state protects you.

ugh okay. I was kind of hoping there was a loophole there but I guess not. thanks for the info

I want to share something that helped me when I was in this situation. California DCSS actually has a formal process called a Compromise of Arrears Program (COAP) where they can potentially reduce the total arrears you owe if you're in genuine financial hardship. Not everyone qualifies and it's a whole process but it's worth knowing about if your debt has gotten large. You have to apply and demonstrate hardship but it exists.
0 coins
Clarissa Flair
AuthorI've never heard of this. Is this something you apply for through DCSS directly or through the court?
0 coins
Rudy Cenizo
Directly through DCSS. You'd contact your local DCSS office and ask about the COAP process. They have an application and there's an eligibility review. Being unemployed and receiving UI benefits would definitely count as hardship evidence.

Good mention. Also worth noting that Legal Aid organizations in California sometimes help with this process for free if you can't afford an attorney.

okay real talk I'm in a similar situation and reading this whole thread has been incredibly helpful but also incredibly stressful lol. I didn't know half of this stuff before today. Going to log into UI Online right now and check my payment details because my second payment just dropped and I want to see if anything changed.

oh wow just checked and I do have a deduction on my most recent payment. I had no idea. Time to call EDD and figure this out... or try that Claimyr thing since apparently calling directly is impossible.

One more thing worth mentioning for anyone reading this later: your weekly benefit amount for UI in California is calculated based on your highest earning quarter in the base period - the child support withholding doesn't change that calculation. Whatever your WBA is, that's what EDD determined you qualify for and the garnishment comes out of that amount. So if you're trying to figure out if you can request a higher benefit amount to offset the garnishment - that's not really how it works. The WBA is fixed based on your earnings history.
0 coins
Clarissa Flair
AuthorThat's good to know because I was actually wondering if there was any way to get more from EDD to compensate. Sounds like no.
0 coins
Kirsuktow DarkBlade
Correct, the WBA calculation is set. Your energy is better spent on the modification request with the court to potentially lower the child support obligation while you're unemployed, which addresses the root issue rather than trying to increase benefits.

went through this last year and just want to say it does get better. Filed my modification request, got a temporary order reducing my payments while I was on UI, then when I got a new job I updated the court and got a new permanent order based on new income. the system is clunky and stressful but there are actual mechanisms to help you. just takes some effort to navigate them
0 coins
Clarissa Flair
AuthorThis is genuinely reassuring to hear. How long did the temporary order take to get?
0 coins
McKenzie Shade
about 3 weeks from when I filed to when I got the temp order. The permanent modification took like 3 months total. But the temp order came through pretty quickly and it was retroactive to my filing date which helped a lot.

good to know the temp order is an option. I didn't realize you could get something temporary while waiting for the full hearing

does California EDD notify you when a withholding order comes in or do they just start deducting without warning? I feel like I should have gotten some kind of letter
0 coins
Tyrone Hill
You should receive notice from DCSS that they've submitted an IWO to EDD. EDD itself may or may not send a separate notice - their communication around garnishments is honestly not great. The most reliable way to know what's happening is to check your UI Online payment details after each certification rather than waiting for mail.

California EDD communication in general is just terrible. I got a notice about something three weeks after it had already been resolved. Totally useless.

This is why calling EDD directly is important for anything involving garnishments or deductions - they can tell you in real time what's on your account. As others said in this thread, Claimyr is probably the easiest way to actually reach someone given how hard it is to get through on the regular EDD phone lines.

UPDATE for anyone following this thread: I finally got through to a California EDD agent using Claimyr (tried the link someone posted above at claimyr.com) and they confirmed I do have an active Income Withholding Order on my claim. The agent explained exactly what percentage is being withheld and how it's calculated. They also confirmed I should contact DCSS directly to discuss any modifications. I also have a call scheduled with a Legal Aid attorney about filing for a child support modification now that I have a better understanding of the situation. Thanks everyone who contributed here - this thread genuinely helped me understand what was happening and what steps to take.
