Can child support take the $600 unemployment benefit from California EDD?
So I've been going back and forth on this and I can't get a straight answer anywhere. My situation: I got laid off from my warehouse job about six weeks ago and I've been collecting unemployment through California EDD. Someone at my kid's school told me that child support enforcement can intercept my unemployment benefits and take a big chunk of it - like up to $600 worth. I have a child support order from a few years back and I've been making payments but I fell behind when I lost my job. Now I'm freaking out that they're gonna just take my unemployment money before I even see it. Does anyone know if child support agencies can actually garnish or intercept California EDD unemployment payments? And if so is there a limit on how much they can take? I really need this money to survive right now and pay rent. Already stressed enough about finding a new job and doing my weekly certifications every week without worrying about this too.

yes child support can absolutely take from your unemployment. its called an intercept and it happens automatically if you owe back support. the state already has your info from when you filed your claim

Authorwait so it just happens without any warning? they dont tell you first?

they're supposed to notify you but honestly it can happen fast. i'd check your UI Online account to see if there's any garnishment notice in your correspondence inbox

To give you accurate info here: child support CAN be withheld from California EDD unemployment benefits. Under California law, the Department of Child Support Services (DCSS) can issue an earnings assignment order that applies to unemployment insurance benefits just like it would apply to wages. The amount they can take depends on your specific order but it's typically capped at a percentage of your disposable income, not necessarily a flat dollar amount. If you have arrears (back support owed), they can take up to 50-65% of your benefits in some cases. The best thing you can do right now is contact California EDD directly to find out if any withholding order has been placed on your claim. That way you know exactly what to expect before your next payment.

Author50-65%?? that seems insane. I barely get enough to cover rent as it is. Is there any way to contest or modify that amount?

Connor O'Brien
Yes you can request a modification through DCSS if your income has changed significantly, which it has since you lost your job. File for a modification showing your current unemployment income vs your previous wages. Courts consider changes in financial circumstances.

this is the right info. I went through this exact thing two years ago. the percentage caps are real and they do apply to unemployment benefits not just wages

I dealt with this nightmare situation last year and honestly the hardest part was just getting anyone at California EDD on the phone to explain what was happening with my payments. I kept seeing deductions and had no idea if it was the child support intercept or some other issue with my claim. I finally used a service called Claimyr (claimyr.com) that basically gets you through to a live California EDD agent without sitting on hold for hours. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - once I actually got someone on the line they walked me through exactly what was being withheld and why. Saved me so much confusion and anxiety honestly.

Authorwait this actually works? I've called EDD like 4 times and never gotten through to anyone

yeah I was super skeptical too but it worked for me. the agent I spoke with could see all the withholding details on my account and explained the child support deduction line by line

SAME EXACT SITUATION happened to me!! I nearly had a heart attack when my first payment was way less than expected and nobody told me why. Took me forever to figure out it was DCSS coordinating with EDD to pull the support amount directly. The system is SO broken - they expect you to just magically know this is happening to your money

RIGHT?? I had bills set up expecting a certain amount and then boom completely different number deposited. overdrafted my account because of it

tbf they are supposed to send a notice. might have gone to an old address or the spam folder if you have email notifications set up

Okay so I want to clarify something because there's some confusion in this thread. The $600 figure you mentioned - are you thinking of something specific? Because standard California EDD unemployment benefits are calculated based on your previous wages, not a flat $600. There was a federal supplement during COVID a few years back but that's long gone. Either way child support withholding applies to whatever your current benefit amount is. Just want to make sure you have the right numbers in mind when you're calculating what you might have left after any withholding.
0 coins
Javier Morales
Authorhonestly I don't even know where the $600 number came from, someone just mentioned it to me. So my actual benefit amount is just based on what I was earning before?
0 coins
Freya Andersen
Correct. California EDD calculates your weekly benefit amount based on your highest earning quarter during the base period, which is roughly the first 12 of the last 15 months before you filed. You can see your exact WBA on your UI Online account under claim summary.

yeah the $600 thing was the FPUC supplement that ended years ago. current benefits are just based on your wages

One thing I'd add - if you're behind on child support AND you're now on unemployment, you should proactively reach out to your local DCSS office to let them know your income has changed. You can request a temporary modification based on hardship. They'd rather work with you than just intercept everything because a zero balance account doesn't help anyone. Document everything when you call them and get the agent's name and ID number.

Javier Morales
AuthorI didn't realize I could actually contact them proactively. I've been kind of avoiding it honestly
0 coins
Malik Jenkins
Definitely don't avoid it - showing up proactively actually works in your favor. Courts and DCSS look more favorably on people who communicate vs people who just go dark when they fall behind

Amina Diallo
100% this. I proactively called DCSS when I got laid off and they put a note on my case. still had some withholding but it was reduced while I was on unemployment

just went through something like this. child support took about 25% of my weekly benefit amount. wasn't the end of the world but definitely tightened things up. make sure ur still doing ur job search activities every week and certifying on time bc the last thing u want is ur claim getting flagged for something on top of the child support situation

Javier Morales
Authoryeah I've been doing my 3 job search activities per week and certifying every Sunday. at least that part I've got down

good. some people slip up on that when they're stressed about other stuff. EDD takes the job search requirements seriously

There's actually a specific form you need to be aware of - if DCSS has an active wage assignment order, they can submit it directly to California EDD and EDD is legally required to honor it. It works almost identically to how it would work with an employer. The withholding should show up as a line item on your payment record in UI Online. Log in and look under payment history - if something is being withheld it'll show there even if you haven't received a formal notice yet.

Javier Morales
Authorjust checked and I don't see any withholding on my last two payments. does that mean I'm clear or could it still show up?
0 coins
Leila Haddad
Could still show up depending on when DCSS submits the order. The fact that it hasn't happened yet doesn't mean it won't. Keep an eye on it especially if your arrears amount is significant.
0 coins
Connor O'Brien
This is accurate. EDD processes these on a per-payment basis once the withholding order is active in their system. There can be a lag between when DCSS submits and when EDD processes.

Natasha Petrov
has anyone had luck getting the withholding amount reduced because of financial hardship? my support order was set when I was making good money and now I'm on unemployment making like a third of that
0 coins
Malik Jenkins
Yes this is exactly what the modification process is for. You need to show a material change in circumstances - job loss qualifies. File an RFO (Request for Order) in family court or go through DCSS directly for an administrative review
0 coins
Natasha Petrov
how long does the modification usually take? I can't wait months for this to get resolved
0 coins
Amina Diallo
can take anywhere from 6 weeks to several months depending on your county and how backed up the courts are. DCSS administrative review is usually faster than going through family court

I was so stressed about this same issue and spent three days trying to get California EDD on the phone to understand my payment breakdown. Finally someone on another forum mentioned Claimyr and I was honestly at my wit's end so I tried it. Got connected to an EDD rep within a reasonable time and she confirmed exactly what was being taken out for child support and gave me the reference number for the DCSS order. That info was huge because I was able to take it to my attorney and actually do something about it. claimyr.com if anyone needs it, there's a demo video at https://youtu.be/JmuwXR7HA10

does anyone know if they can take from your EDD if the child support order is from a different state? like what if the order was set up in another state but you're now in California collecting EDD
0 coins
Connor O'Brien
Yes, interstate child support enforcement is a thing. Under UIFSA (Uniform Interstate Family Support Act) which all states including California have adopted, an order from another state can absolutely be enforced against California EDD benefits. DCSS offices coordinate across state lines.
0 coins
Isabella Costa
ugh. was hoping there was some loophole there. thanks for the honest answer I guess
0 coins
Freya Andersen
no loopholes really. the system is pretty well coordinated between states specifically to prevent people from dodging support by moving

random question - if child support is taking money from your unemployment does that count toward your support obligation or does it just reduce your arrears? like do you get credit for it
0 coins
Malik Jenkins
Yes it absolutely counts. Any amount intercepted by DCSS is applied to your account either as current support or toward arrears depending on the order. You should see it reflected in your child support payment history.

Eduardo Silva
okay good. just making sure I wasn't gonna get double-dinged somehow

Amina Diallo
One thing nobody mentioned - if you're on unemployment and paying child support through an earnings assignment, make sure your ex or the other parent's DCSS caseworker knows you're on unemployment now. Sometimes there are delays in the system updating and you might have late payment flags even though the money is being intercepted. Proactive communication on all fronts is the move here.
0 coins
Javier Morales
AuthorI hadn't even thought about that angle. so I should basically be in contact with DCSS directly myself?
0 coins
Amina Diallo
Yeah call your local DCSS office, let them know you're on unemployment, get the case number for your support order, and confirm they have the right contact and payment info. Takes like 20 minutes and saves so much headache
0 coins
Malik Jenkins
Also keep records of every call - date, time, agent name. If anything gets disputed later you want documentation

just to share my experience - i had child support taking from my unemployment in 2023 and what messed me up was not budgeting around it. like i kept expecting my full benefit amount and kept being surprised every week. once i just accepted the reduced amount as my actual income things got a little more manageable mentally
0 coins
Javier Morales
Authorthat's actually really practical advice. just recalibrate expectations to the net amount
0 coins
Hiroshi Nakamura
yeah its a mindset shift but once you stop thinking of it as money being taken and just think of it as your actual benefit amount it helps

Freya Andersen
I want to loop back to something practical for OP - when you log into UI Online, go to Payment Activity and click on any individual payment. It should show you a full breakdown of your gross benefit amount vs any deductions including child support withholding, federal tax withholding if you opted into that, and your net payment. This is the clearest way to see exactly what's happening with your money without having to call anyone.

Javier Morales
Authorjust did this and I can see my payments but no deductions listed so far. I guess I'm in a wait and see situation
0 coins
Freya Andersen
Sounds like it. Keep checking after each certification. And if you do see a deduction appear that you don't understand, that's when it's worth getting EDD on the phone to explain it.

For anyone in this thread struggling to reach EDD by phone - I mentioned Claimyr earlier and just want to reiterate it was genuinely useful for me when I had payment questions I couldn't get answered any other way. claimyr.com and the demo is at https://youtu.be/JmuwXR7HA10. Sometimes you just need to talk to a human who can actually pull up your account.

going to try this today. been putting off calling because the hold times are so bad

the whole point is you don't have to sit there waiting. let it do the work and just wait for the callback

Final thought for OP - don't forget that unemployment benefits are taxable income in California (well, taxable for federal purposes) and child support payments you make are NOT tax deductible. So factor that in when you're doing your overall financial picture. You might want to opt into voluntary federal tax withholding on your EDD payments if you haven't already to avoid a surprise tax bill later.
0 coins
Javier Morales
Authoroh wow I had not even thought about taxes on top of all this. how do I opt into the withholding?
0 coins
Leila Haddad
Log into UI Online, go to your profile or settings, and there should be an option for voluntary federal income tax withholding. It's 10% of your benefit amount. Worth doing if you don't want to deal with estimated taxes.

Connor O'Brien
Good point. California doesn't tax unemployment benefits at the state level but the federal 10% withholding is smart to set up proactively

this thread has been super helpful honestly. I had no idea how much DCSS and EDD were integrated. feels like there should be more public info about this when you first file for unemployment
