EDD stuck on pending determination for a month after submitting required letter - already paid for 3 weeks

I'm stressing out about my son's unemployment situation and hoping someone can help! Here's what happened: He submitted his explanation letter to EDD detailing the circumstances of his job separation over a month ago. Since then, he's been faithfully certifying every two weeks. EDD paid him for one week initially, then paid him for two more weeks after that. However, they mentioned they're still doing a "determination" on his claim. They also warned that if they find him ineligible, he'll have to pay back everything he's received! I don't understand why this determination is taking so long - it's been over FOUR WEEKS since he turned in that paperwork. Is this normal? Should we be worried? Has anyone else had their determination take this long but still received payments? What should he do now - just keep certifying and hope for the best?

This is actually pretty common with EDD right now. The determination process can take 4-6 weeks even when everything is submitted correctly. The good news is that they're paying him while they review - that's usually a positive sign! He should definitely keep certifying every two weeks without fail. Make sure all questions are answered accurately to avoid any issues down the road. If the determination finds him eligible (which seems likely since they're paying), everything continues as normal. If you want to check status, trying to reach an EDD rep is your best option.

Thank you so much! That's reassuring. Do you know if there's anything we should be doing while waiting? Should he be uploading any additional documents or just wait?

same thing happend to my daughter last year!! they kept paying her then 2 months later they decide shes not qualified and wanted ALL the money back it was like $4200!!! nightmare

Oh no! That's exactly what I'm afraid of! Did she have to repay everything? Was there any way to appeal their decision?

Determinations can take FOREVER. My theory is they pay you while reviewing because they dont want a backlog of claims all hitting at once when they finally make decisions. Keep all documentation your son submitted just in case. The fact they're paying is usually good but not guaranteed approval.

That's not how it works at all. EDD is legally required to begin payment if they can't make a determination within a certain timeframe. It's called a "conditional payment" and has nothing to do with managing backlogs. It's actually part of California UI Code Section 1253.9 that they must begin payment if they can't complete the eligibility interview within a reasonable time. So the payments don't indicate approval or denial - they're just following the law while they process the determination.

Hi there! EDD specialist here. What you're describing is a typical pending determination situation. When there's a question about separation from employment (quit, fired, etc.), EDD will often begin paying benefits conditionally while they investigate. The key things your son should do: 1. Continue certifying every two weeks without fail 2. Report any work/income accurately 3. Fulfill all work search requirements (applying to jobs, networking, etc.) 4. Keep checking his UI Online account for any messages or interview appointments 5. Maintain copies of the letter and any other documentation submitted The determination could result in full approval, partial approval with some weeks disqualified, or a finding of ineligibility. If he's found ineligible, there will be an overpayment but he can appeal the decision within 30 days. Hope that helps clarify things!

Thank you for explaining it so clearly! One question - if they schedule an interview, will they notify him by mail or just in his UI Online account? He checks his account but sometimes misses mail.

If you need to check on the status, I'd recommend trying to speak with an EDD representative directly. After dealing with similar issues for months, I finally found a service called Claimyr that helped me get through to an EDD rep in about 20 minutes instead of spending days redialing. Their website is claimyr.com and they have a video demo at https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km that shows how it works. Saved me so much frustration when I needed to check on my pending determination that was taking forever.

I hadn't heard of this service! We've been trying to call for days with no luck. I'll check it out, thanks!

is this legit?? sounds sketchy to me... has anyone else used it?

I used it last month when my certification got stuck. It works but I still had to wait on hold after they connected me. Better than not getting through at all though.

I think your son might be in the pending resolution queue. EDD has two main determination paths: regular determinations (2-3 weeks) and pending resolution determinations (4-8 weeks). The fact they're paying him is USUALLY a good sign, but I've seen cases both ways. If they find him ineligible, they'll send a Notice of Determination with appeal rights. Keep ALL documents related to this claim in case you need to appeal! One important thing: make sure he's doing and documenting his work search activities every week. Even while waiting for determination, failing to meet work search requirements can create a separate issue.

Thank you for this info! He's definitely been keeping track of his job applications. Do you know if EDD contacts previous employers during the determination process? His former manager was pretty upset when he left.

Yes, EDD absolutely contacts the employer - that's a standard part of the determination process. They'll ask the employer for their version of the separation. If your son's story and the employer's story conflict, that's when they typically schedule an eligibility interview to sort it out. If his manager was upset, they might have contested the claim, which would explain the longer determination timeline.

Don't stress too much! But yeah your son should def keep certifying every 2 weeks!!! My determination took like 7 weeks and I got paid the whole time and it worked out fine. But my friend waited 5 weeks and then got denied and had to appeal. It's like 50/50 I think.

Just to address your question about notifications - EDD will typically send interview notices both in the mail AND to his UI Online inbox. However, the mail notice usually contains more details and should be considered the official notification. Make sure his mailing address is current in the system and he's checking both places regularly. Also worth noting - if he misses a scheduled eligibility interview, they'll almost certainly find him ineligible. Those interviews are crucial for determining qualification when there's any question about the job separation.

I'll make sure he knows to check both places and that his address is updated! Thank you for the tip about the eligibility interview being so important.
