EDD penalty weeks completed - Will I get benefits after serving 10 weeks with partial overpayment balance?

Just finished serving my 10-week penalty period with EDD. My next certification date is March 2nd. I still have an outstanding overpayment balance of about $600. A rep named Judy mentioned that the one-week waiting period was waived because of the wildfires in Southern California (I'm in the affected area). My question is: will I actually receive any money from the $900 for the two weeks I'm certifying for? Or will they take the whole amount to cover my remaining overpayment? I'm really confused about how this works after penalty weeks end when there's still a balance owed. Anyone been through this?

they always take the money if u owe them. EDD gonna keep ur benefits til that 600 is gone. thats how it wrkd for me last year

After your penalty weeks are over, EDD typically applies 100% of your benefits toward your overpayment until it's completely paid off. If your weekly benefit amount is $450, they'll take two full weeks ($900) and apply it to your $600 balance. The remaining $300 should be released to you. One important thing - the waived waiting week has nothing to do with your penalty weeks or overpayment collection. Those are completely separate issues. The waiting week waiver just means you get paid for your first week of benefits when you initially file a claim.

I HAD THE EXACT SAME SITUATION!!! Served my penalty weeks (8 in my case) and still had like $750 overpayment. They took my ENTIRE first certification payment after the penalty and part of the second one. You won't see a PENNY until that $600 is paid back in full. That's how these people operate. The waiting week waiver has NOTHING to do with your overpayment situation.

not entirely true... depends on if they set up a repayment plan or not. some people get partial payments

Not in my experience or anyone I know with penalty weeks. Maybe if it's just a regular overpayment without penalties they might do partial, but with penalty weeks they took 100% until it was paid back.

So I had something kinda similar happen back in november. I had a 6 week penalty and bout $820 overpayment still left. What ended up happening was they took the entire first payment after my penalty (like $430) and then took the remaining balance from my next certification and gave me the rest. So like if ur certification is $900 and u owe $600, they'll keep $600 and give u $300. But u should check ur UI Online account after you certify. When u go to claim history it should show u what they're doing with the money. It'll say something like "overpayment offset" for the amount they're keeping.

Has anyone here appealed their penalty weeks? I'm looking at a 12-week penalty for supposedly misreporting income, but I don't think I did anything wrong. Sorry for going off topic but I'm desperate for advice on this.

UPDATE: I certified on March 2nd as scheduled, and you all were right! They took $600 to clear my overpayment balance and released the remaining $300 to my EDD debit card. It took about 2 days for the payment to process. Thanks everyone for your help explaining how this works!
