Just finished EDD 10-week false statement penalty - what happens with payments now?

Finally made it through my 10-week false statement penalty with EDD (wasn't even intentional - I misunderstood a question about availability during one week). Now I'm confused about what happens next. Do I need to wait the standard two weeks to certify and THEN get paid? Or do I also have to serve the one-week unpaid waiting period again? I thought the waiting period was only for new claims, but my neighbor said I might have to do it again after penalties. Really need this money ASAP since I've been living on savings for 2+ months. Anyone been through this process recently? The EDD site is so vague about post-penalty procedures.

You don't have to serve another waiting period after penalty weeks - that's only for brand new claims. Just certify as usual on your regular schedule, and you should get paid for both weeks (assuming you meet all eligibility requirements). Your benefit year doesn't restart after penalties.

That's a huge relief! So I should expect payment pretty quick after my next certification? The penalty period completely wiped out my emergency fund.

Wow congrats on making it thru! Such a nightmare when they hit u with those penalty weeks!! I had 6 weeks last yr and almost lost my apartment 😫

6 weeks is still better than 10! The EDD system is ridiculous with these penalties. My cousin got hit with 15 weeks for an honest mistake on his application. It's like they WANT people to become homeless.

I think you have to wait a week still. When i finished my penalty time they made me wait another week but that was back in january so maybe its changed?

That's not correct. The one-week waiting period is only served once per benefit year, at the beginning of your claim. Penalty weeks and the waiting period are completely different things in the EDD system. OP should get paid for both weeks after their next certification (assuming they meet all other eligibility requirements).

I went through this exact situation last month. You certify on your regular schedule, and as long as you meet all the requirements (work search, availability, etc.), you'll get paid for both weeks. There's no second waiting period. BUT - and this is important - make sure your contact info is up to date in the system. Sometimes after penalty weeks, they flag your account for an eligibility interview just to make sure everything is kosher before resuming payments. If they can't reach you, it could cause delays. Also, double-check that your claim is still active. If your benefit year ended during your penalty period, you might need to file a new claim, which WOULD trigger another waiting week.

Thank you! My benefit year is still active for another 4 months, so hopefully I won't have any issues. I'll double check my contact info right now.

same boat last year! the regular certification schedule just picks back up where u left off. no extra waiting.

Have you tried calling EDD directly? I know it's nearly impossible to get through, but I had success using Claimyr (claimyr.com) to connect with an EDD rep after struggling for weeks. They have a service that helps you bypass the phone queue and actually get to speak with someone. Check out their demo at https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km - it worked for me when I had questions about my appeal process. The rep I spoke with was able to tell me exactly what would happen after my disqualification was removed.

Does that service actually work? I've been trying to reach EDD for 3 weeks about an identity verification issue. Keep getting the "we're experiencing high call volume" message and then it hangs up.

btw what kinda false statement did they get u for? just curious cuz i hear they r getting super strict lately

I said I was available for work during a week when I actually had a family emergency out of state. Didn't realize that made me ineligible for that week. Then they investigated and decided I made a "false statement" even though it was just a misunderstanding of the rules. Apparently I should have reported that I wasn't available that week. Expensive lesson!

One more important thing - after serving penalty weeks, your account might be flagged for more careful review of your certifications. Make sure you're super accurate with your work search activities and any earnings reported. They sometimes scrutinize accounts more closely after penalties have been served.

Thanks for the tip! I've been keeping detailed records of all my job applications and contacts. Definitely not making any more mistakes with this process.

The whole EDD system is designed to make people fail! They deliberately make the questions confusing, then punish you when you answer wrong. My cousin lost her ENTIRE claim because she checked the wrong box about self-employment income. No warning, no chance to explain - just BOOM, 23 weeks of penalties! The system is BROKEN and the politicians don't care.

preach!! 🙌 they make everything so complicated on purpose

Just went through this exact same thing 3 months ago! You're good to go - no additional waiting period needed. Just certify on your normal schedule and you should get paid for both weeks assuming you meet all the regular eligibility requirements. The waiting week is only for brand new claims, not after penalty periods end. One heads up though - they might send you a notice asking you to confirm your work search activities for the first few certifications after penalties. They did that to me and a few others I know who went through penalty periods. Nothing to worry about, just make sure you have your job search documentation ready if they ask for it. Hang in there, the worst part is behind you now! 💪

Thanks for sharing your experience! It's really reassuring to hear from someone who just went through this recently. Did they actually follow up and ask for your job search documentation, or was it just the notice? I've been keeping detailed records but want to know what to expect. Also, how long did it take for your payments to show up after you certified? I'm hoping it's the usual 2-3 days and not delayed because of the penalty history.

I just went through this same situation about 6 weeks ago after a 12-week penalty period (ugh, don't even get me started on how that happened). The good news is that once your penalty weeks are done, you just go back to your regular certification schedule - no extra waiting period! I was terrified I'd have to wait even longer, but I certified on my normal day and got paid for both weeks within 3 business days. Just make sure your account shows "paid" status before you celebrate though. Sometimes there can be random holds that pop up after penalties, but those usually resolve quickly if you call (or use one of those callback services people mentioned). Keep all your job search records organized because they definitely scrutinize post-penalty certifications more carefully. But honestly, the hardest part is over - you made it through those brutal penalty weeks!

Wow, 12 weeks is brutal! I thought my 10 weeks was bad enough. Really appreciate you sharing that it went smoothly after - gives me hope that I'll actually see some money soon. I've been living off ramen and prayer for the last couple months 😅 Did you notice any difference in how they processed your certifications after the penalty, or was it pretty much back to normal timing? I'm keeping my fingers crossed that there won't be any surprise holds!

Hey Vincent! Just wanted to chime in as someone who recently completed an 8-week penalty period in December. You're absolutely right to be confused - the EDD website is terrible at explaining what happens next. Good news: NO additional waiting period! That's only for brand new claims. You'll certify on your regular schedule and should get paid for both weeks as long as you meet all the usual requirements (job search, availability, etc.). However, I'd recommend double-checking a few things before your next certification: 1) Make sure your contact info is current in case they need to reach you, 2) Have your work search documentation ready - they tend to audit post-penalty certifications more closely, and 3) Check that your benefit year hasn't expired during the penalty period. The payments should come through in the normal timeframe (2-3 business days after certification shows "Paid"). After 10 weeks of no income, I know every day feels crucial. You've made it through the hardest part though! 🙏

Thank you so much Sofia! This is exactly the kind of detailed info I was hoping for. Really appreciate you mentioning the audit thing - I've been keeping spreadsheets of all my job applications but wasn't sure if they'd actually check them. My benefit year is still good for another few months, so I should be okay there. It's such a relief to hear from multiple people that there's no extra waiting period. After 10 weeks of living on savings and stress, I'm ready to get back to some normalcy! 🙏

Just wanted to add my experience for anyone else going through this nightmare! I finished a 15-week penalty period last summer (yeah, 15 weeks - longest penalty possible for false statement). The key thing everyone's saying is correct - no additional waiting period after penalties end. You just pick up where you left off with regular certifications. BUT here's what nobody mentioned yet: make sure to log into your EDD account a few days before your next certification date to check if there are any notices or requirements. Sometimes they'll post additional forms or questionnaires that need to be completed before you can certify again. I almost missed my certification deadline because I didn't see a "return to work" questionnaire they posted. Also, pro tip: if you haven't already, screenshot or print your penalty completion notice from your account. I had to reference mine later when there was confusion about my payment status. The EDD system sometimes glitches and shows old penalty info even after it's completed. You've survived the worst part - 10 weeks of financial stress is no joke! Just stay on top of all the requirements and you should be getting paid again soon. 💪

Thanks Zoe! That's a great tip about checking for additional forms before certification. I would have definitely missed that since I've been avoiding logging in during the penalty period (too depressing to look at zero payments). The screenshot idea is smart too - I've learned not to trust the EDD system to keep accurate records of anything! 15 weeks sounds absolutely brutal, I can't imagine how you got through that. Really appreciate everyone sharing their experiences here, it's way more helpful than anything on the official EDD site.
