EDD payments after winning appeal hearing - employer no-show got case dismissed
Just had my appeal hearing this morning and got some unexpected good news! My former employer filed an appeal against my unemployment claim but they didn't even show up to the hearing, so the judge dismissed their appeal completely. I'm relieved but also confused about what happens next. Does anyone know how long it typically takes for EDD to start releasing my payments now that I've won the appeal? Do I need to contact EDD or will they automatically process everything? This whole situation has drained my savings and I'm getting desperate for those payments to start coming through.

Congrats on winning your appeal! When this happened to me last year, it took about 7-10 business days for payments to start processing. You should see your payment status change from 'appeal pending' to 'paid' in your UI Online account. I'd recommend checking your account daily. If you don't see movement after 2 weeks, that's when you should contact EDD directly.

•Thank you so much! That's really helpful to know. Did your backpay come all at once or was it spread out over several payments? I've got about 14 weeks of pending payments.

just so ur aware sometimes the judge takes a few days to enter the decision in the system before edd even knows about it. dont panic if nothing happens immediately

•Oh that's good to know! I was expecting something to show up in my account right away. I'll try to be patient.

Been through this exact situation! Here's what will happen: 1. The judge will issue a written decision (takes 1-5 days) 2. EDD will receive and process the decision (3-7 days) 3. Your claim will update to "paid" status 4. You'll receive all backpay at once If it's been more than 2 weeks since your hearing with no update, that's when you need to get on the phone with EDD. I highly recommend using Claimyr (claimyr.com) to get through - they got me connected to a live agent in under 25 minutes when I was trying for WEEKS on my own. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km Don't worry about contacting them before the 2-week mark though - they'll just tell you to wait.

•I tried Claimyr last month and it was ok but still took me like 20 mins to get thru. better than the 200+ calls i was making before tho lol

DONT CELEBRATE YET!!!! Just because your employer didn't show up doesn't automatically mean you'll get paid! I won my appeal the same way and EDD STILL denied my payments because of some "eligibility issue" they suddenly found. The whole system is rigged to deny benefits any way they can. Call them IMMEDIATELY and DEMAND they process your payments!!!!!

•This is misleading. While there can occasionally be separate eligibility issues, when an appeal is dismissed specifically because the employer didn't appear, the claim generally reverts to its original approved status. The judge's decision is binding. Calling and "demanding" anything won't help and might actually flag your account for additional review.

when my cousin had his appeal last month the judge said he won right there at the hearing but then he didn't get any money for like 3 weeks and had to keep certifying the whole time. make sure u keep doing ur certifications every 2 weeks!!

•I've been keeping up with my certifications even though they've all been stuck on pending. Glad to hear I should continue doing that!

Professional tip: After an appeal is decided in your favor, you should receive your payments within 7-14 days. The exact timeline depends on several factors: 1. How quickly the Administrative Law Judge (ALJ) processes the formal written decision 2. Whether the decision requires any special processing by EDD 3. The current backlog at EDD for processing appeal decisions You do not need to contact EDD during this period. The payments should process automatically once the decision is entered. All weeks that were pending during the appeal should switch to paid status simultaneously. If it's been more than 15 business days since your hearing and you've seen no change in your UI Online account, then it's appropriate to contact EDD for a status update. Make sure to have your appeal case number ready when you call.

•Thank you for the detailed explanation! I just checked and I do have my appeal case number from the hearing paperwork. I'll give it two weeks before I try contacting them.

•The judge said they'd mail the written decision within 5-7 days. The hearing was over the phone so I didn't get anything in hand today.

this happened to my roommate and she got her money in like 4 days! but my brother had to wait almost a month for his... i think it just depends on who processes your case and how backed up they are when your paperwork lands on their desk lol edd is so inconsistent

Since your appeal was dismissed due to employer no-show, here's what I recommend: 1. Keep checking your UI Online account daily for status changes 2. Continue certifying for benefits every two weeks 3. If no payment after 2 weeks, call EDD and ask for the appeal processing department 4. If they say they haven't received the judge's decision yet, contact the Office of Appeals directly In my experience, about 80% of dismissed appeals are processed within 10 business days, but there are always outliers. Be persistent but patient.

•Thanks for the clear timeline and steps. It's been so stressful dealing with all this uncertainty. At least now I have a better idea of what to expect.
