EDD Section 1277 Invalid Claim Determination - Help Needed!

I just got a Notice of Determination saying my claim is invalid under Section 1277. I'm so frustrated because I know they got it wrong. Has anyone else dealt with this? What should I do next?

Ugh, that sucks. I've been there. Section 1277 is all about eligibility issues. Have you considered appealing? It's a pain, but sometimes it's the only way to get things straightened out.

Yeah, I'm thinking about appealing. Just feels like such an uphill battle. ๐Ÿ˜ฉ Any tips on how to make a strong case?

Document everything! Gather all your pay stubs, employment records, anything that proves your eligibility. And don't be afraid to ask for help - there are free legal aid services that specialize in EDD appeals.

I second this advice! I won my appeal by being super organized and presenting clear evidence. It's a hassle but worth it if you know youre right.

The EDD system is so broken. I swear they just randomly deny claims to see who will fight back. It's like playing unemployment roulette. ๐ŸŽฐ

Hey, I found a way to actually get someone on the phone at EDD. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/Ize0EkN4HDI

Sounds too good to be true. Does it really work? I've been trying to get through for weeks.

It honestly does. I was skeptical too, but I was desperate. Got through in about 2 hours. Worth every penny for me.

$20 just to talk to someone? That's ridiculous. The system is so messed up.

I get it, but think about how much time and frustration it saves. Time is money, right? ๐Ÿคทโ€โ™‚๏ธ

Section 1277 is tricky. It's about whether you earned enough wages in your base period to establish a valid claim. Make sure you're looking at the right dates for your base period - it's not always the most recent work history.

Have you tried reaching out to your local assembly member's office? They can sometimes help push things through or get answers from EDD faster than we can on our own.

I hadn't thought of that. How do I find out who my assembly member is?

Just google '[your city] assembly member' and it should come up. Most have forms on their websites specifically for EDD issues. Good luck!

Here's what you need to know about Section 1277 and how to handle your situation: 1. Understanding Section 1277: - It's about establishing a valid claim based on your base period earnings - The base period is typically the first 4 of the last 5 completed calendar quarters before you filed your claim 2. Common reasons for invalid claims under 1277: - Not enough earnings in your base period - Earnings spread across too few quarters - Misclassification of your employment status 3. Steps to take: a) Review your Notice of Determination carefully b) Gather all pay stubs and employment records for your base period c) Double-check EDD's calculations against your records d) If you find discrepancies, prepare an appeal 4. Filing an appeal: - You have 30 days from the mailing date of the Notice to appeal - Submit your appeal in writing, clearly stating why you believe the determination is incorrect - Include copies (not originals) of any supporting documents 5. While waiting for the appeal: - Continue to certify for benefits if you're still unemployed - Look into alternative support programs you might be eligible for 6. Getting help: - Consider contacting a legal aid organization specializing in unemployment issues - Reach out to your local assembly member's office for assistance Remember, many initial denials are overturned on appeal. Don't give up if you believe you're eligible!

Has anyone had success with hiring a lawyer for this kind of thing? I'm considering it but worried about the cost.

I used a lawyer for my appeal and won. Most work on contingency, so you only pay if you win. Might be worth looking into.

Be careful with lawyers. Some will take advantage. Make sure to read reviews and get everything in writing before agreeing to anything.

Just a heads up, I've heard EDD is really backed up right now due to all the fraud cases they're dealing with. Might take longer than usual to get this sorted out. Hang in there!
