Can you get Social Security and unemployment at the same time in California EDD?
So I've been collecting Social Security retirement benefits for about two years now, and I recently got laid off from my part-time job that I'd been working to supplement my income. My former employer is contesting the claim saying I quit voluntarily which is completely false - I was let off because they reduced their workforce. Anyway I filed with California EDD about three weeks ago and my claim is showing pending. A friend told me you can't collect both Social Security and unemployment at the same time but I've also read online that California changed those rules. I'm really confused about where I actually stand. Does anyone know if receiving Social Security retirement disqualifies you from getting California unemployment benefits? I need both right now to cover my bills and I'm honestly panicking a bit about what's going to happen with my claim.

Good news - California does allow you to collect both Social Security retirement benefits AND unemployment insurance at the same time. California eliminated the Social Security offset back in 2004, so your Social Security payments will NOT reduce your UI benefit amount. You need to be careful though - you still need to meet all the regular eligibility requirements for California EDD unemployment, meaning you need to be able to work, available to work, and actively looking for work each week you certify. Your Social Security status alone won't disqualify you.

AuthorOh wow that's actually really reassuring to hear. So as long as I'm doing my job search activities and certifying every two weeks I should be fine? My claim is still showing pending and I'm worried the Social Security thing is causing a hold.

this is correct. my dad collected both for almost a year when his company downsized. edd never flagged anything about his social security

Confirmed accurate. California is one of the states that removed the SS offset years ago. Just make sure you're reporting your income correctly each week - if you receive any Social Security work incentive payments or wages on top of retirement benefits, those need to be reported on your weekly certification.

The pending status on your claim is probably because of the employer dispute not the Social Security thing. When an employer contests a separation saying you quit voluntarily vs being laid off that almost always triggers adjudication. EDD has to investigate both sides before they can approve benefits. This can take anywhere from 3-6 weeks sometimes longer depending on their current backlog.

AuthorThat makes a lot of sense actually. So the adjudication is about the employer dispute not because I get Social Security? Should I be doing anything on my end while they investigate?

Yara Sayegh
Yes exactly. Keep filing your weekly certifications even while in adjudication - if you stop certifying and then win your case you'll lose those weeks of back pay. Also gather any documentation proving you were laid off - emails, termination letter, anything in writing from your employer about the workforce reduction.

same thing happened to me when my boss tried to say i resigned. took about 5 weeks but edd sided with me because i had email proof

Since you're stuck in adjudication and probably need to talk to an actual EDD rep to find out what's going on with your claim, I want to mention something that helped me when I was in a similar situation. I used a service called Claimyr to get through to a live California EDD agent without spending all day redialing. Their site is claimyr.com and they have a demo video at https://youtu.be/JmuwXR7HA10 that shows how it works. When my claim was in adjudication I needed to submit additional info and couldn't get anyone on the phone for three weeks. Claimyr got me connected to an agent same day. Might be worth looking into while you're waiting.

AuthorI've been trying to call EDD literally every morning and can't get through. I'll check out that video. Does it actually work?

Worked for me twice. The key is it basically navigates the phone queue for you. Got to speak with an agent within a few hours both times.

sounds too good to be true honestly but I've seen a few people on here mention it so maybe its legit

A few people in my local job search group have used Claimyr with good results. Getting a live EDD agent on the phone is genuinely one of the hardest parts of this whole process.

wait I thought you had to report social security income when you certify weekly?? like wouldn't that count as income and reduce your benefit amount?

QuantumQuasar
Social Security RETIREMENT benefits are not counted as wages in California and don't reduce your UI benefit amount. However if you're talking about Social Security work credits or SSDI that's a different situation. Regular retirement benefits - no offset in California.

oh ok so retirement specifically. what about if someone is on ssi

SSI (Supplemental Security Income) is also handled differently. If you're collecting SSI you need to report UI benefits as income to Social Security because it could affect your SSI payment amount. But from EDD's side, the UI eligibility still stands based on your work history. It gets complicated when SSI is involved so I'd recommend calling EDD and also the SSA to understand both sides.

AuthorMine is just regular retirement benefits so it sounds like I'm in the clear on that piece. Still need to resolve the adjudication situation though.

I went through almost this EXACT situation eight months ago. Was collecting retirement SS, got laid off from a hotel front desk job, employer tried to claim abandonment which was absolute garbage. My claim sat in adjudication for 31 days. What finally moved it was calling EDD and specifically asking to speak with an adjudicator about my pending case - not just a general rep. They can leave notes on your file that sometimes speed things up. Also fax your documentation to the adjudication unit directly, don't just wait for them to contact you.

Miguel Ramos
AuthorWait you can request to speak specifically with an adjudicator? I didn't know that. Is there a specific number to call for that or just the main EDD line?
0 coins
Oliver Schulz
Main line, but when you get through ask them to transfer you to the adjudication unit or leave a note for your adjudicator. It doesn't always work but it helped in my case. The faxing thing was huge - I faxed my termination paperwork and an email chain from my manager and my case was approved within a week of that.

the fax tip is underrated. edd's online message system is unreliable but fax submissions get into the physical file faster sometimes

ok real talk the california edd phone system is an absolute nightmare. i spent THREE WEEKS trying to get through. calling at 8am calling at lunch calling randomly throughout the day. mostly just getting the "we cannot take your call" message and getting hung up on. it shouldnt be this hard to get basic answers about your own claim

preach. i have a full time job now but when i was on unemployment the amount of time i wasted trying to call edd was insane. like a part time job just trying to reach them

This is exactly why I ended up using Claimyr - I just couldn't afford to spend 4 hours a day redialing. Check out claimyr.com if you're hitting that wall, it got me connected when I was ready to give up on calling entirely.

To clarify the job search requirement since you mentioned Social Security and working part-time - California EDD requires you to make at least three job search contacts per week while claiming UI benefits UNLESS you are on standby status or have a return-to-work date. These contacts need to be logged in your CalJOBS account. Since you were doing part-time work supplementing SS income, make sure your work search activities are realistic for your availability and the type of work you're seeking.
0 coins
Miguel Ramos
AuthorI actually wasn't aware about the CalJOBS requirement. I've been keeping a paper log but haven't set up CalJOBS yet. Is that going to be a problem?
0 coins
Connor Gallagher
You should set up your CalJOBS account as soon as possible at caljobs.ca.gov - it's technically required as part of UI eligibility. EDD doesn't always audit it immediately but not having it registered can create issues especially if your claim is already in adjudication. Register, upload your resume, and log your past job search activities there.

Yara Sayegh
Seconding the CalJOBS setup urgently. During adjudication EDD sometimes does a more thorough eligibility review and missing CalJOBS registration can become an additional problem on top of the employer dispute.

My mom is in almost the same boat - she's 68 on Social Security and got laid off from her bookkeeping job in January. Her California EDD claim got approved no problem and the SS retirement income was never mentioned as an issue. She gets her full UI benefit amount plus her SS check every month. So yes it definitely can work out fine.
0 coins
Miguel Ramos
AuthorThat's really encouraging to hear about your mom. Did she have any issues with the employer or was her claim straightforward?
0 coins
Javier Cruz
Her employer actually provided a nice layoff letter so there was no dispute. Her claim approved in maybe 10 days. Your adjudication situation sounds more complicated but the SS piece shouldn't add to that.

CosmicCowboy
yeah the employer dispute is really the main thing here, not the social security. OP should focus energy on getting that documentation together

One thing nobody has mentioned - if you're receiving Social Security retirement AND you file for UI benefits, Social Security needs to be aware in some cases that you have additional income. Check with SSA.gov to confirm whether your specific Social Security retirement benefit type has any reporting requirements on their end when you start receiving UI. California EDD won't penalize you but SSA has their own reporting rules depending on what program you're on.

QuantumQuasar
Good point. Standard Social Security retirement benefits (not SSI) generally don't have income limits that would be affected by UI, but it's always smart to verify with SSA directly since everyone's situation is slightly different.
0 coins
Miguel Ramos
AuthorI'm on standard retirement benefits not SSI so hopefully that simplifies things. But I'll call SSA as well just to confirm nothing on their end gets complicated.

did you certify for your first two weeks yet?? because if your claim is just showing pending and you havent certified that might be part of the problem. EDD wont process much until you start certifying
0 coins
Miguel Ramos
AuthorYes I've certified for three biweekly periods so far. All showing as pending. I believe it's all tied to the adjudication status from the employer dispute.

CosmicCowboy
oh ok good. yeah then it sounds like adjudication is just the wait. keep certifying no matter what

Yara Sayegh
Correct - never stop certifying during adjudication. Those payments are held pending resolution and then released in a lump sum once approved. Claimants who stop certifying during adjudication and then win their appeal end up losing weeks they should have been paid for.

JUST want to add that edd adjudication for employer disputes is NOT the same as being denied. I see so many people freak out when they hit adjudication and think their claim is rejected. It just means they're investigating. Most employer disputes where the claimant was genuinely laid off get resolved in the claimant's favor because employers often can't actually document their claims that the person quit voluntarily.
0 coins
Miguel Ramos
AuthorThank you for clarifying that. I definitely have been catastrophizing and treating pending adjudication as basically a denial. That's helpful to keep in mind.

Oliver Schulz
This is true in my experience too. If you have ANY documentation showing you were laid off - even an informal email saying the position is being eliminated - that usually carries more weight than the employer just claiming you quit with no evidence.

Update for OP - to directly answer your original question one more time clearly: YES you can collect California EDD unemployment and Social Security retirement benefits simultaneously in California. The state eliminated the SS offset over 20 years ago. Your pending status and adjudication is 100% about the employer dispute over how your separation happened, not your SS status. Focus on documenting your layoff. If you need to talk to EDD about your adjudication status and can't get through by phone, Claimyr (claimyr.com) is worth trying - they have a video at https://youtu.be/JmuwXR7HA10 showing the process. Good luck.

slightly off topic but this thread made me realize I had no idea california removed the SS offset. I'm years away from retirement but my parents have been super worried about this exact scenario. Sending this thread to my dad who's been afraid to take any part-time work while on SS because he thought it would disqualify him from UI if something happened. Really useful info here.

QuantumQuasar
Worth noting that the WORK rules for Social Security retirement (earning limits before full retirement age) are separate from the UI question. Your dad should look into how working while collecting SS affects his SS benefits depending on his age - it's a different issue from the EDD UI eligibility question but still relevant for planning purposes.

Malik Thomas
oh that's a good point. he's past full retirement age so i think the earnings limits don't apply to him anymore but I'll make sure he understands the distinction

went through adjudication twice with california edd. first time 4 weeks second time almost 7 weeks. both times i eventually got approved but the waiting is brutal especially when you dont know if your bills are gonna get covered. hang in there OP the system is slow but it does work eventually for legitimate claims

honestly just tried to stay busy applying for jobs and kept copies of everything. and i made peace with the fact that calling edd obsessively wasn't helping my anxiety lol. i did eventually use Claimyr to get through to an agent around week 5 just to confirm my claim was still active - that actually helped my anxiety more than anything knowing nothing had fallen through the cracks

The peace of mind from just confirming your file is intact during a long adjudication is genuinely underrated. Sometimes you just need to hear from a human that yes your claim exists and is processing.

can you still collect edd if you are on social security disability? asking for a family member situation
0 coins
Connor Gallagher
SSDI (Social Security Disability Insurance) is more complicated for UI purposes. If you're collecting SSDI it means SSA has determined you have a disability preventing substantial gainful employment - but UI requires you to certify that you're ABLE to work, AVAILABLE to work, and actively seeking work. These two requirements can contradict each other. The situation depends heavily on the individual's specific disability, whether they can legitimately certify they're able and available, and what type of work they're looking for. It's a gray area that really requires speaking with an EDD specialist.
0 coins
Zainab Omar
yeah SSDI is really different from retirement SS for this purpose. the able and available requirement is the sticking point. not saying it's impossible but definitely more complicated than the retirement SS situation.

Isabella Costa
ok thanks. she has a partial disability and was working modified duty so maybe there's an argument she's still able and available for modified work. will have her call edd to ask

update: I helped my neighbor navigate basically this same question last month. He was on SS retirement, got laid off from a grocery warehouse after 6 years, employer claimed he abandoned the job which was false. After adjudication EDD approved his claim and he received full back pay for all the certified weeks during adjudication. The SS retirement income was never brought up once in the whole process. So it absolutely works out.
0 coins
Miguel Ramos
AuthorThis is exactly the kind of outcome I'm hoping for. Did your neighbor have to do anything special to get it resolved or did it just process on its own?
0 coins
Ravi Malhotra
He sent in a detailed written statement through the EDD portal explaining his side of the separation with specifics - dates, who told him he was being laid off, the reason given. That seemed to help move things along. The adjudicator also called him with a few questions which he said was actually a good sign - it meant they were actively working his case.
0 coins
Yara Sayegh
The phone call from an adjudicator is definitely a positive sign when you get it. It means they're in the active review phase not just the backlog queue. Make sure you answer unknown numbers OP because EDD adjudicators call from blocked or government numbers sometimes.

how much does social security reduce your unemployment in other states? trying to understand if california is actually different
0 coins
QuantumQuasar
Some states do reduce UI benefits based on Social Security income - typically by 50% of the Social Security amount. So if you received $1,200/month in SS some states would reduce your weekly UI by the equivalent of $600/month. California eliminated this offset, so you receive your full calculated UI benefit regardless of SS income. It's one area where California's unemployment system is actually more claimant-friendly than many states.
