My company just announced we're all getting furloughed starting July 12th for about 2 months. This is my first time dealing with unemployment and I'm not sure when I can actually apply for benefits. Do I have to wait until my last day of work? Can I apply now since I already know the furlough is coming? Also wondering if furloughs qualify the same as layoffs for unemployment benefits? Pretty stressed about this whole situation since I've got rent and car payments to worry about.
I'm freaking out about my upcoming EDD phone interview this Friday. Got terminated from my warehouse job after missing 8 days over 3 months - two separate COVID infections (Jan and April) that my employer is claiming were 'unexcused absences' despite me providing doctor's notes for both illnesses. To make things more complicated, I've got an active workers' comp claim with them for a back injury I got in December. I wasn't receiving wage replacement, just medical coverage for physical therapy. My supervisor kept assigning me tasks that violated my work restrictions (heavy lifting over 25lbs when my PT doctor restricted me to 10lbs max). I documented everything and informed HR twice. Could either of these situations hurt my unemployment claim? The termination letter says 'excessive absenteeism' but doesn't mention my work restrictions or the workers' comp situation at all. What should I prepare for the phone interview?
hav u applied 4 disability 2? sounds like u qualify 4 both with ur situation. my cousin got EDD and then disability for her back injury when she got laid off
Based on everything you've shared, I think you have a strong case for unemployment approval. The fact that other employees had similar COVID absences but weren't terminated is very relevant - definitely mention that in your interview as it suggests potential discrimination or retaliation related to your workers' comp claim. As for the work restrictions issue, that's a separate potential violation but it reinforces the narrative that your termination wasn't truly about attendance but about your workplace injury. Bring any emails or documentation showing they were assigning duties outside your medical restrictions. One last tip - if for some reason your claim is denied (which I don't expect), remember you can appeal the decision. The appeal approval rate in California is actually quite high when employees have documentation.
Just got an amended UI award letter in the mail that's got me a bit nervous. EDD apparently found income from an employer I worked for 2 years ago that I didn't include in my application (honestly wasn't trying to hide anything - I just don't have access to those old pay stubs anymore). The letter shows my weekly benefit amount is still the same since I was already at the max benefit ($550). Should I be worried about this amended notice? Will it delay my claim processing? I filed almost a month ago and still haven't received my first payment. My UI Online account shows everything as "pending" with no clear explanation why. Is this normal for first payments? How much longer should I expect to wait before I start panicking?
btw make sure u check ur spam folder too. sometimes edd emails go there and u miss important stuff. happened to me
Just checking back - were you able to contact EDD about your delayed payment? If so, what did they say was causing the hold-up?
Thanks for following up! I was finally able to get through using that Claimyr service someone mentioned above. Turns out EDD had flagged my account for an eligibility interview because of the amended wages, but they never sent me a notification about it. The rep scheduled an interview for next week and said my payments should process after that. At least now I know what's happening!
I'm freaking out right now. Got fired last week from my admin job at a healthcare office after 14 months. My manager accused me of 'falsifying patient records' when all I did was follow the file organization process they taught me during training. Yes, I made some mistakes on about 8-10 files over the past few months (dates entered wrong, missing checkboxes, etc) but it wasn't intentional AT ALL. I filed for unemployment and just got a notice saying I might be disqualified for misconduct. Can they really deny my benefits for honest mistakes? The termination letter specifically says 'falsifying files' which sounds deliberate but I NEVER intentionally did anything wrong. Has anyone successfully appealed something like this? I've got rent due in 3 weeks and no savings left.
Has EDD scheduled your eligibility interview yet? That's where they'll determine if the misconduct disqualification applies. In my experience, if you haven't received an interview date within 10 days of filing, you should be proactive about contacting them. Most people just wait and end up in benefit limbo for weeks.
No interview date yet. The determination notice just says they'll contact me. I've tried calling but can't get through - just the 'too many callers' message and then it hangs up. I'm going to try that Claimyr service the other person mentioned because I can't afford to wait around.
During your eligibility interview, be prepared for specific questions about your termination. The EDD interviewer will likely ask: - Did you receive proper training for the tasks? - Were you aware of the correct procedures? - Had you previously been warned about similar errors? - What was your understanding of the consequences for making these errors? The key factor will be establishing that any mistakes were not intentional or deliberate violations of company policy. If this truly was a case of occasional errors rather than deliberate falsification, you should prevail in your claim.
This is really helpful - thank you! I was only given one verbal warning about a month ago about being more careful with paperwork, but nothing formal. And I actually improved after that conversation. These recent mistakes they fired me for were different types of errors that nobody ever mentioned were problems before. I'll make sure to explain all this during the interview.
I lost my job last week (restaurant shut down suddenly) and I've been desperately trying to file for unemployment since Thursday morning. The EDD website keeps giving me an error when I try to create an account saying 'we cannot process your request at this time.' I've tried calling the main EDD number at least 25 times but either get a busy signal or that automated message saying they're experiencing high call volume before it hangs up on me! I'm getting really worried as my rent is due in 2 weeks and I have maybe $430 to my name right now. Is there ANY phone number that actually connects to a human being at EDD? Or some secret time of day when the lines aren't jammed? This is my first time applying and I'm completely lost. Any advice would be so appreciated!
When you apply online, make sure you're using a desktop computer if possible, not a mobile device. Many of the website errors happen on phones or tablets. If you keep getting the error message, try using Internet Explorer (yes, the old browser) as the EDD website sometimes works better with it. For phone contact, here's a method that worked for me: call the 833-978-2511 number, press 1 for English, then when prompted press 2 and immediately after press 4. This sequence sometimes gets you to a queue instead of the disconnection message. Be prepared to wait 1-2 hours once you're in the queue. While you're waiting to get through, gather all your employment information: last employer details, start/end dates, reason for separation, wages earned, etc. Having this ready will make the application process much smoother when you finally connect.
Just wanted to update that I was able to get through today! I tried the 833 number that people suggested with the 1-2-4 sequence right at 8:01am. It took about 7 attempts but I finally got into the queue instead of being disconnected. Waited about 45 minutes but finally spoke to someone who helped me file my claim. They said I should receive my account number in the mail within 10 days. Thank you everyone for the help!

My cousin said the whole EDD system is messed up now and everyone is getting automatically flagged for interviews! Be prepared to wait FOREVER

That's not accurate. While some claims do get flagged for eligibility interviews, it's not automatic for everyone. Furloughs with definite return dates are actually some of the most straightforward claims, especially if the employer properly reports the furlough to EDD. The system has improved significantly since the pandemic overload.

Just to clarify something important: when you apply before your last day, make absolutely sure to enter your correct last day of work. Don't put the application date as your last day worked. This is a common mistake that causes problems. The system will ask for your last day worked - that should be your actual final day at work (July 11th based on your post). And be careful with your first certification. If you work any days in that first certification period, accurately report those days and earnings or you could end up with an overpayment situation later.

AuthorThank you for pointing this out! I definitely would have been confused about how to handle the overlap between application and last day worked. I'll make sure to be precise with all the dates.
