Just a quick update on the "reasonable assurance" rule - as of January 2025, EDD updated their guidelines for contract employees at educational institutions. The key factors they now consider are: 1. Whether there's a written guarantee of reemployment 2. Whether there's a consistent history of reemployment after breaks 3. Whether the contractor (not just the school) has indicated future work Make sure to download and review Form DE 1870C from the EDD website before your interview - it contains the specific questions they'll ask about educational employment. Being prepared with this information will help tremendously during your interview.
i think they just do these interviews to scare people tbh. my cousin works at a school cafeteria (not district employee either) and they did this same thing to her every summer for like 3 years. she always got approved in the end but they make you jump thru hoops first cause thats what edd does lol
To answer your follow-up question - yes, go ahead and certify for those uncertified weeks now. When you do, you'll enter your employment information and earnings for each week. This tells EDD you returned to work. You won't get in trouble for the delay - people sometimes forget to do this final step. What's important is that you didn't continue collecting benefits after starting work. Just make sure you accurately report your first day of work and earnings when you certify.
anyone know if this applies to part time work too? i just got a part time job but still eligible for some benefits
Different situation entirely. With part-time work, you need to continue certifying and report all earnings. EDD will calculate if you're eligible for partial benefits. Never stop certifying if you're working part-time and think you might still qualify for some benefits. Just report your hours and earnings accurately each certification period.
Thanks everyone for the advice! I just submitted my unemployment application and listed both employers. I tried to be very detailed in explaining the situation. Now I'm just waiting to see what happens. I also called the Labor Commissioner's Office about filing a wage claim for the unpaid work, and they're sending me the paperwork. Fingers crossed this all works out soon because my savings are getting really low.
Good job taking action quickly! Be prepared for EDD to schedule an eligibility interview - this is standard procedure when there's a voluntary quit involved. Make sure your phone number is up to date in the system and answer any unknown calls during business hours as it could be EDD. Also check your UI Online account daily for any notices or requests for additional information.

•Thanks for the tip! I'll check the original paperwork tonight and see if there's a separate number listed. Anything is worth trying at this point.
