Help! My MIL's PFL claim was denied after she took time off to care for me post-surgery. She's been out of work for a month caring for me, and now we're in a financial bind. The denial letter stated that a "fighter-in-law" isn't on the list of qualifying family members (I think they misread her handwriting where she wrote "daughter-in-law"). my sister in law had this EXACT same problem last year!!! they said she couldnt care for her brother in law but thats absolutely allowed. the EDD rep told her it was a training issue with new claim processors not understanding all the family relationships that qualify. definitely appeal and send in your marriage license!!

my cousins wife had almost the exact same thing happen!!!! but hers was because she wrote "daughter-in-law" and they said that wasn't covered. she gave up and didn't appeal so they never got the money. dont do what she did!!!! APPEAL!!!

btw has your MIL applied for unemployment while waiting for the appeal? she might qualify since she's available for work but just waiting on the PFL appeal.

She hasn't because she's still actively caring for me and not actually available for work. I'm still recovering from surgery and need her help. That's why this PFL denial is so stressful.

Also, regarding the previous claim being approved when she listed herself as "mother" instead of "mother-in-law" - I wouldn't mention this in your appeal as it could potentially complicate things.
