EDD PFL application with severance - How to explain 'Separation and Release' payment?
Hey everyone, I'm in a bit of a pickle and could use some advice. I just got laid off and received a severance package, but I'm also applying for Paid Family Leave (PFL). I'm worried that the EDD might misunderstand my severance as regular wages. My severance paperwork clearly states it's a 'Separation and Release' payment, not a continuation of wages. Has anyone dealt with receiving PFL and severance at the same time? I've heard it's possible if it's coded correctly, but I'm not sure how to explain this to EDD when I talk to them. Any tips on how to handle this situation?

Oof, that's a tough situation. But don't worry, you're not alone! I went through something similar last year. Here's what you need to know: • Severance and PFL can be received simultaneously if coded correctly • Your severance being labeled as 'Separation and Release' is crucial • When talking to EDD, be very clear that this is NOT regular wages • Bring your severance paperwork as proof if possible • Ask your former employer for a letter explaining the nature of the payment if needed Remember, persistence is key with EDD. Don't be afraid to ask for a supervisor if the first agent doesn't understand. Good luck!

•This is solid advice 💯 I wish I had known this when I was dealing with EDD last year!

•Quick question - did you have to submit any extra paperwork to EDD to prove the severance wasn't regular wages?

•@profile 3 Yeah, I ended up sending them a copy of my severance agreement and a letter from HR. Better safe than sorry!

•Preach! 🙌 I've been trying to get through to them for weeks. It's like they're allergic to answering phones or something

•Have you guys tried calling right when they open? I heard that's the best time to get through.

Hey, I found a way to actually get someone on the phone at EDD! I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/DOLxZQb92wM

•Sounds too good to be true. Are you sure it's legit?

•@profile 8 Totally get the skepticism, but I can vouch for it. Used it twice now, worked both times. Saved me hours of frustration.

•How long did you have to wait once they started calling?

•@profile 9 It varied. First time was about 45 mins, second time closer to 2 hours. Still beats calling myself all day!

Pro tip: Keep a detailed log of all your interactions with EDD. Note down who you talked to, when, and what was said. It'll save your butt if there's any confusion later.

•This! 👆 I learned this the hard way. Ended up in a 'he said, she said' situation with EDD. Not fun.

have you tried reaching out to your local state representative? sometimes they can help cut through the red tape with EDD

Okay, but can we talk about how messed up it is that we even have to jump through all these hoops? The system is broken, y'all. 🤡

•True, but complaining won't solve OPs problem. Let's focus on helping them navigate the system we're stuck with for now.

Hey Zoe! I went through this exact situation about 6 months ago. The key thing is to be super clear with EDD that your severance is a one-time separation payment, not ongoing wages. When I called, I specifically said "This is a lump-sum severance payment for separation, not continuation of salary" and had my severance letter ready to reference. Also, make sure your former employer coded it correctly on their end - they should report it as severance, not regular wages. If there's any confusion, ask for a corrected form from HR. One more tip: if the first EDD rep doesn't seem to understand, politely ask to speak with someone else or a supervisor. Some agents are more familiar with these situations than others. You've got this! 💪

•This is super helpful! @Zoe Alexopoulos - definitely save this advice. The part about making sure your former employer coded it correctly is crucial. I had a friend who got denied initially because HR messed up the coding on their end. Once they fixed it and resubmitted, everything went smoothly. Thanks for sharing your experience @Alina Rosenthal! 🙏

Just wanted to add - if you're still having trouble getting through to EDD by phone, try their online contact form first. Sometimes they respond faster to written inquiries, and you'll have a paper trail of your communication. Also, check if your former employer has an HR hotline or benefits specialist who can help clarify how they reported your severance payment. I had to go back to my old company twice to get the right documentation, but it was worth it in the end. The whole process is frustrating, but don't give up! You're entitled to both benefits if everything is coded correctly.

•Thanks for the tip about the online contact form! I've been banging my head against the wall trying to get through on the phone. Quick question - do you remember roughly how long it took them to respond to your online inquiry? I'm dealing with a time-sensitive situation and trying to figure out if I should keep calling or go the online route. Also, when you say "paper trail," did you save screenshots or did they send you confirmation emails?
