EDD ignoring overpayment waiver docs - need advice on appealing!
Hey everyone, I'm having a major issue with EDD. I sent in documents for an overpayment waiver, but the overpayment department isn't doing anything with them. I've tried calling but can't get through. Has anyone dealt with this before? What should I do? I'm thinking about appealing but not sure if I need representation or how that whole process works. Any advice would be really appreciated!

Ugh, dealing with EDD is THE WORST. I've been in the same boat, my friend. Have you tried faxing your documents? Sometimes that works better than mailing or uploading online.

ā¢I haven't tried faxing yet. Do you know if there's a specific fax number for the overpayment department?

ā¢I don't have the exact number, but you can probably find it on their website. Just make sure to keep the fax confirmation as proof!

I found a way to actually get someone on the phone! I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/1X-mEsLtbmQ

ā¢Sounds too good to be true. Has anyone else tried this?

ā¢I get the skepticism, but it seriously worked for me. After weeks of trying, I finally got through. Worth every penny imo

ā¢How long did you have to wait once they connected you?

ā¢Only about 5 minutes! Way better than spending hours on hold yourself

Listen up, because I've been through this whole song and dance with EDD. Here's what you need to do: ⢠First, document EVERYTHING. Every call, every letter, every online submission. Dates, times, names if you can get them. ⢠Next, reach out to your local state representative's office. They often have liaisons who can cut through the red tape. ⢠If that doesn't work, file a formal appeal. Yes, it's a pain, but it's your right. ⢠Consider getting legal help. There are non-profits that specialize in EDD issues and can represent you for free or low cost. ⢠Keep pushing. The squeaky wheel gets the grease, as they say. Remember, the system is designed to wear you down. Don't let it. You've got this! šŖ

ā¢Wow, thank you so much for this detailed advice! I'll definitely start documenting everything right away. Do you have any recommendations for non-profits that could help?

ā¢Check out Legal Aid at Work or your local Bar Association. They often have resources or can point you in the right direction.

I'm curious, what was the reason for the overpayment? Sometimes that can affect how they handle your case.

ā¢They said I didn't provide enough proof of my self-employment income, even though I sent in all my tax documents š©

ā¢Oof, that's rough. Definitely appeal that decision if you haven't already. Sounds like someone might have misplaced your docs.

I hate to say it, but you might need to get a lawyer involved. EDD can be real sticklers about overpayment stuff. It sucks, but sometimes having a legal eagle on your side is the only way to make them listen.

ā¢Lawyers are $$$ tho. OP, check if there's any pro bono services in your area first!

ā¢Good point! Some lawyers also do free consultations, so that could be worth looking into as well.

Hot take: the whole unemployment system is broken af. We shouldn't have to jump through 1000 hoops just to get help when we're already struggling. Time for a complete overhaul imho

I went through something similar last year and it was incredibly frustrating! One thing that helped me was sending everything certified mail with return receipt requested - that way you have proof they received your documents. Also, try reaching out to your state assembly member's office. I was shocked at how quickly they were able to get someone from EDD to actually look at my case. Most people don't know that their representatives have staff specifically for helping constituents with government agency issues. It's free and they know exactly who to contact at EDD. Good luck - don't let them wear you down! šŖ
