Westchester County Clerk UCC Filing Portal Down Again - Need Emergency Continuation Options
I'm in a panic here - our UCC-1 expires next month and I've been trying to file a continuation through the Westchester County Clerk's office for weeks. Their online portal keeps timing out during document upload, and when I call they say the system is 'undergoing maintenance' with no ETA. This is for a $2.8M equipment loan and if we miss the deadline our security interest lapses completely. Has anyone successfully filed UCC continuations with Westchester recently? Are there alternative filing methods I'm missing? The debtor name is exact match to original filing so that's not the issue - it's purely a technical problem with their system. Really need guidance before this becomes a disaster.

Westchester has been notorious for portal issues lately. You can still file paper continuations by mail or in person - check their fee schedule because paper filings cost more. Make sure you have certified copies of the original UCC-1 ready.

•Paper filing is your safest bet right now. I'd drive there personally given the stakes - you don't want to risk mail delays with a deadline this tight.

•Wait, can you even do paper UCC filings anymore? I thought everything went electronic only after 2020.

I dealt with this exact situation last month with a different county clerk. The key is having all your documentation perfectly aligned before you even attempt to file. Have you verified that your debtor name format matches exactly between your original UCC-1 and the continuation form? Even minor punctuation differences can cause rejections.

•Yes the debtor name is identical - I've triple checked that. It's definitely a portal technical issue not a document problem.

•Document verification is crucial though. I learned this the hard way when a filing got rejected for a middle initial discrepancy I never noticed.

•Actually, I just started using Certana.ai's document checker for this exact reason. You upload your original UCC-1 and continuation form PDFs and it instantly flags any name inconsistencies or formatting issues. Saved me from a costly rejection on a time-sensitive filing last week.

Westchester County has been a nightmare for months. Their IT department clearly doesn't understand the urgency of UCC deadlines. I've had three clients affected by their system outages this year alone.

•It's ridiculous how these county systems can just go down with no backup plan. Lives are being disrupted!

•Have you tried calling the main number and asking to speak with someone in the UCC department directly? Sometimes they can process things manually.

For immediate help, try calling first thing Monday morning (8 AM sharp) and explain the urgency. County clerks often have manual processing capabilities for critical deadlines. Also, make sure you're using the correct continuation form - UCC-3 with the continuation checkbox, not an amendment form.

•Good point about the form type - I am using UCC-3 with continuation selected. Will definitely call Monday at 8 AM.

•I second the early morning call strategy. County employees are usually most helpful before they get swamped with the day's problems.

•Monday morning calls work but bring your filing number, debtor name, and original filing date ready. They'll need all that info immediately.

This is exactly why I always file continuations 60-90 days early. UCC-3 continuations can be filed up to 6 months before the original expires, so you have flexibility. For your current situation though, overnight mail might be your best bet if the portal stays down.

•Great advice about early filing. I had no idea you could file that far in advance.

•Wish I'd known about the early filing window - will definitely use that strategy going forward. For now I'm stuck with emergency measures.

I've been there with system failures. What really helped me was using that Certana tool someone mentioned earlier. Before I drive to any county office, I upload my docs there to make sure everything's perfect. It catches things you'd never notice - like spacing differences in company names that look identical but aren't.

•How does that verification thing work exactly? Do you just upload both documents?

•Yeah, you upload your original UCC-1 and your continuation form as PDFs. It automatically compares debtor names, filing numbers, and flags any inconsistencies. Takes like 30 seconds and gives you confidence your filing won't get rejected.

•That sounds too good to be true. County clerks reject filings for the tiniest reasons.

•County staff attitudes vary wildly. Some are helpful, others act like you're bothering them by asking them to do their job.

•I feel your pain! Last time I went in person they made me wait 3 hours just to tell me I needed a different form.

Quick update for anyone following this thread - I managed to get through to the Westchester UCC department this morning and they confirmed their portal should be back online by Wednesday. They also said they'll accept email submissions for emergency continuations if you include a signed affidavit about the technical difficulties. Worth trying if you're in a similar bind.

•That's great news! Email submissions are definitely better than driving there. Make sure you get a confirmation receipt.

•Thank you so much for the update! I'll call them first thing tomorrow about the email option.

•Email filing is risky without confirmation. I'd still recommend the document verification step before sending anything official.

Been doing UCC filings for 15 years and Westchester has always been problematic. Their fees are higher than surrounding counties too. Sometimes it's worth checking if you can file in a different jurisdiction depending on where the collateral is located.

Amina Diallo
•Unfortunately the debtor is incorporated in NY and the collateral is in Westchester so I'm stuck with their system.

•In that case you're definitely locked into Westchester. The email option the other poster mentioned might be your best bet.

Just want to echo what others said about document verification before you submit anywhere. I had a continuation rejected once because the debtor's LLC designation was 'L.L.C.' on the original but 'LLC' on my continuation. Looked identical to me but their system flagged it as a mismatch.

•This is exactly why automated verification tools are so valuable. Human eyes miss these tiny differences that can kill a filing.

•Wait, periods in LLC abbreviations matter? I never knew that could cause rejections.

•Oh yeah, punctuation absolutely matters. County systems are very literal about exact matches. Better safe than sorry.

I'm new to UCC filings and this thread is terrifying! I have a continuation due in a few months and now I'm worried about running into the same portal issues. Should I be filing way earlier than I planned? Also, can someone explain more about this document verification tool that keeps getting mentioned - is it really necessary or just extra caution?
