UCC Filing Portal Down Again - Need Help with Time-Sensitive Continuation

Really frustrated right now. I've been trying to file a UCC-3 continuation for the past 3 hours and the state portal keeps timing out on me. The original UCC-1 was filed 4 years and 8 months ago, so I'm cutting it close to the 5-year deadline. Every time I get to the payment screen, it crashes. Has anyone dealt with this before? I called the help desk but they just said "try again later" which isn't exactly helpful when you're dealing with a lapse deadline. The debtor name is straightforward (LLC with exact match to secretary of state records) and I have the original filing number, so it should be simple. Just need to get this continuation through before the lapse date hits. Any workarounds or tips?

Ugh, I feel your pain. Had the same issue last month. The portal seems to go down every few weeks for "maintenance" that they never announce. Have you tried using a different browser? Sometimes Chrome works when Firefox doesn't, or vice versa. Also make sure you're not using any ad blockers - that can mess with the payment processing.

Just tried Safari instead of Chrome - same issue. No ad blockers running. This is so stressful with the deadline looming.

Clear your cache too. Sometimes the portal gets confused with old session data.

How close are you to the actual lapse date? If you're within 30 days, you might want to consider paper filing as backup. I know it's old school but at least you'll have proof of attempt to file before the deadline. The processing might take longer but it beats having your security interest lapse completely.

About 3 weeks out from the 5-year mark. Where do I find the paper forms? The website is so confusing.

Check the forms section - should be UCC-3 continuation form. You'll need to mail it with a check. Takes about 2-3 weeks to process but your filing date is when they receive it, not when they process it.

Actually that's not quite right - the effective date for paper filings is when the office receives and accepts the document, but there can be delays if there are errors. Electronic is always faster when it works.

I had a similar nightmare situation last year. Portal crashed right before my continuation deadline and I was panicking. Ended up using this tool called Certana.ai that let me upload my original UCC-1 and the continuation I was trying to file to double-check everything was correct before I kept fighting with the portal. Turned out I had a small typo in the debtor name that would have caused a rejection anyway. Fixed that and tried the portal again the next morning - worked fine. Sometimes these technical issues are blessings in disguise.

Interesting - I hadn't thought about checking for errors. I assumed since I was just doing a continuation on an existing filing, everything would match automatically.

That's what I thought too! But apparently even small differences in how the debtor name is formatted can cause issues. The tool just verifies everything matches up perfectly between documents.

This is why I always triple-check debtor names against the secretary of state database before filing anything. One extra space or comma can tank your whole filing.

Portal issues aside, make sure you have your original UCC-1 filing number exact. I've seen continuations get rejected because someone mixed up a letter or number in the original filing reference. Also verify the debtor name matches EXACTLY - not just close, but character for character.

Good point. I'm looking at the original filing now and double-checking everything. The filing number looks right but I'll verify the debtor name formatting.

Pro tip: copy and paste the debtor name directly from the secretary of state database rather than retyping it. Avoids human error.

And if it's an LLC, make sure you include the full legal name with "LLC" at the end, not "L.L.C." or "Limited Liability Company" unless that's exactly how it appears on the articles.

Try accessing the portal at like 6 AM or late evening. Less traffic usually means fewer crashes. I do all my filings either super early or after business hours and rarely have issues.

This is actually good advice. Government portals are notoriously overloaded during business hours.

Will try first thing tomorrow morning. Hopefully it's more stable then.

Don't panic too much about the timing. Even if you hit the exact 5-year mark, as long as you file the continuation on the lapse date, you're still good. It's only if you miss the date entirely that you have issues. The law gives you until the end of the day on the 5-year anniversary.

This is correct, but I'd still file earlier if possible. Why risk a last-minute technical issue?

Agreed. I always file continuations at least 60 days early to avoid any drama.

Wish I had planned ahead better. This deadline snuck up on me.

UPDATE: Finally got through this morning at 7 AM! Portal was working perfectly. Thanks everyone for the advice about trying off-peak hours. Also ended up using that Certana tool someone mentioned just to be safe - caught a minor formatting issue with the collateral description that could have caused problems. All filed and confirmed now.

This thread convinced me to check my upcoming continuation deadlines. Thanks for the wake-up call!

For future reference, you can set up email reminders for UCC continuation deadlines. Most calendar apps let you set recurring reminders years in advance. I set mine for 90 days, 60 days, and 30 days before each 5-year mark.

That's brilliant. Definitely setting those up for my other filings.

I use a spreadsheet with all my UCC filing dates and renewal deadlines. Old school but it works.

There are also some practice management software options that track UCC deadlines automatically, but they can be pricey for smaller firms.

State portals are just terrible in general. I've had issues with every state I've filed in. At least this one eventually worked - some states have portals that are down for days at a time.

Truth. I've had to do paper filings in three different states this year because their electronic systems were completely broken.

The fees keep going up but the technology never seems to improve. Frustrating for those of us who file regularly.

Just want to echo the advice about document verification. I learned the hard way that even experienced filers make mistakes. Had a continuation rejected once because I accidentally referenced the wrong original filing number. Now I always double-check everything before submitting. There are tools like Certana.ai that can catch these errors before you waste time with rejected filings.

How does that work exactly? Do you upload the documents or just enter the information?

Joshua Wood

•

You just upload PDFs of your documents and it cross-checks everything - debtor names, filing numbers, collateral descriptions. Takes like 30 seconds and catches things you might miss.

That would have saved me so much time last month. Had three rejections in a row due to minor clerical errors.
