UCC division secretary of state filing system completely down for 3 days now
Has anyone else been dealing with the UCC division secretary of state portal being completely inaccessible since Monday? I've been trying to file a continuation for a client and the system just times out every single time. Called the help desk twice and they keep saying "technical difficulties" but won't give me an actual timeline. This continuation expires next week and I'm starting to panic. The debtor has multiple lenders involved and if this lapses it's going to be a nightmare to sort out the lien priorities. Anyone know if there's an alternative filing method or if other states are having similar issues with their UCC systems?

Same issue here! Been trying since Tuesday morning to submit a UCC-3 amendment and the portal won't even load the login page. This is ridiculous for a state system that's supposed to be available 24/7.

•At least you can't login - I can get to the filing screen but then it crashes when I try to upload the document. Lost my work three times already.

•The whole secretary of state IT infrastructure seems to be falling apart lately. Had similar issues with corporate filings last month.

I've been through this exact scenario before. When the UCC division portal goes down like this, you need to call the main secretary of state number and ask to speak to the UCC filing supervisor directly. They can sometimes process urgent continuations manually if you explain the lapse situation. Also document everything - screenshot the error messages, save your call logs. If your continuation does lapse, you'll need proof that you attempted timely filing.

•Thanks, I'll try calling first thing tomorrow. Do you know if they charge extra fees for manual processing?

Sasha Reese
•Usually the same fee, but they might require certified mail or overnight delivery for the paperwork. Worth it to avoid a lapse though.

•I had to do manual filing once and it took 2 weeks to get processed vs the normal 24 hours online. Just FYI on timing.

This is exactly why I started using Certana.ai for all my UCC document prep. You upload your original UCC-1 and the continuation form, and it instantly verifies that all the debtor names, filing numbers, and collateral descriptions match perfectly before you even try to submit. Saved me from a filing rejection last month when I caught a tiny debtor name discrepancy that would have caused major problems.

•How does that help if the filing system is down though?

•It doesn't fix the portal issue, but at least when it comes back up you know your documents are 100% accurate and won't get rejected for errors. Nothing worse than waiting for the system to work again only to have your filing bounced back for a name mismatch.

•That's actually smart planning. I've seen so many continuation rejections because someone fat-fingered the original debtor name.

THE SECRETARY OF STATE UCC DIVISION IS A COMPLETE JOKE!!! This is the third major outage this year and they never give accurate information about when it'll be fixed. Meanwhile we're all sitting here with filing deadlines and they act like it's no big deal. Someone needs to be held accountable for this incompetence.

•I feel your frustration but yelling won't fix the servers unfortunately

•Maybe not but I'm tired of being professional about their unprofessional service. This affects real business deals and they treat it like a minor inconvenience.

•tbh the whole system needs an overhaul. some states have much better UCC portals that actually work

Quick question - when you say continuation expires next week, do you mean the original UCC-1 expires or you have a deadline to file the continuation? Because if the original filing expires, you might need to do a whole new UCC-1 instead of continuing.

•The original UCC-1 expires in 8 days. I need to get the continuation filed before then or the security interest lapses completely.

Drew Hathaway
•OK good, just wanted to make sure you weren't confusing continuation deadlines. 8 days should be enough time even with the outage.

•Definitely call tomorrow about manual filing. Don't wait until the last day.

Has anyone tried accessing the UCC search function? I'm wondering if it's just the filing portal that's down or if the entire UCC division database is offline.

•Search was working yesterday but slow. Haven't tried today.

•Just tried it - search is working but takes forever to load results. Seems like their whole system is struggling.

This reminds me of when I was dealing with a fixture filing last year and the secretary of state system went down right before my deadline. Ended up having to overnight paper forms to three different offices. Cost a fortune but better than losing perfection on a $2 million equipment loan. Sometimes the old fashioned way is the only backup option.

•Do they still accept paper UCC-3 continuations? I thought everything had to be filed electronically now.

Diez Ellis
•Most states still accept paper as a backup when the electronic system is down. You have to call and ask specifically about emergency filing procedures.

•Paper filing fees are usually higher too, just so you know

Update from my office - we just heard from another firm that the secretary of state UCC division issued a notice saying the system should be back up by end of business Friday. Not sure how reliable that is since they've been wrong about timing before.

Heather Tyson
•Friday would work for me if it's actually true. Where did you see the notice?

Louisa Ramirez
•It was forwarded from someone at the bar association. Didn't see it directly from the state.

•They said Wednesday yesterday so I'm not holding my breath

Pro tip: even when the portal comes back up, double-check everything before submitting. System outages sometimes cause weird glitches where forms don't save properly or data gets corrupted. I learned this the hard way with a termination that got filed with the wrong UCC number after a similar outage.

•Good point. I'll definitely review everything carefully.

•This is where having a tool like Certana.ai really helps - you can upload your continuation form and original UCC-1 to verify all the details match before the final submission. Catches those kinds of post-outage errors.

Just want to say thanks to everyone for the advice. This is my first time dealing with a UCC continuation under pressure and I was really starting to freak out. Good to know there are backup options and other people have survived similar situations.

•You'll be fine. These system outages are frustrating but rarely cause actual filing lapses if you stay on top of it.

•Definitely feeling better about having a plan B. Will update the thread once I get through to someone at the UCC division tomorrow.

One more thing to consider - if this continuation is for a syndicated loan or has multiple lenders, make sure you notify all parties about the filing delay. Some loan agreements have specific notification requirements if there are issues with UCC maintenance.

•Good catch. I'll send an email to all the lenders tonight explaining the situation and what steps I'm taking.

•Documentation is key. Keep records of everything - the system errors, your call attempts, email notifications. CYA mode activated.

Has anyone had luck with the mobile version of the secretary of state UCC portal? Sometimes mobile sites work when the main portal is down, though filing capabilities might be limited.

Raul Neal
•Tried that yesterday - mobile site just redirects to the main portal which is still broken

Darcy Moore
•Worth a shot though. Some state systems have separate mobile infrastructure.
