West Virginia Secretary of State UCC Filing Portal Down Again - Anyone Else Having Issues?
Is anyone else completely unable to access the west virginia secretary of state ucc filing system today? I've been trying since 7am to submit a continuation filing that's due next week and the portal keeps timing out. This is the third time this month I've had issues with their online system. My client's UCC-1 expires in 8 days and I'm starting to panic about getting the continuation filed on time. The error message just says 'system temporarily unavailable' but I need to know if this is widespread or just me. Has anyone successfully filed a UCC-3 continuation through the WV SOS portal in the last 24 hours? I'm worried about the lapse timing and whether I should try calling their office directly, but last time I called they said phone filings aren't accepted anymore - everything has to go through the online portal. Really frustrating when you're trying to protect a $850K equipment lien and the state's own system won't cooperate.

You still have time - continuations can be filed up to 6 months before the UCC-1 expires and as long as it's filed before the expiration date you're fine. But yes, the WV SOS portal has been having issues. I usually try early morning or late evening when there's less traffic on their servers. Also make sure you have the exact debtor name from the original UCC-1 - any variation will cause the system to reject it.

I filed a UCC-1 in West Virginia about 3 weeks ago and had to try multiple times over two days before it went through. Their system seems to have peak hours where it's completely unusable. Try between 11pm-6am if you can - that's when I've had the most success. Also, make sure your PDF isn't too large - their system seems to choke on files over 5MB.
