Will ESD stop payments due to new adjudication while laid off again?

My husband was partially employed for a few weeks (reported everything correctly) and has been receiving partial UI benefits. Yesterday he noticed ESD added a new adjudication to his account about a potential overpayment related to one of his weekly claims from last month. Now he's been laid off completely again and needs full unemployment benefits. Will this new adjudication freeze all his payments while they investigate? We rely on these payments for rent and I'm freaking out about what happens next. Has anyone dealt with a similar situation where an adjudication popped up in the middle of an active claim? Will they keep paying while they investigate or are we about to have zero income?

In my experience, adjudication doesn't automatically stop all payments, but it depends on the specific issue. If the adjudication is only related to that specific week in question, they should continue paying for new weeks while they investigate the earlier claim. He needs to keep filing his weekly claims as normal even with the adjudication open. Make sure he accurately reports his new completely laid-off status on the next weekly filing.

Thank you! So even with an open adjudication he should receive payment for the new weeks? That's a huge relief. He'll definitely keep filing. Do you think we should call ESD to explain the layoff situation or just let the weekly claims speak for themselves?

Oh no, that's exactly what I'm afraid of! Did you do anything special to get it resolved? We can't go 6 weeks without income...

Had something similar happen in January. My advice is DOCUMENT EVERYTHING. Take screenshots of every earnings report you submitted, every notification, etc. They might request proof later and having it ready speeds things up. Also when was he notified about the adjudication? There should be a letter explaining exactly what they're investigating.

That's great advice about documentation. We didn't get any letter yet - it just showed up in his online account yesterday with status "adjudication in progress" but no explanation. Should we wait for the letter or be proactive?

The answer is: it depends on the type of adjudication. Some issues will hold up all payments, while others only affect the week in question. Your husband should: 1. Continue filing weekly claims accurately 2. Check his eServices account for any messages about what specific issue they're investigating 3. Respond immediately to any information requests from ESD 4. Be prepared with documentation showing his income was correctly reported If it's a simple verification issue and he reported everything correctly, they may continue paying while investigating. If it's a more serious eligibility question, they might pause payments until resolved.

This is really helpful information. We've checked messages and there's nothing yet explaining what they're investigating. I guess we'll know more when we see if his next payment comes through or not... which is stressful.

My best advice after going through this TWICE is to try calling ESD directly. Their automated system is useless but if you can get through to a real person they can often tell you exactly what the adjudication is about and whether payments will continue. It's impossible to get through though - I spent 3 days calling repeatedly before connecting with someone who could actually help.

I was about to suggest the same thing! OP, you should try using Claimyr (claimyr.com) to get through to ESD faster. It saved me so much time when I was dealing with adjudication last month. They basically call ESD for you and connect you when an agent is available instead of you having to redial constantly. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. The ESD rep I talked to was able to tell me exactly what the issue was and confirm my payments would continue while they investigated.

I work in HR and deal with this stuff frequently. There's a difference between a "potential overpayment investigation" and a "benefit eligibility investigation." If it's just about a specific week's earnings calculation, they usually keep paying while they sort it out. If it questions his overall eligibility, they might pause everything. Look for the specific issue code on his account - anything starting with UCFE means federal employment verification, which doesn't usually stop payments. Anything with AVAIL or ABLE in the code could mean a more serious issue that might pause payments.

Thank you for the insider perspective! I just checked with my husband and the code says something about "EARNS" which I'm guessing relates to earnings reporting? Does that sound like the less serious type you mentioned?

Yes! EARNS codes typically just mean they're verifying the earnings reported for a specific week. This is actually good news - these are routine and usually don't halt ongoing benefits while they investigate. They're basically just cross-checking what he reported against what his employer reported.

this happened to me and i couldnt pay rent for 2 months. esd is the WORST!!! they made me pay back $4000 even tho it was THEIR mistake not mine!!!

I'm sorry that happened to you, but it's important not to scare the OP unnecessarily. Many adjudications are resolved quickly with no repayment required, especially if all earnings were reported correctly as they mentioned.

UPDATE: We finally got through to ESD this morning! They said the adjudication is only about that specific week where they think his hours might have been misreported (they weren't - we have documentation). The good news is they confirmed payments WILL continue for his current weekly claims while they investigate the past week! Such a relief. Also thanks to those who suggested documentation - we're gathering everything now just in case. Will update again once this is fully resolved.

That's great news! How did you manage to get through to them? I've been trying for days.

We tried that Claimyr service someone mentioned above. Honestly wasn't sure about it at first but it worked - got connected with an ESD agent in about 25 minutes instead of spending days trying to call ourselves. Definitely worth it just for the peace of mind knowing our benefits won't stop.
