Washington ESD what disqualifies you for unemployment - need to understand the rules
I'm trying to understand all the ways someone can get disqualified from unemployment benefits in Washington. My employer is claiming I was fired for misconduct but I think they're lying about what happened. Before I file my claim, I want to know what actually disqualifies you so I can be prepared. Does anyone have a complete list of disqualification reasons? I've heard conflicting information about quitting, getting fired, and refusing work.

The main disqualifications for Washington ESD unemployment are: voluntary quit without good cause, discharge for misconduct, refusing suitable work, not actively seeking work, not being able and available, and providing false information. If your employer claims misconduct, you'll need to prove otherwise during adjudication.

•What counts as misconduct exactly? They're saying I violated company policy but it was a minor thing that other employees do all the time.

Carmen Ruiz
•Misconduct has to be willful disregard of employer's interests or deliberate violation of rules. Minor policy violations usually don't qualify unless there's a pattern or you were warned.

I got disqualified for quitting my job even though my boss was harassing me. Apparently you need 'good cause' which is really hard to prove. The adjudication process took forever.

•Did you try to appeal the disqualification? I'm worried about going through all this just to get denied.

Andre Lefebvre
•Yeah I appealed and won eventually but it took 3 months total. Document everything if you decide to file.

If you're having trouble getting through to Washington ESD to discuss your situation, I found this service called Claimyr that helped me reach an agent quickly. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me hours of calling and getting disconnected.

•Is that legit? I've never heard of using a service to call ESD for you.

•Yeah it's real, check out claimyr.com. They basically auto-dial and wait in the queue for you, then patch you through when they get an agent.

•That sounds too good to be true. How much does it cost?

Other disqualifications include not meeting the base period earnings requirement, being an undocumented worker, receiving certain types of pension payments, and being incarcerated. Also if you're attending school full-time without approval.

•What's the base period earnings requirement? I worked part-time for most of last year.
0 coins
Jamal Anderson
•You need at least $1,005 in your base period and earnings in at least two quarters. Base period is usually the first 4 of the last 5 completed quarters before you file.

dont forget about the work search requirements!!! if you dont do your 3 job contacts per week they'll cut you off. learned that the hard way

•Wait, you have to look for work even if you're appealing a disqualification?
0 coins
Carmen Ruiz
•Yes, you still need to meet all ongoing eligibility requirements including work search while your appeal is pending.

The Washington ESD adjudication process is brutal. They interview you, your employer, and any witnesses. Make sure you have documentation of everything - emails, texts, witness statements, whatever you can get.

•How long does adjudication usually take? I need to know if I should look for temporary work while waiting.

•Mine took 6 weeks but I've heard anywhere from 3-12 weeks depending on complexity and their backlog.

I was disqualified for 'refusing suitable work' when I turned down a job that paid $5/hour less than my previous job. The appeals judge overturned it because the wage was too low compared to my previous earnings.

Yuki Yamamoto
•Good to know! What makes work 'suitable' vs unsuitable?
0 coins
Liam McGuire
•Generally needs to be within your skill level, pay at least 80% of your previous wage after the first 13 weeks, and be within reasonable commuting distance.
0 coins
Jamal Anderson
•That 80% rule only applies after you've been unemployed for 13 weeks. Before that, suitable work can be lower wages as long as it's not unreasonably low.

What about if you get fired for attendance issues? Is that always misconduct?
0 coins
Carmen Ruiz
•Not necessarily. If attendance issues were due to circumstances beyond your control (illness, family emergency, transportation problems), it might not be misconduct.

•My car broke down and I couldn't afford to fix it right away, so I was late a few times. Think that would count as beyond my control?

I tried Claimyr when I couldn't get through to ESD about my disqualification appeal status. Worked great - got connected to an agent in about 20 minutes instead of calling for hours.

Yuki Yamamoto
•Did the agent actually help you or just give you the runaround?

Amara Eze
•She was able to tell me exactly where my appeal stood in the process and what to expect next. Much better than the automated system.

UNEMPLOYMENT SYSTEM IS RIGGED! They find any excuse to deny benefits. I got disqualified for 'insubordination' when I questioned my manager about illegal practices. FIGHT EVERYTHING!

Yuki Yamamoto
•That sounds like whistleblower retaliation. Did you file a complaint with L&I or OSHA too?

Giovanni Ricci
•Filed with everyone I could think of but these government agencies all protect employers over workers.

If you're disqualified, you can still file weekly claims during your appeal. Just don't expect to get paid until the appeal is resolved in your favor.
0 coins
Yuki Yamamoto
•So I should still do the weekly claims even if I'm disqualified? Won't that look bad?
0 coins
NeonNomad
•Yes, you have to continue filing to preserve your right to benefits if your appeal succeeds. It's required.

got disqualified for quitting but then got it overturned because my employer wasn't paying overtime properly. good cause can include illegal employer behavior
0 coins
Yuki Yamamoto
•Did you have to prove the illegal behavior or was your word enough?

Fatima Al-Hashemi
•had to provide paystubs and work schedules showing the unpaid overtime. documentation is key

The able and available requirement trips up a lot of people. You have to be physically and mentally capable of working full-time and actually available to accept work immediately.
0 coins
Yuki Yamamoto
•What if you have a medical condition that limits the type of work you can do?
0 coins
Dylan Mitchell
•You can still qualify if you're able to do some type of work and are actively seeking work within your limitations. May need doctor's documentation.

Another thing that can disqualify you is receiving workers compensation benefits at the same time as unemployment. They offset each other.
0 coins
Yuki Yamamoto
•What about if you're getting workers comp but it's just for medical bills, not lost wages?
0 coins
Sofia Martinez
•Medical-only workers comp usually doesn't affect unemployment eligibility, but wage replacement benefits do.

I'm curious about the false information disqualification. How do they determine if something was intentional vs just a mistake?
0 coins
Carmen Ruiz
•They look at whether a reasonable person would have known the information was incorrect and whether you made an effort to provide accurate information.

•So accidentally reporting wrong dates probably wouldn't be considered fraud?

Claimyr helped me when I needed to talk to someone about my disqualification notice. The agent explained exactly what evidence I needed for my appeal. Definitely worth trying if you can't get through normally.

•I keep seeing people mention this service. Is it really that hard to get through to ESD on your own?

•I tried calling for 3 days straight and never got through. With Claimyr I was talking to someone the same day.

Don't forget about the drug testing disqualification if you're fired for failing a drug test. That's automatic misconduct in most cases.
0 coins
Yuki Yamamoto
•What about medical marijuana? Is that still considered misconduct?
0 coins
CyberSiren
•Even with a medical card, employers can still fire you for testing positive and you'd likely be disqualified. It's still federally illegal.

i got disqualified for being self-employed while collecting benefits. didn't realize you had to report freelance income even if it was just a few dollars
0 coins
Yuki Yamamoto
•How much freelance income triggers a disqualification? Is there a minimum amount?
0 coins
Miguel Alvarez
•any amount has to be reported but they only reduce your benefits if you earn more than your weekly benefit amount

The voluntary quit disqualification has exceptions for domestic violence, sexual harassment, and unsafe working conditions. You need documentation though.
0 coins
Yuki Yamamoto
•What kind of documentation would prove unsafe working conditions?
0 coins
Zainab Yusuf
•OSHA reports, safety complaints to management, photos of hazards, witness statements from coworkers. The more evidence the better.

Connor O'Reilly
Bottom line - even if you get disqualified initially, don't give up. The appeal process exists for a reason and a lot of initial decisions get overturned if you have good evidence.
