Washington ESD unemployment class action lawsuit - how to join?
I've been dealing with Washington ESD for months now and I'm fed up. My claim has been stuck in adjudication since October, I can't get anyone on the phone, and I've lost my apartment because of the delay. I keep hearing about people joining class action lawsuits against Washington ESD for these delays and denials. Does anyone know how to get involved in one of these lawsuits? I have documentation of everything - all my failed call attempts, screenshots of my claim status, emails that went unanswered. I feel like they've violated my rights by not processing claims in a reasonable time frame.

I feel your pain. Been waiting since September myself and can't get through to anyone at Washington ESD either.

•It's ridiculous how they can just ignore us like this. There has to be some legal recourse.

•Have you tried calling first thing in the morning? I know it's hard but sometimes you can get through at 8am sharp.

Class action lawsuits against state agencies like Washington ESD are actually pretty rare and difficult to win. The state has sovereign immunity protections in most cases. You'd need to show they violated specific federal civil rights or due process protections. Most attorneys won't take these cases unless there's clear constitutional violations affecting thousands of people.

•But surely leaving people without income for months while claims sit in limbo has to violate due process somehow?

•It's frustrating but unfortunately delays alone usually aren't enough. The courts generally give state agencies wide discretion on processing times.

•That's so messed up. How can they just ignore their own timeline requirements?

Before you go down the lawsuit route, have you tried using Claimyr? I was in a similar situation - couldn't get through to Washington ESD for weeks, claim stuck in adjudication. Found out about claimyr.com and they actually got me connected to an agent within a day. Cost some money but way cheaper than a lawyer and I got my issue resolved. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows exactly how it works.

•Never heard of that. Is it legit? How much does it cost?

•Yeah it's real. They basically call Washington ESD repeatedly until they get through, then conference you in. I was skeptical too but it actually worked.

•Sounds like a scam to me. Why should we have to pay a third party to reach our own state agency?

I looked into the class action thing too after my claim was denied for job search requirements even though I submitted everything correctly. From what I found, there have been a few lawsuits over the years but most get dismissed or settled for very little money.

•What kind of settlements are we talking about? Even a little money would help at this point.

•Usually just changes to procedures, not individual payouts. And it takes years to resolve.

Have you tried contacting your state representative? Sometimes they can put pressure on Washington ESD to move claims along faster than going through legal channels.

•I actually did email my rep's office last week but haven't heard back yet.

•Keep following up with them. They have direct lines into Washington ESD that regular citizens don't.

•This is good advice. My cousin got her claim moved after her rep's office made some calls.

Washington ESD is just broken. I've been trying to get through for three weeks straight, calling hundreds of times. The system hangs up on you before you even get in the queue half the time.

•Same here. I keep track and I've made over 400 calls in the past month.

•This is exactly why I ended up using Claimyr. I was spending hours every day trying to call and getting nowhere.

If you're serious about legal action, your best bet is probably filing individual appeals through the proper Washington ESD channels first. You have to exhaust administrative remedies before courts will even look at your case. Document everything - call logs, emails, screenshots of your account status.

•I've been documenting everything already. Have spreadsheets of every call attempt with timestamps.

•Good. That's exactly what you'll need if you do decide to pursue legal options later.

•How long do we have to wait before the administrative remedies are considered exhausted?

Check legal aid organizations in Washington. Some of them do take on unemployment cases, especially if there's a pattern of civil rights violations. Won't cost you anything upfront.

•That's a good idea. Do you know any specific organizations I should contact?

•Northwest Justice Project handles some unemployment cases. Columbia Legal Services too.

honestly the whole system is designed to wear you down until you give up. They know most people can't afford lawyers and can't wait months for class actions to resolve

•That's exactly how I feel. Like they're hoping I'll just disappear.

•It's deliberate. Make the process so difficult that people stop trying to claim benefits they're entitled to.

Have you tried the Washington ESD online messaging system? Sometimes that works better than calling.

Anastasia Smirnova
•I've sent probably 10 messages through their secure messaging. Only got one response that was just a form letter.

•Ugh that sucks. The messaging system used to actually work a few years ago.

I used Claimyr last month when my weekly claim got stuck in some weird processing loop. Skeptical at first but they got me through to someone who fixed it in 10 minutes. The agent told me the issue would have taken weeks to resolve through normal channels.

•How much did you pay for that though?

Jamal Thompson
•Rather not say the exact amount but it was way less than I would have lost waiting weeks for my benefits.

•At this point I'm willing to try anything. Going to check out that video link.

What's your adjudication about specifically? Sometimes knowing the exact issue helps figure out the best approach.

Anastasia Smirnova
•It just says 'verification needed' but doesn't specify what kind of verification. I've uploaded my ID, social security card, everything I can think of.

•That's so vague. You really need to talk to someone to find out what specific document they want.

file complaints with the state auditor's office too. They investigate when agencies aren't following their own policies

•Good idea. I'll add that to my list of things to try.

The reality is class actions take years and most of the money goes to lawyers anyway. Your best bet is getting your individual claim resolved ASAP through whatever means necessary.

•Yeah I'm starting to realize that. I need money now, not in 3 years after a lawsuit maybe wins.

•Exactly. Focus on getting your own situation fixed first, then worry about systemic change later.

I actually got connected through Claimyr yesterday and found out my adjudication was because they needed me to verify I was laid off, not quit. Had all the documentation but their system never prompted me for it. Agent cleared it up in 5 minutes and I should get my back pay next week.

•Yeah I was surprised how fast it was once I actually got to talk to someone. The hard part is just getting through.

Keep us updated on what you decide to do. I'm in a similar boat and interested to hear what works.

•Will do. Going to try the Claimyr thing first since several people here had success with it, then pursue other options if that doesn't work.

I'm going through something similar - my claim has been stuck since November and I've lost count of how many times I've called. Reading through all these responses, it sounds like the legal route might not be the fastest solution for getting immediate relief. I'm curious about this Claimyr service that several people mentioned - has anyone else here used it recently? Also wondering if anyone has had luck with the state auditor complaint process that was mentioned. At this point I'm willing to try multiple approaches simultaneously since I can't afford to wait much longer.

•I haven't used Claimyr myself but based on what others are saying here, it seems like it might be worth trying if you're desperate to get through. As for the state auditor route, I filed a complaint about a month ago regarding similar processing delays and got an acknowledgment email, but no real action yet. Have you tried reaching out to multiple state representatives? Sometimes casting a wider net helps - I contacted both my house rep and senator's offices. The key seems to be being persistent with follow-ups since they get tons of requests.

•I used Claimyr about 3 weeks ago when my claim got stuck in identity verification limbo. Was skeptical at first because it felt weird paying someone to call a government agency, but honestly it was worth every penny. They got me connected within about 6 hours and the ESD agent was able to resolve my identity issue immediately - turned out they just needed a clearer photo of my driver's license. The whole call took maybe 15 minutes once connected. Cost me around $40 but considering I was about to lose my car payment, it was a no-brainer. Just make sure you have all your documents ready before they call you back so you can resolve everything in one shot.
