Washington ESD unemployment benefits and bankruptcy - how does it affect my claim?
I'm going through bankruptcy proceedings right now and just lost my job. Can I still file for unemployment benefits with Washington ESD? I'm worried that the bankruptcy trustee might try to take my unemployment payments or that Washington ESD will deny my claim because of my financial situation. Has anyone dealt with this before? I really need these benefits to survive while I'm looking for work.

Your bankruptcy shouldn't affect your eligibility for unemployment benefits at all. Washington ESD determines eligibility based on your work history and reason for separation, not your financial status. File your claim as soon as possible - you can't get benefits for weeks you don't claim.

I went through something similar last year. Filed for unemployment while in Chapter 7 bankruptcy. Washington ESD processed my claim normally and I never had any issues. The trustee knew about the benefits but couldn't touch them because they're protected.

Just want to add that you still have to meet all the regular requirements for unemployment. So you need to be actively looking for work, available for work, etc. The bankruptcy doesn't change any of that.
