Washington ESD denied with relief - what does this mean for my unemployment claim?
Got a determination letter from Washington ESD today saying my claim was 'denied with relief' and I have no idea what this means. I filed my initial claim back in November after getting laid off from my warehouse job in Tacoma. The letter mentions something about a previous employer dispute but doesn't explain what 'with relief' actually means for my benefits. Has anyone seen this status before? I'm really confused and worried about whether I can still collect unemployment or if I need to appeal this decision.

A 'denied with relief' determination usually means Washington ESD initially denied your claim due to an employer protest, but then found you qualify for benefits anyway under different circumstances. It's actually good news - you should be eligible for payments. Check your account to see if benefits are being released.

•That's a relief! I was panicking thinking I wouldn't get anything. My account still shows pending though - should I call them?

•Yes, definitely call to confirm when payments will start. Sometimes there's a processing delay even after a favorable determination.

I had something similar happen last year. My former employer tried to claim I was fired for misconduct but Washington ESD investigated and found I was actually laid off due to lack of work. The 'with relief' part means they're overturning the initial denial and granting you benefits retroactively.

•Did you get backpay for the weeks you were denied? I've been waiting almost 6 weeks now.

Yuki Tanaka
•Yes, I got all my back payments once the determination was finalized. It took about 2 weeks after the letter for everything to process.

•That's encouraging. I'm dealing with a similar employer dispute right now and haven't heard anything in over a month.

If you're having trouble getting through to Washington ESD about this, I recently discovered Claimyr.com which helps you actually reach a real person at the unemployment office. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. I used it last week when I couldn't get answers about my adjudication and finally got my claim resolved.

•How does that work exactly? I've been trying to call for days but just get busy signals or disconnected.

•They basically handle the calling process for you and connect you when they reach an actual agent. Way better than sitting on hold for hours or getting hung up on.

•Is there a cost for this service? Sounds too good to be true.

•There is a fee but honestly it was worth it to finally get my claim sorted out. Much better than losing weeks of benefits.

This is actually a good thing! 'Denied with relief' means your initial claim was denied but you have the right to appeal or there's some form of relief available. It usually happens when there's a technical issue with your filing but you still qualify for benefits.

•Oh thank goodness! I was panicking thinking I wouldn't get anything. Do I need to do anything specific to get the relief part?

•Check your account for any pending actions or appeals you need to file. Sometimes it's automatic but you might need to respond to something.

DENIED WITH RELIEF means you won!! Your employer probably tried to protest your claim saying you quit or were fired for cause, but Washington ESD did their investigation and determined you're eligible for unemployment benefits. This is actually one of the better outcomes you can get.

•Thank you! I was so worried when I saw 'denied' in the letter. Why don't they just say 'approved' instead?

•Government bureaucracy at its finest. They deny the initial protest but grant you relief (benefits). It's confusing wording but the important thing is you qualified.

•This happened to my sister too. She thought she was denied but actually got approved for all her back benefits. Washington ESD really needs to work on their communication.

How long did the whole process take from when you first filed? I'm in adjudication hell right now and my employer is fighting my claim too. Been waiting 8 weeks with no income.

•It was about 6 weeks total from filing to getting this determination. The waiting is the worst part especially when bills are piling up.

•At least you got a decision. I'm still in 'pending adjudication' status with no end in sight.

•Hang in there. Once they make a determination, if it's in your favor you'll get all your back pay. The waiting sucks but it's worth it in the end.

What was your former employer claiming? I'm curious because I might be dealing with something similar soon. My boss has been making threats about fighting my unemployment if I get laid off.

•They claimed I was terminated for attendance issues but it was actually a reduction in force. I had documentation showing other people were laid off too which helped my case.

Congrats on the good news! Make sure you keep filing your weekly claims even if payments haven't started yet. You don't want to lose any weeks while this gets processed.

•Yes I've been filing every week even though I wasn't getting paid. Good thing because now I should get backpay for all those weeks.

•Exactly! So many people stop filing when they're in adjudication and then lose out on benefits they were entitled to.

washington esd determinations are so confusing... why cant they just say APPROVED in big letters instead of all this legal jargon nobody understands

I had the same status last year and it was because I had some issue with my work history verification. The 'relief' meant they were going to review it again once I provided more documentation. Check if you have any outstanding requests for information.

I work in HR and see these determinations fairly often. 'Denied with relief' typically means the initial protest was denied (which is good for you) and you're granted relief in the form of unemployment benefits. Your employer's challenge was unsuccessful.
0 coins
Amara Okafor
•That makes sense. Do you know if employers get penalized for filing false protests against unemployment claims?
0 coins
Tyrone Johnson
•Not really penalized per se, but if they have a pattern of unsuccessful protests it can affect their unemployment tax rates. Most legitimate employers only protest when they have valid grounds.
0 coins
Ingrid Larsson
•Some employers just protest everything hoping to save money on their unemployment taxes. It's frustrating for people who legitimately qualify for benefits.

Been through this exact situation. The key thing is that 'with relief' means you get benefits. I'd recommend calling Washington ESD to confirm when payments will start and if you need to do anything else. When I couldn't get through on the phone, I used Claimyr and they connected me with an agent who explained everything clearly.

The Washington ESD system is so confusing with all these different statuses. I've been dealing with adjudication for weeks and still don't understand half of what they're telling me. At least your status sounds more promising than mine!

denied with relief usually means there's an automatic appeal process happening or they're reviewing additional information. Don't panic - it's not a final denial.

I work in HR and see this status sometimes when employees file claims. It often happens when there's a discrepancy between what the employer reported and what the claimant filed. The relief part means they'll sort it out once they get the right information.
0 coins
NeonNomad
•That makes sense! My former employer was pretty disorganized so they might have reported something wrong.

Zainab Yusuf
•Employers mess up the reporting all the time. I had to correct my separation reason because they said I quit when I was actually laid off.

Check your monetary determination too. Sometimes the denial is about the benefit amount calculation but the relief means you'll still get benefits once they recalculate.
0 coins
NeonNomad
•I did notice my benefit amount looked lower than I expected. Maybe that's related?

Connor O'Reilly
•Exactly! If they used the wrong wage information initially, they'll fix it and backpay you for any difference.

Make sure you check your payment history in your Washington ESD account. Sometimes the benefits get released before they send the determination letter. I got three weeks of back pay deposited before I even knew I was approved.

Question - did you have to provide any additional documentation during the adjudication process? I'm worried about what I might need if my employer protests my claim.

For anyone dealing with adjudication delays, I found that Claimyr.com really helps get answers faster. Just wanted to add that if you disagree with any part of the determination, even a favorable one, you have 30 days to appeal. But in your case with 'denied with relief' you're getting benefits so no need to appeal anything.

Amara Okafor
•Good to know about the appeal timeframe. I'm definitely not appealing since this works out in my favor!

Congrats on getting a favorable determination! I went through something similar last year and the whole process was so stressful. The wording on these letters is absolutely terrible - I remember panicking when I saw "denied" even though it was actually good news. Make sure to keep filing your weekly claims while you wait for the payments to start processing. In my case, it took about 10 business days after getting the determination letter for the first payment to hit my account, and then I got all the back pay for the weeks I'd been waiting. The relief you'll feel when you see those deposits is amazing after all that uncertainty!
