Washington ESD denied my unemployment claim - need help when appealing unemployment benefits denial
My unemployment claim was denied by Washington ESD last week and I'm lost on what to do next. The denial letter says I was 'discharged for misconduct' but I was actually laid off due to company restructuring. I have documentation from HR showing it was a reduction in workforce, not misconduct. The appeal deadline is coming up fast and I don't know how to properly fight this. Has anyone successfully appealed a misconduct denial? What evidence did you submit and how long did it take?

You absolutely need to appeal this ASAP! The appeal window is only 30 days from the date on your denial notice. Gather all your documentation - the HR paperwork, any emails about layoffs, witness statements if you have them. The key is proving the separation wasn't due to misconduct on your part.

•Thank you! Do I need to submit all the evidence with the initial appeal or can I bring it to the hearing?

•Submit what you have with the appeal, but you can also present additional evidence at the hearing. The more documentation you provide upfront, the stronger your case.

Same thing happened to me - got denied for 'misconduct' when I was actually terminated for attendance issues due to a medical condition. The appeal process is no joke, you need to be prepared.

•Did you win your appeal? What was the timeline like?

Alice Fleming
•Yes, but it took 3 months total. Had to go through a phone hearing with an administrative law judge. Make sure you have all your ducks in a row.

If you're having trouble reaching Washington ESD to discuss your appeal options, I found this service called Claimyr that actually gets you through to speak with an agent. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Might be worth checking out since their phone lines are always jammed.

•Is this legitimate? I've been trying to call for days with no luck.

•Yeah it's real - claimyr.com. I used it when I needed to clarify some adjudication issues. Way better than spending hours on hold.

•Interesting, never heard of this but definitely beats the endless busy signals from Washington ESD.

The whole system is rigged against us. They'll find any excuse to deny claims and make you jump through hoops to get what you're entitled to. Washington ESD rubber stamps these denials without really investigating.

•While I understand the frustration, appeals do work if you have proper documentation. The system isn't perfect but it's not completely stacked against claimants.

•Easy to say when you haven't been fighting them for months over an obvious error.

For your appeal, make sure you clearly state that the separation was due to lack of work, not misconduct. Include dates, names of supervisors, and any company-wide communications about layoffs. The burden is on Washington ESD to prove misconduct occurred.

•Should I get a statement from my former supervisor? She was the one who told me about the restructuring.

Steven Adams
•Absolutely! A statement from your supervisor explaining the business reasons for the layoff would be very helpful.

When filing your appeal, be very specific about why the determination is wrong. Don't just say 'I disagree' - explain exactly what happened and provide timeline of events. The more detailed and factual your appeal, the better your chances.

•Good point. I'll write out a timeline of everything that happened leading up to my termination.

•Also make sure you understand what constitutes misconduct under Washington law. Being laid off definitely isn't misconduct.

The appeal hearing will be by phone usually. Make sure you have all your documents organized and ready to reference. The judge will ask questions and you want to sound prepared and professional.

•Are employers usually represented at these hearings?

•Sometimes, depends on the company. Larger companies often send someone, smaller ones might not. Either way, stick to the facts.

Just want to add that even if you lose the initial appeal, you can request a review by the Board of Appeals. Don't give up if the first level doesn't go your way.

Grace Durand
•How many levels of appeal are there?
0 coins
Alice Fleming
•Three total - initial determination, administrative law judge appeal, then Board of Appeals review. Most cases get resolved at the ALJ level though.

This is why I always document everything at work. You never know when you'll need it for something like this.

•I wish I had been better about that. Learning for next time I guess.

Just to follow up on the Claimyr thing - I've used it twice now when I needed to actually talk to someone at Washington ESD about complex issues. Much easier than the regular phone system and you actually get through to a human who can help.

•How does it work exactly? Do you still call the regular Washington ESD number?

Hassan Khoury
•No, you go through their system at claimyr.com and they connect you. Takes the hassle out of dealing with busy signals and long hold times.

Make sure you file your appeal before the deadline! I know someone who missed it by one day and had to start all over with a new claim. Washington ESD is strict about those dates.

•Yeah, I'm planning to submit it this week. Thanks for the reminder!

One more tip - if you had any performance reviews or commendations from your employer, include those too. It helps show you weren't terminated for misconduct if you had good performance ratings.

Grace Durand
•Great idea! I actually got a good performance review just two months before the layoff.

Samantha Howard
•Perfect! That's exactly the kind of evidence that helps your case.

The waiting is the worst part. Even when you win the appeal, it takes so long to get your benefits started. Hope you have some savings to get by.

•That's what I'm worried about. Bills don't stop coming while you're fighting this.

•If you win, they'll pay you retroactively for the weeks you were denied. Small consolation but at least you don't lose that money completely.

Don't let them intimidate you during the hearing. Stick to your story and present your evidence clearly. The judges are supposed to be neutral arbiters.

•Any other tips for the actual hearing?

•Be concise, answer questions directly, and don't get emotional even if the employer says things that aren't true. Let your documentation speak for itself.

washington esd is a mess right now anyway, they're making mistakes left and right with these determinations

•True, but that's all the more reason to appeal when you know they got it wrong.

I went through this exact situation last year. Had all my paperwork ready, employer didn't even show up to the hearing, and I won easily. Sometimes these things work out better than expected. Stay positive!

The whole misconduct thing is way overused by Washington ESD. Half the time they don't even understand what actually happened. Good luck with your appeal!

One last thing - if you do need to speak with Washington ESD about your appeal status or have questions, that Claimyr service I mentioned earlier really does work. Saved me hours of frustration trying to get through their regular lines.
