How to fight unemployment denial - Washington ESD appeal process help needed
My Washington ESD unemployment claim was denied last week and I'm completely lost on how to fight this decision. The denial letter says I was terminated for 'misconduct' but that's not what happened at all. I was let go because my position was eliminated due to budget cuts. How do I appeal this and what evidence do I need to gather? The letter mentions I have 30 days but doesn't explain the actual process clearly. Has anyone successfully fought a denial like this?

You absolutely can and should appeal this! The 30-day deadline is critical so don't wait. You'll need to file your appeal through your SecureAccess Washington account or mail it to the address on your denial letter. Gather any documentation showing your termination was due to position elimination - emails, layoff notices, anything proving it wasn't misconduct.

•Thank you! Do I need to keep filing weekly claims while the appeal is processing?

•Yes, absolutely keep filing your weekly claims even during the appeal. If you win the appeal, you'll get backpay for those weeks. If you don't file, you won't get paid for those weeks even if you win.

I went through this exact same thing 6 months ago. Washington ESD initially denied my claim saying I quit voluntarily when I was actually laid off. The appeal process took about 8 weeks but I eventually won and got all my back benefits.

•That gives me hope! What kind of evidence did you submit with your appeal?

•I submitted my termination letter, emails from HR about the layoffs, and a statement from my supervisor. The key was proving the company's version of events was wrong.

If you're having trouble reaching Washington ESD to ask questions about your appeal, I found this service called Claimyr that helped me get through to an actual agent. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. It was way easier than spending hours on hold.

•How much does something like that cost? I'm already stressed about money.

•It's worth checking out their site for details. For me it was much less stressful than the endless calling and getting disconnected. Plus I actually got answers about my appeal timeline.

•I've never heard of paying someone to make calls for you. Seems sketchy to me.

The Washington ESD appeal process is actually pretty straightforward once you understand it. You'll get a phone hearing scheduled where you can present your case to an administrative law judge. Make sure you have all your documents organized and be prepared to explain exactly what happened.

•Do I need a lawyer for the hearing or can I represent myself?
0 coins
StarStrider
•You can represent yourself. Most people do. Just be honest, stick to the facts, and have your documentation ready. The judges are used to dealing with regular people, not just lawyers.

UGH the same thing happened to me!! They said I was fired for poor performance when really my whole department got laid off. It's like they just make stuff up sometimes. I'm so frustrated with Washington ESD right now.

•Did you appeal it? I'm hoping this isn't a lost cause.

•Yeah I'm in the middle of appealing right now. It's been 3 weeks since I filed the appeal and haven't heard anything yet. The waiting is killing me.

Make sure you check the reason code on your denial letter. Different codes require different types of evidence. If it's a misconduct denial, you need to prove you didn't do anything wrong. If it's a voluntary quit, you need to prove you were actually terminated.

Chloe Martin
•The code says 'discharged for misconduct connected with work' but I wasn't fired for doing anything wrong.

•Then your appeal should focus on proving the termination was due to business reasons (layoff, position elimination) not your conduct. Get documentation from your employer if possible.

Just wanted to follow up on the Claimyr thing I mentioned earlier - I used them again last week to check on someone else's appeal status and they got me through to an ESD agent in about 20 minutes. Way better than the 2+ hours I usually spend trying to call.

•OK I'm curious about this now. Is it legit? Like do they actually get you to real Washington ESD people?

Sean O'Donnell
•Yeah they connect you to the same agents you'd talk to if you called yourself. They just handle the waiting and getting through the phone system for you.

UPDATE: I filed my appeal yesterday through SecureAccess Washington and got a confirmation number. Now I'm gathering all my documentation. Thank you everyone for the advice - feeling much more confident about fighting this now!

•Great job getting it filed quickly! Make copies of everything you submit and keep detailed records of all communications.

•You've got this! The fact that you know it was really a layoff and have documentation puts you in a strong position.

I won my appeal last year but it took forever. Be prepared for a long process - mine took 12 weeks from filing to getting the hearing scheduled. But I got all my back benefits so it was worth the wait.

Chloe Martin
•12 weeks?? How did you survive financially during that time?

Aisha Abdullah
•It was rough honestly. Had to borrow money from family and pick up some gig work. But when I won I got a big lump sum payment for all the weeks I was waiting.

Pro tip: when you get your hearing scheduled, make sure you test the phone number they give you ahead of time. I almost missed my hearing because the number they sent me was wrong!

•Good to know! I'll definitely test everything once I get my hearing notice.

•Yes, always test the tech stuff ahead of time. And have a backup phone number ready just in case.

Does anyone know if you can submit additional evidence after you file the appeal but before the hearing?
0 coins
Diego Rojas
•Yes you can usually submit additional documents up until a few days before the hearing. Check with the appeals office for their specific deadline.

Chloe Martin
•That's helpful because I'm still trying to get a letter from my old supervisor confirming the layoffs.

The key thing is don't give up! I know it seems overwhelming but Washington ESD makes mistakes all the time. If you were really laid off and not fired for misconduct, you have a good chance of winning your appeal.

•Thank you for the encouragement! Some days I wonder if it's worth the hassle but I really need those benefits.

•It's absolutely worth it. You paid into the system and you deserve benefits if you're eligible. Don't let them intimidate you out of what's rightfully yours.

I tried calling Washington ESD about my appeal status last month and that Claimyr service someone mentioned actually worked. Got through to an agent who explained the whole timeline to me. Much better than the usual runaround.

•I might try that if I need to call them about my appeal. The regular phone system is impossible.

•I still think it's weird to pay someone to make phone calls but if it works I guess...

Make sure you understand the difference between the first level appeal (reconsideration) and the second level (hearing). Some people think they only get one chance but there are actually multiple levels if needed.
0 coins
Chloe Martin
•I didn't know there were multiple levels! So if I lose the first appeal I can try again?
0 coins
Andre Laurent
•Yes, if you lose at the first level you can appeal to the Board of Appeals. But hopefully you'll win at the first level and won't need to worry about that.

been there done that, won my appeal after 10 weeks, got $4800 in back pay. totally worth fighting it if you know you're right

•Wow $4800! That definitely makes the hassle worth it. Gives me motivation to stick with this.

•yeah dont let them steal your benefits. i had all my paperwork ready and the hearing was only 15 minutes

The Washington ESD appeal system is so broken. They deny legitimate claims all the time hoping people won't fight it. It's basically a way to save money by discouraging people from getting benefits they deserve.
0 coins
Chloe Martin
•That's exactly what it feels like! Like they're hoping I'll just give up and go away.

Sophia Nguyen
•While the system has problems, many appeals are successful when people have good documentation. Don't let frustration stop you from fighting a legitimate claim.

One more tip - when you get to your hearing, speak slowly and clearly. The judge has to take notes on everything you say so give them time to write it down. Don't rush through your explanation.

Chloe Martin
•Great advice! I tend to talk fast when I'm nervous so I'll definitely keep that in mind.

•Yes, and pause between main points. The judges appreciate when people are organized and easy to follow.
