Requalified for ESD by working for Instacart but still showing Disqualified - what's the problem?
Incredibly frustrated with my ESD claim right now. I got disqualified back in September and lost my appeal. ESD told me I needed to earn 7x my weekly benefit amount to requalify, so I've been hustling with Instacart for months. Finally earned enough and waited the required 7 weeks. Today (Feb 2nd) was supposed to be my first week to restart my claim according to an ESD rep I spoke with earlier - she confirmed I earned enough to requalify. But when I logged in to restart my claim today, it STILL says Disqualified! What am I missing here? Has anyone gone through the requalification process successfully? Do I need to file a whole new claim instead of restarting my existing one? Really need this figured out ASAP since I've been waiting months already.

You probably need to file a NEW claim, not restart the old one. That's what happened to me after disqualification. The system is terrible at explaining this. Try filing a completely new application and see if that works.

The confusion here is between "restarting" and "requalifying" - they sound similar but are totally different processes in the ESD system. Restarting is when you temporarily stopped filing weekly claims but were still eligible. Requalification after disqualification usually requires a new application because your previous claim has a permanent disqualification flag on it. Since you earned your 7x amount, you should be eligible, but you need to file a new claim entirely. Your previous claim is permanently marked as disqualified.

Been there done that!!! went thru the EXACT same thing last year. its so confusing! the rep probly meant restart as in get benefits again but what you actually have to do is a whole new claim. the old one is toast once u get that disqualified status. good luck

I had a similar issue and couldn't get a straight answer for WEEKS. Finally got through to someone at ESD who actually knew what they were talking about (took like 20+ calls). They said after a disqualification and requalifying with earnings, you 100% need to file a new claim. The old claim can never be "restarted" once disqualified. On the bright side, if you've already earned 7x your benefit amount and waited the 7 weeks, you should be good to go once you file the new claim.

•HOW did you manage to get through to anyone on the phone at ESD?! I've been trying for literally two weeks and either get hung up on or sit on hold until they close for the day. It's absolutely ridiculous how impossible it is to talk to a human being there.

After helping dozens of people with this exact issue, I can clarify: When you're disqualified and earn your way back to eligibility, you must file a completely new UI claim. The rep you spoke with unfortunately gave you incorrect information. The good news is that since you've already done the work (earning 7x your WBA and waiting 7 weeks), you should be eligible immediately once you file the new claim. Just make sure to have all your Instacart income documentation ready when you apply. not to derail this but does anyone know if instacart counts as "suitable work" for ESD purposes? i got offered a job there but wasnt sure if turning it down would affect my benefits

•That's actually a different topic entirely, but quickly: independent contractor work like Instacart is treated differently than traditional employment for suitable work determinations. You should call ESD before turning down any work offer to understand how it might impact your specific claim.

UPDATE: I filed a completely new claim last night and it's now showing as processing instead of disqualified! Looks like you all were right - needed a new claim, not a restart. Thanks everyone for the help. Will update again once I know if it's approved.
