OAH denied my appeal despite employer contradictions - How to appeal higher?

I'm in total disbelief right now. After a 15-week nightmare with ESD, I just lost my OAH hearing even though I thought it was a slam dunk case. Here's what happened: I filed for UI benefits back in February after being let go. ESD initially flagged my identity for verification (sent in my driver's license, SS card, etc). Got approved after that hurdle, but then boom - denied during adjudication before I could get a single payment. I appealed immediately and FINALLY got my OAH hearing last week after filing weekly claims for nearly 4 months. During the hearing, my former employer contradicted themselves multiple times about the reason for separation. They literally gave different stories to ESD versus what they testified! I had documentation backing up my side completely. Just got the decision yesterday - DENIED. The judge "affirmed" ESD's decision. I honestly can't believe it. I feel like I'm in some alternate universe where facts don't matter? I'm now 4+ months behind on rent, car payment, utilities... everything. I desperately need to appeal this higher. Does anyone know: 1. How to appeal an OAH decision? 2. What's the success rate of these higher appeals? 3. How long does the next appeal process take? I'm completely broke and about to be evicted. Any advice from someone who's successfully appealed beyond OAH would be incredibly helpful.

I'm sorry you're going through this. You can appeal an OAH decision to the Commissioner's Review Office within 30 days of the OAH decision date. This is called a Petition for Review. You'll need to submit a written statement explaining why you believe the judge's decision was incorrect, specifically addressing legal errors or misinterpretation of facts. If the Commissioner's Review doesn't go your way, you can then appeal to Superior Court, but that's a much more formal legal process. I went thru something similar in January!! My employer totally lied about why I was fired and the judge still sided with them even tho they had NO EVIDENCE. Had to appeal to Commissioner and WON!! The key is focusing on where the judge messed up legally, not just saying it's unfair. While your waiting on the appeal decision u should call ESD directly to see if they can expedite anything cuz of financial hardship. Good luck!!!

It took about 7 weeks for my decision, but that was during a super busy time. I focused my appeal on how the judge ignored specific testimony that contradicted my employer's claims. I quoted the transcript a bunch and pointed out where employer gave different stories to ESD vs the hearing. Also mentioned the relevant WACs about burden of proof for misconduct cases. BTW good luck getting through to ESD on the phone... I spent like 6 hours on hold and never got through.

Speaking of calling ESD - if you're having trouble getting through, I'd recommend trying Claimyr (claimyr.com). Had to use them myself when my claim got stuck in adjudication for weeks. THEY DO THIS ALL THE TIME!!!! The system is RIGGED against workers! My friend's cousin had the EXACT same thing happen and they got rejected too even though they had PROOF the employer was lying!!! The OAH judges are all in the pocket of big business, they don't care about regular people at ALL!!!

The Commissioner level actually overturns quite a few OAH decisions. They're much more thorough in reviewing the evidence and legal standards. OP should definitely appeal and focus on specifics. Thanks everyone for the advice. I've found the appeal instructions in my decision letter and am working on my Petition for Review now. I've identified at least three places where the judge completely mischaracterized my testimony and ignored documented evidence that contradicted my employer's claims. I'm also going to try to get through to ESD to explain my financial hardship situation. Does anyone know if there's any emergency assistance available while waiting for the Commissioner Review? I'm literally about to be evicted and my car is at risk of repossession.

While you're working through the appeal, you should also look into emergency assistance programs: 1. Contact your local DSHS office about emergency cash assistance programs 2. Apply for LIHEAP for utility help 3. Reach out to local community action agencies - many have rental assistance funds 4. Call 211 for referrals to other emergency resources in your area Also, keep filing your weekly claims even during the appeal process. If you win your appeal, you'll be paid for all eligible weeks you claimed during the appeal period. Missing even one weekly claim could cost you benefits for that week even if you ultimately win.

hey so ur supposed to get a copy of the hearing recording for free. did u ask for that? u can use it to show exactly where the employer contradicted themselves. also make sure u mail ur appeal CERTIFIED so they cant claim they didnt get it. thats what happened to my bro and he had to start all over!!

This is excellent advice. You can request the audio recording through OAH's customer service. Having the exact quotes from the hearing will strengthen your appeal significantly. The Commissioner's office puts a lot of weight on inconsistencies in testimony that the OAH judge might have overlooked. And definitely send your appeal via certified mail with return receipt requested. The 30-day deadline is strictly enforced, and you need proof of when you submitted it.

Not trying to be negative but my cousin went through all this last year and still lost at the Commissioner level too. Just prepare yourself that you might need to look for other income options. The whole system is designed to deny people benefits its so frustrating!!!

That's good advice, thank you. I've been diligently doing my 3 job search activities every week and logging them, even though it feels pointless sometimes with the claim denied. I really hope this pays off in the end when I win the appeal.
