OAH appeal hearing document submission - how to send to other parties?

I've got an unemployment appeal hearing scheduled with OAH on the 27th of next month. The hearing notice says I need to submit any evidence/documents to 'all parties' before the hearing date. I've already uploaded my documentation to the OAH portal for my case, but I'm confused about how I'm supposed to send these documents to the other participants. There's no contact info for ESD's representative or anyone else on the notice. Am I missing something obvious? Has anyone gone through this process recently who can tell me what I need to do to make sure I'm in compliance? I really don't want to mess this up and have my evidence dismissed because I didn't follow proper procedure.

You need to send copies of your evidence to ESD directly. There should be contact information on your Notice of Hearing - look for the ESD Appeals Office address, fax number, and email. If you don't see it, call OAH and ask them for the correct contact. Usually, you can email your evidence to the ESD appeals representative handling your case. Make sure to include your case number in all communications and keep proof that you sent the documents (delivery/read receipts, fax confirmation, etc.). And do this ASAP - you need to give them at least 7 calendar days before the hearing date.

Thank you! I found an email address for the ESD Appeals Office buried in the fine print of page 2. I'll send everything to them right away and request a read receipt. Do I also need to send copies to the Administrative Law Judge or is uploading to the portal sufficient for that?

It's really up to the judge's discretion. Some ALJs are lenient about the rules, but others will strictly enforce them. Better to follow the proper procedures than risk having your evidence excluded.

OMG the ESD appeals process is THE WORST!!! I went through this in February and it was a complete nightmare. They make everything confusing on purpose I swear! My hearing notice had different instructions than the OAH website and when I called to clarify nobody could give me a straight answer. Then the ESD rep showed up with a bunch of documents I'd never seen before and I felt totally ambushed. The system is RIGGED against claimants!!

It's definitely frustrating, but there is a process to object to new evidence at the hearing if you haven't seen it before. Did you win your appeal despite those challenges?

Nope, I lost because I couldn't respond properly to their surprise documents. Still bitter about it.

Here's what you need to do step by step: 1. Find the ESD Appeals Office contact info on your hearing notice (usually page 2) 2. Send all your documents to that email/address/fax with your case number clearly marked 3. Include a cover letter listing each document you're submitting 4. Request confirmation of receipt 5. Keep copies of EVERYTHING, including proof you sent it 6. Make sure to do this at least 7 days before your hearing date For the OAH portal upload - yes, that's sufficient for the judge, you don't need to send separate copies to the ALJ. Also, prepare a brief statement explaining why each document is relevant to your case. This will help both you and the judge during the hearing.

This is incredibly helpful, thank you! I just sent everything to the ESD Appeals email with a cover letter as you suggested. One more question - should I have my own copies of all documents ready during the phone hearing? Or will the judge and ESD rep already have them pulled up?

Definitely have your own copies ready and organized for the hearing! Even though everyone should have them, you want to be able to quickly reference specific pages when making your case. Number your pages and have notes about what points you want to make with each document.

i had similar confusion with my hearing back in january and i couldn't get through to anyone at esd for days. finally tried Claimyr (claimyr.com) and they got me connected to an actual person at esd appeals within like 20 minutes. they have this demo video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 i was skeptical but it saved me so much stress. the esd person confirmed exactly where to send my documents and even gave me the direct email address for the appeals specialist handling my case.

Does that service actually work? I've been trying to reach someone at ESD for weeks about a separate issue.

yeah it really does! saved me hours of redial hell. they just basically hold your place in line and call you when they have someone from esd on the phone.

UPDATE: I called OAH this morning and got some clarification. The representative told me that uploading to the portal IS sufficient for the judge, but I still needed to send everything to ESD separately. She gave me the specific email address for appeals submissions and confirmed I should include my case number in the subject line. Thanks everyone for your help! Feeling much better about this now.

Great to hear! Make sure you're well prepared for the actual hearing too. Have all your facts organized chronologically, be ready to explain why you believe ESD's determination was incorrect, and stay calm and professional during the hearing. The ALJ will appreciate a clear, factual presentation.

Will do. I've written out my main points and practiced explaining my situation clearly. Hopefully it goes well!

One thing nobody has mentioned yet - if the other party (usually ESD) submits new evidence at the last minute that you haven't seen before, you can ask the judge for a continuance to give you time to review the documents. Just say "Your honor, I haven't had an opportunity to review these documents and request time to do so before proceeding." Most judges will grant this reasonable request. Good luck with your hearing!
