First-time ESD appeal hearing next week - what should I expect?
I just received my notice of hearing from OAH for my ESD appeal next Thursday. I got disqualified for 'quitting without good cause' even though I explained I had to relocate because my spouse got transferred. Now I'm freaking out about this hearing - I've never done anything like this before! Has anyone gone through the ESD appeal process? What was it like? Do I need a lawyer? The packet they sent is like 20 pages long and I'm totally overwhelmed. Any advice would be so appreciated!

I went through an appeal hearing last year and it wasn't as scary as I thought. Mine was a phone hearing and lasted about 45 minutes. The judge was actually pretty nice. You'll need to prepare your evidence ahead of time - anything that proves you had to relocate with your spouse. If you have an official transfer letter from their employer, that would be perfect. You definitely don't need a lawyer for this - I won my case representing myself. Just stick to the facts and be honest. Good luck!

ESD APPEALS ARE A JOKE!!! I got denied even with TONS of evidence. Judge didn't even look at half my documents and sided with ESD immediately. The whole system is rigged against claimants!!! Don't expect fairness because you won't get it!!

I help people prepare for unemployment hearings as part of my job. For a 'quit due to spouse relocation' case, you need specific documentation. Washington recognizes this as good cause IF you can prove: 1. Your spouse's job transfer was mandatory (not voluntary) 2. The distance makes commuting unreasonable 3. You made reasonable efforts to find work in the new location Bring documentation for all three points. Submit your evidence 3 business days before the hearing. And very important - be on time for the call! They'll dismiss your case if you're late.

•This is extremely helpful, thank you! My spouse's transfer was mandatory (I have the letter) and we moved 200 miles away, so the commute thing should be obvious. I did apply for 5-6 jobs before leaving but I'm not sure I have documentation. Will that hurt my case?

my hearing was back in january i think. kinda nerve-wracking but turned out ok. just answer questions directly and don't go off on tangents. the judge kept interrupting me when i tried to explain extra stuff lol. oh and my hearing got delayed twice which was super annoying so be prepared for that possibility too

When I had my ESD appeal last month, I couldn't get through to anyone at ESD to ask questions about the process. Kept calling and getting disconnected. Finally used this service called Claimyr that got me connected to an ESD agent in about 20 minutes (claimyr.com). i had my appeal in Feb. make sure ur phone has good reception cuz i got disconnected during mine and almost missed half the hearing! so stressful. also the judge asked me questions about dates of when i quit and when spouse got transfer notice etc so have all those dates ready. they are super specific.

One more thing - since you mentioned relocating for a spouse's job transfer, make sure you understand the exact legal standard for that exception. Under WAC 192-150-120, it's considered good cause to quit if your spouse's employer required the transfer, it's outside your normal commuting area, and you stayed employed as long as was reasonable prior to the move. Focus your testimony on these specific elements and you'll have a much better chance of success.

By the way, don't forget to check your mail/email obsessively after the hearing. I kept checking the ESD website for my decision, but it actually came by regular mail about 10 days later. The judge didn't tell me the decision during the hearing - apparently they almost never do. Good luck with everything and let us know how it goes!
