Need advice: Can we collect back pay after winning ESD appeal for expired claim?

After months of fighting, I finally won my ESD appeal yesterday! The judge reversed most of their decision and found I didn't commit fraud (thank god). Here's my situation - I was disqualified from March-September 2025 because I accidentally reported something wrong on a few claims. The judge ruled I should only be disqualified for those specific weeks I made mistakes on, not the entire period. Here's my question: my benefit year for that claim is now expired, but can I still collect the back payments for all those weeks I was wrongfully disqualified? We're desperate for that money. I work in construction (electrical union) and was just laid off AGAIN last week due to project cancellations. Had to file a completely new claim yesterday. The timing couldn't be worse - we're already 3 months behind on our mortgage from all the previous gaps in employment, and I'm worried this new claim will take forever to process while we sink deeper into debt. Has anyone successfully gotten back payments after winning an appeal on an expired claim? Do I need to submit something special to ESD?

Congratulations on winning your appeal! Yes, you can absolutely get backpay on an expired claim after a successful appeal. I went through something similar last year. Here's what you need to do: 1. Contact ESD ASAP and inform them about your successful appeal. Reference your OAH case number. 2. You'll likely need to submit a form requesting payment for the wrongfully disqualified weeks. 3. Keep copies of your appeal decision and submit it with your request. It took about 3-4 weeks for me to get paid after my appeal was decided. The expired benefit year doesn't matter in this case since the appeal establishes that you were eligible during the contested period. Keep in mind they'll deduct any weeks where the disqualification was upheld by the judge.

Thank you so much for this info! Do you know specifically which form I need to request the backpay? The ESD website is so confusing and I can't find anything about this situation. Did they automatically pay you or did you have to keep pushing?

DON'T GET YOUR HOPES UP!!! ESD is THE WORST about honoring appeal decisions. I won my appeal back in January and I'm STILL fighting to get my backpay. Every time I call, they say "it's in processing" or "escalated to a specialist" but NOTHING HAPPENS. The system is rigged against workers!!!! They're hoping you'll just give up and go away. Keep calling EVERYDAY until you get someone who actually helps. Document EVERYTHING - who you talked to, date/time, what they promised. The left hand never knows what the right is doing in that department.

Have you tried using Claimyr to reach an ESD agent directly? I was in a similar position last month trying to get my backpay after winning my appeal and couldn't get through the regular phone lines. Used Claimyr (claimyr.com) and got connected to an agent in under 30 minutes. They helped me file the right paperwork to get my backpay processed. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 It saved me hours of frustration and busy signals. The ESD agent I spoke with was able to see my appeal decision and start the backpay process immediately.

I've never heard of this service before. Does it actually work? I've spent hours trying to get through on the regular ESD line with no luck.

Yes, it definitely worked for me. Saved me days of frustration. The best part was I got to speak with an actual ESD specialist who could see my claim history and appeal decision right away.

Since your benefit year expired, you'll need to speak directly with an ESD agent to request what's called a "Retrodetermination Payment" for the weeks covered by the appeal decision. This isn't something you can do through the online portal. Make sure you have your appeal decision document ready when you call, specifically the part that states which weeks you should be eligible for. Also have your social security number, claim ID, and the specific weeks you're requesting payment for written down. From my experience working with several clients in similar situations, ESD will typically process these payments within 2-4 weeks once properly requested. Don't be surprised if the first agent you speak with isn't familiar with the process - you might need to ask for a tier 2 specialist or someone in the appeals unit.

Thank you for this detailed information! Is there a specific department I should ask for when I call? And will this affect my new claim that I just filed last week?

Ask for the "Appeals Resolution Unit" or a "Claims Specialist familiar with post-appeal payments." And no, your new claim is completely separate - the back payments would come from your previous claim period. Your new claim should process normally regardless of getting these back payments.

my husbands in construciton too and its been awful this year!!! so many projects cancelled. hope you get your backpay but from what weve seen it takes foreeeever. we won our appeal in april and still waiting on about half the payments. they did some but keep saying theres "technical issues" with the rest lol sure....just make sure you file ur weekly claims on the new claim while your waiting for the old one!!

Ugh, the construction industry has been brutal lately! Sending good thoughts your way too. And yes, definitely keeping up with the weekly claims on this new one!

I successfully received backpay after winning an appeal on an expired claim in January 2025. Here's exactly what worked for me: 1. Call ESD and inform them of your successful appeal (have your OAH case # ready) 2. Request to speak with someone in the "Appeals Processing Unit" specifically 3. Ask them to process a "retroactive payment adjustment" based on the judge's decision 4. Follow up with an email to the appeals unit with your judge's decision attached 5. Keep calling weekly for status updates It took about 5 weeks total from my appeal win to receiving the payments. They came in several batches, not all at once. Make sure you check your account daily as they don't always notify you when payments are issued. Good luck with your new claim too - you might want to request expedited processing given your financial hardship. They can sometimes prioritize claims when there's risk of eviction or utility shutoff.

appeals processing unit is closed now. they merged it with claims center last month. i tried calling them and got transferred to general queue. typical esd constantly changing things without telling anyone lol

Thanks for the update! That's frustrating but not surprising. In that case, when you call the main claims center, specifically ask for someone who handles "post-appeal payment processing" or "retroactive payments following OAH decisions." Using those specific terms might help get to the right person.

congrats on winning!!! honestly dealing with esd is like banging your head against a wall. i was in the same boat last yr and finally got my money but took almost 3 months after the judge ruled in my favor. you have to be super persistent and call like everyday. good luck with ur new claim too!

Thanks! That seems to be the consensus - just keep calling and being persistent. Hearing others have eventually gotten their backpay gives me some hope at least.

Quick update on the process since I just helped my brother-in-law through this exact situation last month: Call 833-572-8400, choose the option for questions about an existing claim, then when asked about your specific issue, say "appeal decision payments." This should route you to the right department faster. Have your appeal decision handy - specifically the part listing which weeks you should be eligible for. They'll ask for the OAH docket number (starts with "OAH" followed by numbers) from the top right of your decision letter. The system has improved somewhat since 2024. Back payments after appeals now take about 3-4 weeks instead of 2-3 months like before. Just make sure you're very clear that you're requesting payment for weeks that were approved in your OAH decision, not regular weekly benefits.

This is extremely helpful! I'll try this specific number and routing option tomorrow. I have my decision letter ready with all the information. Fingers crossed I get someone knowledgeable on the first try!
