If you get terminated can you collect unemployment in Washington - confused about eligibility
My supervisor terminated me last Friday after 18 months at my job. They said it was due to performance issues but I disagree with their assessment. I'm wondering if I can still file for unemployment benefits through Washington ESD? I've never had to apply before and I'm not sure if being terminated disqualifies you automatically. Has anyone been in a similar situation? What should I expect during the application process?

Yes, you can definitely apply for unemployment benefits even if you were terminated. The key is WHY you were terminated. If it was for misconduct, that's different than performance issues. Washington ESD will investigate your claim during adjudication to determine if you're eligible.

•That's a relief to hear. They cited performance but I think it was really about personality conflicts with my manager. Should I mention that in my application?

•Be honest but stick to facts. Focus on the official reason they gave you for termination rather than speculation about underlying motives.

I got terminated for attendance issues last year and still qualified for benefits. The Washington ESD adjudicator asked me detailed questions about the circumstances. As long as it wasn't willful misconduct, you should be fine.

•How long did the adjudication process take? I'm worried about how I'll pay bills while waiting.

Mia Roberts
•Mine took about 3 weeks. The waiting was stressful but I eventually got approved and received back pay for the weeks I was waiting.

If you're having trouble getting through to Washington ESD to check on your claim status, I found this service called Claimyr that helped me connect with an actual agent. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Really helped when I was stuck in adjudication limbo.

•Thanks for the tip! I'll definitely check that out if I run into issues reaching them.

•Never heard of that service but anything that helps get through to Washington ESD sounds useful. Their phone lines are always busy.

The whole system is rigged against workers anyway. They'll find any excuse to deny your claim even when you paid into the system for years. Don't get your hopes up too high.

•That's not accurate. While the process can be frustrating, most legitimate claims do get approved. It's important to provide complete and honest information.

•Easy for you to say. I've seen plenty of people get screwed over by Washington ESD for bogus reasons.

wait so if I quit my job can I still get unemployment or only if I get fired?? I'm thinking about leaving my current position

Grace Lee
•Generally you need to be terminated or have 'good cause' to quit to qualify for benefits. Simply quitting because you don't like your job usually disqualifies you.

UPDATE: I filed my claim online through the Washington ESD website yesterday. The process was pretty straightforward but now it says my claim is pending adjudication. Should I be worried about this?

•Adjudication is normal when there's a separation issue like termination. They need to investigate the circumstances to determine eligibility. Don't panic - just be ready to provide documentation if they request it.

•Same thing happened to me. The adjudication process is standard procedure for most terminations. They'll probably contact your former employer too.

Make sure you keep filing your weekly claims even while in adjudication! I made the mistake of not filing thinking I had to wait and lost out on benefits for those weeks.

•Good point, I'll make sure to file every week. Do I need to do job searches while waiting for adjudication to complete?
0 coins
Oscar Murphy
•Yes, you still need to meet the job search requirements. I think it's 3 job contacts per week in Washington but double check that.

If you need to speak with someone at Washington ESD about your adjudication status, I mentioned Claimyr earlier but wanted to add that they really helped me get through when I couldn't reach anyone for weeks. The service connects you directly with agents instead of waiting on hold forever.

•I might need to try that if this drags on much longer. How quickly were you able to get through?

The Boss
•Much faster than calling directly. Within a day or two I was talking to an actual Washington ESD representative who could check my claim status.

Been there done that. Got terminated for supposedly violating company policy but really my boss just didn't like me. Took 4 weeks to get approved but I did get all my back pay. Hang in there!

•Thanks for sharing your experience. It's reassuring to hear from someone who went through something similar.

•Yeah the waiting sucks but most people do get approved eventually if they weren't fired for serious misconduct.

What documentation should I gather while waiting for adjudication? I want to be prepared in case they ask for more information.

Grace Lee
•Keep any termination paperwork, performance reviews, emails related to your termination, and your work schedule/pay stubs. Also document any unemployment you received.

•Perfect, I have most of that stuff already saved. Better to be over-prepared than caught off guard.

The job search requirement is real - make sure you're keeping a log of everywhere you apply. Washington ESD can audit your job search activities at any time.

William Rivera
•Is there a specific format I need to use for the job search log or can I just keep my own records?

Lauren Zeb
•You can use your own format but make sure to include employer name, position applied for, date, and method of contact. Some people use a simple spreadsheet.

My cousin got denied initially but won on appeal. Don't give up if they deny you the first time - you have rights and can fight it.

William Rivera
•Good to know there's an appeals process. Hopefully I won't need it but it's reassuring to have options.

Daniel Washington
•Yeah the appeals process exists for a reason. Sometimes the initial decision is wrong and gets overturned.

Question - do they contact your former employer during adjudication? I'm worried about burning bridges if Washington ESD calls them asking questions.
0 coins
Grace Lee
•Yes, they typically contact the employer to get their side of the story. It's part of the fact-finding process. Your employer is required to respond to these inquiries.

Aurora Lacasse
•Makes sense I guess. Just hope they stick to the facts and don't try to make me look worse than I already do.

The whole adjudication process feels like they're trying to find reasons to deny you. I understand they need to investigate but it's stressful when you need the money.

Oscar Murphy
•I felt the same way but try to think of it as them making sure the system is fair for everyone. They have to verify eligibility somehow.

Anthony Young
•True, I just wish it was faster. Bills don't stop coming while you wait for them to make a decision.

Anyone know if Washington ESD has specific guidelines about what counts as misconduct vs performance issues? Trying to understand where the line is drawn.
0 coins
Grace Lee
•Misconduct usually involves willful or deliberate violation of company rules. Poor performance due to inability rather than unwillingness is typically not considered misconduct for UI purposes.

Charlotte White
•That distinction makes sense. Intent seems to be the key factor in determining eligibility.

I used that Claimyr service mentioned earlier when I couldn't get through to Washington ESD about my pending claim. Worth every penny to actually talk to someone who could help instead of being stuck in phone tree hell.

•Seems like a lot of people have had success with that service. I'll definitely keep it in mind if I need to speak with someone urgently.

•Yeah, especially when you're dealing with time-sensitive issues like adjudication. Sometimes you just need to talk to a real person.

Don't forget you can also check your claim status online through the Washington ESD website. Not always detailed but at least shows if there are any updates.

William Rivera
•I've been checking daily but it just says 'adjudication in progress' with no other details. Pretty frustrating.

Matthew Sanchez
•Yeah the online system isn't great for details. Sometimes calling is the only way to get real information about what's happening.

The financial stress while waiting for adjudication is real. Make sure to look into other resources like food banks or utility assistance programs if you need help in the meantime.

William Rivera
•Thanks for the practical advice. I hadn't thought about other assistance programs but that's a good backup plan.

•Yeah, no shame in using available resources while you're between jobs. That's what they're there for.

Final UPDATE: My claim got approved! Took exactly 3 weeks and 2 days. The adjudicator determined that performance issues don't constitute misconduct. Thanks everyone for the advice and support!
