How long does fact finding take for Washington ESD unemployment claim?

My unemployment claim has been in fact finding status for 2 weeks now and I'm starting to worry. Washington ESD sent me a questionnaire about my separation from my last job and I submitted it within 3 days, but my claim is still pending. The online portal just says 'fact finding in progress' with no timeline. I really need these benefits to start coming through soon. Has anyone been through this process recently? How long should I expect to wait?

Mei Liu

fact finding can take anywhere from 2-6 weeks depending on how complex your case is and how backed up they are

0 coins

6 weeks?? I really hope it doesn't take that long. Did yours take the full 6 weeks?

0 coins

Mei Liu

mine took about 4 weeks but that was during a busy period last year

The fact finding process is when Washington ESD investigates the circumstances of your job separation to determine if you're eligible for benefits. They have to contact your former employer too, which can add time if the employer doesn't respond quickly. The good news is that if you're approved, you'll get backpay from when you first filed.

Do you know if there's any way to check on the status or speed things up? I've tried calling but can never get through.

0 coins

The phone lines are notoriously difficult. I'd suggest trying to call first thing in the morning when they open.

I was stuck in fact finding hell for 5 weeks earlier this year. Couldn't get through on the phone no matter when I called. Finally found this service called Claimyr (claimyr.com) that got me connected to an actual Washington ESD agent within minutes. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. The agent was able to tell me exactly where my case stood and what was holding it up.

0 coins

Really? How does that work exactly? I'm willing to try anything at this point.

0 coins

It's basically a callback service that monitors the phone lines and calls you back when an agent is available. Way better than sitting on hold for hours.

0 coins

That sounds too good to be true. What's the catch?

0 coins

Washington ESD is SO SLOW with everything. I've been waiting 3 weeks for my fact finding to finish and I'm about to lose my apartment. This system is completely broken!!!

0 coins

I feel your frustration. The waiting is the worst part because you can't plan anything.

0 coins

Have you tried contacting your state representative's office? Sometimes they can help with Washington ESD issues.

What was the reason for your separation? If it was a layoff or reduction in force, fact finding usually goes faster. If there was any misconduct involved or if you quit, it can take longer.

0 coins

It was a layoff due to budget cuts. My whole department got eliminated so hopefully that helps speed things up.

0 coins

Mei Liu

That should definitely work in your favor. Layoffs are pretty straightforward for Washington ESD to process.

0 coins

just went through this myself last month took exactly 3 weeks and 2 days from when I submitted my questionnaire

0 coins

That gives me hope! Did you get any updates during those 3 weeks or did it just suddenly get approved?

0 coins

no updates at all then boom one day I logged in and it said approved

0 coins

Make sure you keep filing your weekly claims even while fact finding is pending. A lot of people make the mistake of thinking they don't need to file, but you do need to maintain your claim.

0 coins

Yes I've been doing that! Thanks for the reminder though.

0 coins

Wait, I thought you couldn't file weekly claims during fact finding? I've been skipping mine...

0 coins

No, you absolutely need to keep filing! Contact Washington ESD immediately to explain the gap in your claims.

0 coins

Update: I used Claimyr again this week to check on a different issue and the agent told me they're currently running about 3-4 weeks for fact finding cases. So you're probably looking at another week or two max.

0 coins

Thanks for the update! I think I'm going to try that service too. Did you have any trouble with it?

0 coins

Not at all, it was super easy to use. Just fill out their form and they call you back when they get you connected.

0 coins

I'm skeptical of any service that charges to help with unemployment claims. Isn't this stuff supposed to be free?

0 coins

I get the skepticism but honestly after wasting weeks trying to get through on my own, it was worth it to actually talk to someone who could help.

0 coins

The Washington ESD services are free, but getting through to them is the hard part. Sometimes you need help with that.

0 coins

been there done that. fact finding is just another way for them to delay paying benefits. they're hoping you'll give up and find a job before they have to pay you

0 coins

That's pretty cynical but I sometimes wonder if there's truth to that.

0 coins

They are legally required to investigate certain types of job separations. It's not a conspiracy, it's federal law.

0 coins

The waiting is definitely the hardest part. Try to stay positive and remember that if you get approved, you'll get all the backpay from when you first filed.

0 coins

Thanks, I'm trying to stay hopeful. Just worried about bills in the meantime.

0 coins

my cousin had the same thing happen and it took exactly 21 days from start to finish

0 coins

That's helpful to know, thanks!

I work in HR and deal with Washington ESD fact finding requests regularly. From the employer side, we usually respond within a week, but sometimes it takes longer if the separation was complicated or if we need to gather documentation. The process really does take as long as it takes.

0 coins

That's really helpful insight from the other side. Do you know if employers can delay the process intentionally?

0 coins

Not intentionally delay, but some employers are slower to respond than others. Washington ESD will eventually make a decision even without employer input if they take too long.

Mei Liu

Just remember that no news is usually good news during fact finding. If there were major red flags, you'd probably hear about it sooner.

0 coins

That's reassuring, thank you.

0 coins

I tried calling Washington ESD every day for 2 weeks during my fact finding period and never got through once. Finally gave up and just waited it out. Took 4 weeks total but I did get approved.

0 coins

This is exactly why services like Claimyr exist. The phone system is just broken for regular people trying to get through.

0 coins

hang in there! I know the waiting sucks but most people do get approved eventually

0 coins

Thank you for the encouragement!

One more tip: make sure your contact information is up to date in your Washington ESD account. Sometimes they try to reach claimants during fact finding and if they can't reach you, it can delay the process even more.

0 coins

Good point, I'll double check that right now.

0 coins

Fact finding took 25 days for me but I think that's because my former employer disputed my claim initially. Once Washington ESD reviewed everything, I was approved and got 6 weeks of backpay.

0 coins

Wow, 6 weeks of backpay must have been nice! Hopefully my employer doesn't dispute anything.

0 coins

The fact finding process is actually pretty thorough. They review your work history, the circumstances of separation, and any documentation from both sides. It's annoying to wait but at least they're being careful.

0 coins

Being careful is fine but people have bills to pay. The system needs to be faster.

0 coins

Final update: I checked Claimyr's website again and they have some good info about Washington ESD timelines on their blog. Might be worth checking out while you wait.

0 coins

I'll definitely check that out. Thanks for all your help throughout this thread!
