What happens if my former employer doesn't respond to unemployment claim in Washington ESD?
I filed my unemployment claim with Washington ESD about 2 weeks ago and my former employer was supposed to respond to verify my separation details. The claim status still shows 'pending employer response' and I'm worried this is going to delay my benefits indefinitely. Does anyone know what Washington ESD does when employers just ignore these requests? Will my claim eventually get approved automatically or am I stuck waiting forever? I really need these benefits to start coming through.

Washington ESD gives employers 10 business days to respond to separation verification requests. If they don't respond within that timeframe, the claim typically gets processed based on the information you provided when filing.

•That's reassuring! So after 10 business days it should move forward automatically?

•In most cases yes, but sometimes there can be additional delays if Washington ESD needs to verify other information or if your case gets flagged for adjudication.

my employer never responded either and my claim got approved after about 3 weeks total. just had to wait it out

•3 weeks isn't too bad. I was worried it would be months!

•Some people wait way longer though, depends on your situation and if there are any red flags.

If you're having trouble getting through to Washington ESD to check on your claim status, you might want to try Claimyr. They helped me get connected to an actual agent when I was dealing with a similar employer non-response issue. Check out their demo at https://youtu.be/7DieNd3C7zQ and their site at claimyr.com. Made the whole process way less stressful.

•Wait, what exactly is Claimyr? Is it legit or one of those scam services?

•It's totally legit - they basically help you get through to Washington ESD phone lines when they're swamped. Saved me hours of calling and getting disconnected.

•I was skeptical too but ended up trying it when I couldn't reach anyone at Washington ESD for weeks. Actually worked and got me connected to someone who could explain what was happening with my claim.

THE WHOLE SYSTEM IS BROKEN! My employer didn't respond for 6 WEEKS and Washington ESD just sat on their hands doing nothing. Had to file an appeal just to get someone to look at my case. These people don't care if we starve waiting for benefits.

•6 weeks?! That's awful. Did you eventually get your benefits backdated?

•Yeah but only after threatening to contact my state representative. Shouldn't have to go to those lengths just to get what you're entitled to.

Important clarification - when employers don't respond, Washington ESD doesn't just automatically approve claims. They review the information you provided and may still conduct their own investigation if there are any inconsistencies or if the separation reason seems questionable.

•What kind of things would trigger additional investigation?

•Things like claiming you were laid off but your employer had previously filed misconduct reports, or if there are discrepancies in your work history or wage information.

•This happened to me - said I was laid off but apparently my supervisor had documented some attendance issues. Took 2 months to sort out.

honestly the waiting is the worst part. check your claim status obsessively like every day but nothing changes for weeks

Hunter Brighton
•I'm definitely doing that! Logging into my account multiple times a day hoping something changed.

•Same here! I probably check 5-6 times a day even though I know it's pointless.

Just want to add that when I used Claimyr to get through to Washington ESD, the agent I spoke with was able to tell me exactly where my claim stood in the process and what the next steps were. Sometimes just having that information can reduce the anxiety of waiting.

•That would definitely help with the stress. Not knowing what's happening is the worst part.

•How much does something like that cost though? Can't afford to pay extra fees when I'm already unemployed.

•I found it worth it just for the peace of mind, but I understand everyone's situation is different.

My understanding is that non-responsive employers actually get penalized by Washington ESD. They can face fines or have their unemployment tax rates increased if they consistently fail to respond to claim verifications.

•Good! My last employer never responded to anything from Washington ESD. Serves them right if they get penalized.

•Yeah, it's designed to encourage employers to participate in the process rather than just ignoring it and hoping claims get denied.

Keep filing your weekly claims even while you're waiting! A lot of people forget to do this and then have issues when their claim finally gets approved.

•Good point! I've been keeping up with my weekly claims but wasn't sure if I should.

•Definitely keep doing them. If you stop, you might have to restart the whole process or lose weeks of potential benefits.

•This is super important! I missed 2 weeks of claims while waiting and had to go through a whole appeals process to get those weeks back.

What if the employer responds but lies about the reason for separation? Like says you were fired for cause when you were actually laid off?
0 coins
Dylan Baskin
•That's when your case would go to adjudication. Washington ESD would review both sides and make a determination based on the evidence provided.

Paige Cantoni
•How do you prove you were laid off if they claim otherwise?

•Documentation like emails, text messages, witness statements, or even company-wide layoff announcements can help support your case.

Been there! My former employer finally responded after 3 weeks saying I quit when I was actually laid off due to budget cuts. Had to gather all my documentation and go through the appeals process. Ended up winning but it took an extra month.

Hunter Brighton
•That's my worst fear! I was definitely laid off but I'm worried they might say something different.

•Just make sure you have any documentation saved - emails about the layoff, company announcements, anything that shows it wasn't your choice to leave.

And don't even get me started on how hard it is to reach anyone at Washington ESD when you have questions about the delay. Phone lines are always busy and the online messaging system is useless.

•The phone situation is ridiculous. I've tried calling dozens of times and either get busy signals or sit on hold for hours just to get disconnected.

Kylo Ren
•This is exactly why I ended up using Claimyr - couldn't deal with the phone system anymore and needed to talk to someone who could actually help.

In my experience, if there are no red flags in your application and your employer doesn't respond, Washington ESD will typically approve the claim after their internal review period. But every case is different.

Hunter Brighton
•What would count as red flags in an application?

Emma Olsen
•Things like very recent job changes, unclear separation reasons, wage discrepancies, or if you've had previous unemployment claims with issues.

at least with non-responsive employers you don't have to worry about them fighting your claim. some employers will contest everything just to be difficult
0 coins
Lucas Lindsey
•True! Better to have a slow approval than a contested claim that drags on for months.
0 coins
Lauren Wood
•exactly. my friend's employer contested her claim even though she was clearly laid off. took 4 months to resolve.

Sometimes Washington ESD will try to contact the employer again if they don't respond the first time. I think they give them one more chance before processing the claim without their input.
0 coins
Hunter Brighton
•How long does that second attempt usually take?
0 coins
Sophie Duck
•Not sure exactly, but I think they give them another week or so before moving forward.

Check your online account regularly because sometimes Washington ESD will update your claim status or add notes even if they don't send you a notification. I found out my claim was approved by checking online before I got any official notice.
0 coins
Hunter Brighton
•Good tip! I'll make sure to keep checking beyond just the main status page.
0 coins
Austin Leonard
•Yeah, look at the correspondence section too - sometimes there are updates there that don't show up on the main claim page.

The whole process is designed to eventually move forward even if employers don't cooperate. Washington ESD can't just leave claims hanging indefinitely - they have performance metrics and federal requirements to meet for processing times.
0 coins
Hunter Brighton
•That's comforting to know! Feels like there's at least some accountability in the system.
0 coins
Nina Fitzgerald
•Performance metrics don't mean much when people are waiting months for benefits they desperately need.
0 coins
Anita George
•Fair point - the system definitely isn't perfect, but at least there are mechanisms to prevent claims from being stuck forever.

Just went through this exact situation last month. Employer never responded and my claim got approved after exactly 2 weeks and 3 days. Got all my back pay from the date I filed. Hang in there!

Hunter Brighton
•Thank you! That gives me hope that mine will move forward soon too.

•Just keep doing your weekly claims and try not to stress too much about it. The waiting is awful but it usually works out in the end.

•This is really encouraging to hear! I'm at about the 2 week mark now so hopefully I'll see movement soon. Did you get any notification when it was approved or did you just notice it when checking your account?

•I got both an email notification and saw the status change when I logged into my account. The email came about an hour after the status updated online. Definitely keep checking your account regularly!
